IN THE MATTER OF THE ESTATE OF PETER NJENGA KINUTHIA ALIAS PETER NJENGA

Ruling

1. I have considered the Application dated 6th February, 2025 that is seeking for Orders that the Land Control Board be allowed to proceed with sub-division of the land parcel Dagoretti/Ruthimitu/587 and process for transmission to beneficiaries of the estate without production of the original title deed.

2. The Respondent was ordered to submit the original title deed within 7 days, on 22nd February, 2022.

3. There was no compliance. The Hon. Judge also directed that the caution lodge against the said parcel of land be removed. The Respondent was served with the present application. She was also represented at the delivery of the Ruling of 22nd February, 2022.

4. As there is no compliance, the Applicant has made a good cause for the Orders sought. I allow the application dated 6th February, 2025 as prayed.

5. It is so ordered.
