Ruling

1. Having considered the summons for rectification of grant dated 25th February, 2025 together with the Supporting Affidavit by Ann Mukami Samuel. This Court finds favor in the same appreciating that intransigence by parties in succession proceedings often leads to withholding of critical documents to stall and delay conclusion.

2. This Court hereby dispenses with the requirement of surrender of original grant and certificate of confirmed grant as a requirement to be issued with a rectified grant.

3. The Deputy Registrar is accordingly directed to issue a duplicate grant together with a rectified certificate of confirmed grant.It is so ordered.
