Ruling

1. The deceased Charles Abongo was domiciled in Kanyawegi area, according to the letter by the Assistant Chief, Upper Kanyawegi dated 12th June 2023.

2. The said letter identifies beneficiaries of the estate and already, a protest has been filed by Caleb Omolo Nyawina Abongo and Festus Oluoch Nyawina.

3. The parties are domiciled within the geographical location of Maseno Law Courts. The Petitioner Miyuga Joseph filed the petition at Kisumu Law Courts which has submitted the request for relocation of the Succession Cause to the court with geographical jurisdiction.

4. Accordingly, I hereby transfer Kisumu Chief Magistrate’s Court Succession Cause No. E256 of 2023 to Maseno Law Courts for hearing and determination.

5. The Petitioner and the Objectors to be notified forthwith, upon the e-file being transmitted to Maseno SPM’s Court to move that court.

6. This file is closed.
