Ruling

Background 1. The estate subject to distribution is the estate of Mary Karugi Mwangi (deceased) who died on 15th May, 2016.

2. On 5th July, 2017 the Administrators herein petitioned for Letters of Administration intestate. However, the Objector filed her objection as the personal representative of the Estate of Renny Maina Mwangi a beneficiary of the estate of the deceased herein for having been left out of the estate.

3. On 24th September, 2018, the court in its ruling held that the Administrators erred in failing to include the estate of Renny Maina Mwangi in the list of beneficiaries of the deceased. The Administrators were also issued with the grant of letters of administration and were directed to provide a full inventory of all assets and liabilities of the deceased as well as an accurate account in respect of Kshs. 2,480,887. 87 which had been drawn from the deceased’s bank account.

Subsequently, the Administrators filed their Summons for Confirmation of Grant dated 10th February, 2020 where they gave their proposed mode of distribution which was objected to on the grounds that it was unfair, in that the estate of Renny Maina Mwangi was not consulted and that no valuation had been conducted.

5. On 22nd September, 2022 the court in its ruling directed that all the properties of the deceased be valued by a valuer to be agreed upon by both parties and an affidavit to be filed in court indicating the value of the shares of the deceased.

6. Later on 17th January, 2024, the court directed the parties to file and exchange written submissions on their proposed mode of distribution.

Objector’s Submissions 7. The Objector submitted that the Administrators did not disclose the number of shares of the deceased held in items xviii-xxvii and the value of shares the deceased held in companies listed from items xi-xxvii as per the list of assets provided in the Summons for Confirmation of Grant dated 10th February 2020. No evidence had been provided on the dividends declared from the deceased’s shares from the time of death as well as statements on funds held in the deceased’s account from the time of her death. The Objector sought orders that the Administrators render an account on where all the rental income collected from Flat No. 6 on LR. NO. 209/69/2 and Thika Section 9 on LR. NO. 4953/IX/14 had been deposited or how it had been utilized as well as how Kshs. 2,480,887. 87 withdrawn from the deceased’s account was spent.

Administrators’ Submissions. 9. The Administrators submitted that they have complied with the orders of the court and have always given a true and proper account of all assets, liabilities, incomes and that all the beneficiaries were duly informed. The claim that the estate of Renny Maina (deceased) was not consulted on the mode of distribution was said to be untrue and that the estate of Renny has been duly provided for and that the distribution was done fairly. It was submitted that any non-disclosure is due to the unavailability of the information at the time and that the statements of account are available to all the beneficiaries for perusal. Valuation was said to have been undertaken at the cost of the Administrators.

Issues for Determination 11. After reading the parties respective submissions this court has framed only one issue for determination which is distribution of the Estate of Mary Karugi Mwangi;

Analysis 12. In this instance there being no surviving spouse, the applicable section in these circumstances is found to be Section 38 which provides that the estate of the deceased be divided equally between the surviving children of the deceased; the section reads as follows;“38. Where intestate has left a surviving child or children but no spouse.Where an intestate has left a surviving child or children but no spouse, the net intestate estate shall, subject to the provisions of sections 41 and 42, devolve upon the surviving child, if there be only one, or shall be equally divided among the surviving children.”

13. Where the parties have failed to agree this court will apply the provisions of Section 38 of the Law of Succession as it is not disputed that both parents are deceased;. Findings and Determination 15. For the afore-going reasons this court makes the following findings and determination;i.The Protest is found to be partially with merit and it is hereby partially allowed;ii.The contentious properties of the estate of the deceased as set out in paragraph 13 shall be distributed in equal shares amongst the six (6) children of the deceased inclusive of the family of the Estate of Maina Mwangi;iii.The Grant is hereby confirmed on the terms set out in paragraphs 13 and 14;iv.The parties are at liberty to apply;v.Each party shall bear their own costs.It is so ordered.
