They have no known criminal record in the USA. }{ \f0\fs24\insrsid753002\charrsid5581132 \par {\listtext\pard\plain\s15 \lang2057\langfe1033\langfenp1033\insrsid753002\charrsid5581132 \hich\af0\dbch\af36\loch\f0 5.\tab}\hich\af0\dbch\af36\loch\f0 The applicants apply for legal guardianship under Article 139(1) of the Constitution, Sections 14}{ \f0\fs24\insrsid14033337\charrsid5581132 \hich\af0\dbch\af36\loch\f0 }{\f0\fs24\insrsid753002\charrsid5581132 \hich\af0\dbch\af36\loch\f0 of the Judicature Act}{\f0\fs24\insrsid14033337\charrsid5581132 \hich\af0\dbch\af36\loch\f0 ,}{ \f0\fs24\insrsid753002\charrsid5581132 \hich\af0\dbch\af36\loch\f0 Section}{\f0\fs24\insrsid14033337\charrsid5581132 \hich\af0\dbch\af36\loch\f0 s 2,}{\f0\fs24\insrsid753002\charrsid5581132 \hich\af0\dbch\af36\loch\f0 3}{ \f0\fs24\insrsid14033337\charrsid5581132 \hich\af0\dbch\af36\loch\f0 , 4 and 5}{\f0\fs24\insrsid753002\charrsid5581132 \hich\af0\dbch\af36\loch\f0 of t\hich\af0\dbch\af36\loch\f0 he Children\hich\f0 \rquote \loch\f0 s Act}{ \f0\fs24\insrsid13522598\charrsid5581132 \hich\af0\dbch\af36\loch\f0 , Section 98 of the Civil Procedure Act and Order 52 Rules 1 and 3 of the Civil Procedure Rules}{\f0\fs24\insrsid753002\charrsid5581132 \hich\af0\dbch\af36\loch\f0 .}{ \f0\fs24\insrsid14169068\charrsid5581132 \hich\af0\dbch\af36\loch\f0 It is clear that the applicants\hich\f0 \rquote \loch\f0 intention is to adopt the infant in question }{\f0\fs24\insrsid12144666\charrsid5581132 \hich\af0\dbch\af36\loch\f0 and intend to do so in the USA in case this application decides.\hich\af0\dbch\af36\loch\f0 Given that scenario I would have been }{\f0\fs24\insrsid15472197\charrsid5581132 \hich\af0\dbch\af36\loch\f0 inclined to find that the applicable law should be Section 46 of the Children Act which deals with inter-country adoption.}{\f0\fs24\insrsid753002\charrsid5581132 \par {\listtext\pard\plain\s15 \lang2057\langfe1033\langfenp1033\insrsid6431993\charrsid5581132 \hich\af0\dbch\af36\loch\f0 6.\tab}}{\f0\fs24\insrsid6431993\charrsid5581132 \hich\af0\dbch\af36\loch\f0 However, t}{\f0\fs24\insrsid753002\charrsid5581132 \hich\af0\dbch\af36\loch\f0 he Court of Appeal, in the case of In the Matter of Francis Palmer an Infant, Civil \hich\af0\dbch\af36\loch\f0 Appeal No. 32 of 2006, and in the case of In the matter of Howard Amani Little, an infant, Civil Appeal No.33 of 2006 held that this court has jurisdiction to grant orders of legal guardianship by a 2 to 1 decision. What that decision does not make clear \hich\af0\dbch\af36\loch\f0 a\hich\af0\dbch\af36\loch\f0 re in what circumstances }{\f0\fs24\insrsid9246197\charrsid5581132 \hich\af0\dbch\af36\loch\f0 should}{\f0\fs24\insrsid753002\charrsid5581132 \hich\af0\dbch\af36\loch\f0 a court issue that kind of order, especially in cases that are akin to inter country adoptions. \par {\listtext\pard\plain\s15 \lang2057\langfe1033\langfenp1033\insrsid753002\charrsid5581132 \hich\af0\dbch\af36\loch\f0 7.\tab}\hich\af0\dbch\af36\loch\f0 In that the decision the }{\f0\fs24\insrsid12535066\charrsid5581132 \hich\af0\dbch\af36\loch\f0 C}{ \f0\fs24\insrsid753002\charrsid5581132 \hich\af0\dbch\af36\loch\f0 ourt of }{\f0\fs24\insrsid12535066\charrsid5581132 \hich\af0\dbch\af36\loch\f0 A}{\f0\fs24\insrsid753002\charrsid5581132 \hich\af0\dbch\af36\loch\f0 ppeal was divided as to when and how the High Court may grant orders of legal guardianship in\hich\af0\dbch\af36\loch\f0 the circumstances where the applicants were foreign applicants resident outside this country and whose intention of applying for legal guardianship was to take the children outside this jurisdiction. \par {\listtext\pard\plain\s15 \lang2057\langfe1033\langfenp1033\insrsid753002\charrsid5581132 \hich\af0\dbch\af36\loch\f0 8.\tab}\hich\af0\dbch\af36\loch\f0 One of the judges was of the view that legal guardiansh\hich\af0\dbch\af36\loch\f0 ip was to be resorted to where the applicants could not fulfil the conditions under Section 46 of the Children\hich\f0 \rquote \loch\f0 s Act. Another judge disagreed. Though in agreement that this court had jurisdiction to grant orders of legal guardianship, the judge stated tha\hich\af0\dbch\af36\loch\f0 t\hich\af0\dbch\af36\loch\f0 it should not be applicable where the applicants were foreign applicants who did not qualify under Section 46 of the Children\hich\f0 \rquote \loch\f0 s Act. To allow such applicants to obtain orders of legal guardianship, while they did not qualify to adopt the children under t\hich\af0\dbch\af36\loch\f0 h\hich\af0\dbch\af36\loch\f0 e Act, would be an infringement of the Act. The third judge did not agree that the High Court had the power to grant orders of legal guardianship, such power being only available to Family and Children\hich\f0 \rquote \loch\f0 s Court, by the issue of care orders and appointment \hich\af0\dbch\af36\loch\f0 o\hich\af0\dbch\af36\loch\f0 f Foster Parents. \par {\listtext\pard\plain\s15 \lang2057\langfe1033\langfenp1033\insrsid753002\charrsid5581132 \hich\af0\dbch\af36\loch\f0 9.\tab}\hich\af0\dbch\af36\loch\f0 The Court of Appeal decision, given the conflicting legal positions taken by each judge, provides no authoritative guidance as to how this court should exercise its power in granting orders of legal guardianship.
