RULING

1. I have carefully perused the record and noted that the deceased hailed from Embu County, and that is where his survivors reside. The bulk of his estate is also situated there.

2. It would be more convenient for the matter to be handled at the High Court of Kenya sitting at Embu.

3. Consequently, I do hereby order that this cause be transferred to the said court for final disposal.

4. The files relating to Embu HCSC No. 354 of 2007 and Embu HCSC No. 111 of 2008 to be returned to the said registry.

5. It is so ordered.
