Ruling

Background 1. Deceased’s estate was distributed by Certificate of Confirmation of Grant issued on 02nd March, 2015 and rectified on 08th November, 2023.

Summons 1. By summons dated 22nd April, 2024, Florence Ntundu Ntoikuru (1st Administrator/Applicant) seeks the following orders: That-1. She be appointed as the sole administrator of Deceased’s estate for the reason that Micheck Mwenda Kairemia (2nd Administrator) has since died2. That the for share for Micheck Mwenda Kairemia be distributed to his estate or to his dependents in equal shares.

Analysis and Determination 2. I have considered the application in the light of the supporting affidavit and annexures thereto.

3. It has been demonstrated by a certificate of death that Micheck Mwenda Kairemia (2nd Administrator) died on 04th February, 2024.

4. I notice that the beneficiaries do not oppose the application and it is only fair that the same be allowed to allow the completion of the administration of the estate.

5. It is therefore hereby ordered:1. Florence Ntundu Ntoikuru is appointed as sole administrator of deceased’s estate2. Letters of Administration shall issue in the name of Florence Ntundu Ntoikuru3. Certificate of Confirmation of Grant issued on 02nd March, 2015 and rectified on 08th November, 2023 shall further be rectified distributing the share for Micheck Mwenda Kairemia to his estate4. Mention on 19th September, 2024 to confirm compliance with these orders and for any such further orders
