Directions

1. These directions are in respect of three (3) applications, being: the summons dated 4th February, 2022, the Notice of motion dated 7th March, 2022 and the summons for revocation of grant dated 19th July, 2022.

2. The said applications are scheduled for ruling today. However, in the process of working on the ruling I found some gaps in relation to the properties belonging to the estate of the deceased. This is after going through the certificates of the confirmed grant and the proposed re-distribution.

3. For the said reasons the administrators herein are directed to avail to court copies of the title deeds together with current official searches for all the parcels of land falling under the estate of the deceased; bank statements, share certificates and the logbook.

4. The administrators are also directed to give an inventory of properties that have been sold from the estate, the names of beneficiaries who sold them and to whom they were sold. This is to enable this court reach a just and fair decision in relation to the distribution of the deceased’s estate.

5. The administrators are given sixty (60) days to avail the said documents. This matter shall be mentioned on 11th February, 2025 to confirm compliance.
