They visited Amani Baby Cottage. They came to the conclusion that they could offer a home to Michael and }{\f0\fs24\insrsid14489840\charrsid467424 \hich\af0\dbch\af39\loch\f0 take him up as their child.}{\f0\fs24\insrsid15938674\charrsid467424

\par {\listtext\pard\plain\s15 \lang2057\langfe1033\langfenp1033\insrsid619970\charrsid467424 \hich\af0\dbch\af39\loch\f0 6.\tab}}{\f0\fs24\insrsid619970\charrsid467424 \hich\af0\dbch\af39\loch\f0 I am satis\hich\af0\dbch\af39\loch\f0 fied that the applicants, on the facts available to me, are suitable adoptive parents}{\f0\fs24\insrsid10516886\charrsid467424 \hich\af0\dbch\af39\loch\f0 and or guardians}{\f0\fs24\insrsid619970\charrsid467424 \hich\af0\dbch\af39\loch\f0 . I must now turn to the law}{\f0\fs24\insrsid10516886\charrsid467424 \hich\af0\dbch\af39\loch\f0 and determine whether }{\f0\fs24\insrsid14188405\charrsid467424 \hich\af0\dbch\af39\loch\f0 it is possible for this court to make the order sought}{ \f0\fs24\insrsid619970\charrsid467424 \hich\af0\dbch\af39\loch\f0 . \par {\listtext\pard\plain\s15 \lang2057\langfe1033\langfenp1033\insrsid619970\charrsid467424 \hich\af0\dbch\af39\loch\f0 7.\tab}}\pard \s15\ql \fi-360\li720\ri0\sl360\slmult1\widctlpar\aspalpha\aspnum\faauto\ls1\adjustright\rin0\lin720\itap0\pararsid467424 { \f0\fs24\insrsid619970\charrsid467424 \hich\af0\dbch\af39\loch\f0 The applicants apply for legal guardianship und\hich\af0\dbch\af39\loch\f0 er Sections }{\f0\fs24\insrsid14898595\charrsid467424 \hich\af0\dbch\af39\loch\f0 33}{ \f0\fs24\insrsid619970\charrsid467424 \hich\af0\dbch\af39\loch\f0 of the Judicature Act, Sections 3of the Children}{\f0\fs24\insrsid13310885\charrsid467424 \hich\af0\dbch\af39\loch\f0 Act and}{\f0\fs24\insrsid619970\charrsid467424 \hich\af0\dbch\af39\loch\f0 Section 98 of the Civil Procedure Act. It is clear that the applicants\hich\f0 \rquote \loch\f0 intention is to adopt the infant in question and intend to do so in the USA in case this application succeeds. G \hich\af0\dbch\af39\loch\f0 iven that scenario I would have been inclined to find that the applicable law should be Section 46 of the Children Act which deals with inter-country adoption, in which case, this application}{ \f0\fs24\insrsid14188405\charrsid467424 \hich\af0\dbch\af39\loch\f0 , on its face,}{\f0\fs24\insrsid619970\charrsid467424 \hich\af0\dbch\af39\loch\f0 would have failed given the fact that the applican\hich\af0\dbch\af39\loch\f0 ts would not have complied with the residency requirement and the 36 months foster period. \par {\listtext\pard\plain\s15 \lang2057\langfe1033\langfenp1033\insrsid619970\charrsid467424 \hich\af0\dbch\af39\loch\f0 8.\tab}\hich\af0\dbch\af39\loch\f0 However, the Court of Appeal, in the case of }{\f0\fs24\ul\insrsid619970\charrsid467424 \hich\af0\dbch\af39\loch\f0 In the Matter of Francis Palmer an Infant, Civil Appeal No. 32 of 2006}{\f0\fs24\insrsid619970\charrsid467424 \hich\af0\dbch\af39\loch\f0 , and in the case of }{\f0\fs24\ul\insrsid619970\charrsid467424 \hich\af0\dbch\af39\loch\f0 In the matter of Howard Amani\hich\af0\dbch\af39\loch\f0 Little, an infant, Civil Appeal No.33 of 2006}{\f0\fs24\insrsid619970\charrsid467424 \hich\af0\dbch\af39\loch\f0 held that this court has jurisdiction to grant orders of legal guardianship by a 2 to 1 decision. What that decision does not make clear are in what circumstances should a court issue that kind of order, espec\hich\af0\dbch\af39\loch\f0 ially in cases that are akin to inter country adoptions. \par {\listtext\pard\plain\s15 \lang2057\langfe1033\langfenp1033\insrsid619970\charrsid467424 \hich\af0\dbch\af39\loch\f0 9.\tab}\hich\af0\dbch\af39\loch\f0 In that the decision the Court of Appeal was divided as to when and how the High Court may grant orders of legal guardianship in the circumstances where the applicants were foreign applicants residen\hich\af0\dbch\af39\loch\f0 t outside this country and whose intention of applying for legal guardianship was to take the children outside this jurisdiction. \par {\listtext\pard\plain\s15 \lang2057\langfe1033\langfenp1033\insrsid619970\charrsid467424 \hich\af0\dbch\af39\loch\f0 10.\tab}\hich\af0\dbch\af39\loch\f0 The Presiding Justice was of the view that legal guardianship was to be resorted to where the applicants could not fulfil the \hich\af0\dbch\af39\loch\f0 conditions under Section 46 of the Children\hich\f0 \rquote \loch\f0 s Act. The second Justice of Appeal disagreed. Though in agreement with the presiding justice that this court had jurisdiction to grant orders of legal guardianship, the justice of appeal stated that it should n\hich\af0\dbch\af39\loch\f0 o \hich\af0\dbch\af39\loch\f0 t be applicable where the applicants were foreign applicants who did not qualify under Section 46 of the Children\hich\f0 \rquote \loch\f0 s Act. To allow such applicants to obtain orders of legal guardianship, while they did not qualify to adopt the children under the Act, would\hich\af0\dbch\af39\loch\f0 \hich\af0\dbch\af39\loch\f0 be an infringement of the Act. The third Justice of Appeal did not agree that the High Court had the power to grant orders of legal guardianship, such power being only available to Family and Children\hich\f0 \rquote \loch\f0 s Court, by the issue of care orders and appointment o\hich\af0\dbch\af39\loch\f0 f\hich\af0\dbch\af39\loch\f0 Foster Parents. Nevertheless he concurred in the granting of the order of guardianship proposed by the Presiding Justice. \par {\listtext\pard\plain\s15 \lang2057\langfe1033\langfenp1033\insrsid619970\charrsid467424 \hich\af0\dbch\af39\loch\f0 11.\tab}\hich\af0\dbch\af39\loch\f0 The Court of Appeal decision, given the conflicting legal positions taken by each justice, provides no authoritative guidance as to h\hich\af0\dbch\af39\loch\f0 ow this court should exercise its power in granting orders of legal guardianship. In the result\hich\af0\dbch\af39\loch\f0 ,\hich\af0\dbch\af39\loch\f0 perhaps\hich\af0\dbch\af39\loch\f0 ,\hich\af0\dbch\af39\loch\f0 I must turn to simply one question. Is the grant of such an order in the best interest of the infant? \par {\listtext\pard\plain\s15 \lang2057\langfe1033\langfenp1033\insrsid619970\charrsid467424 \hich\af0\dbch\af39\loch\f0 12.\tab}\hich\af0\dbch\af39\loch\f0 What is needed for this infant and many other in\hich\af0\dbch\af39\loch\f0 fants in h \hich\af0\dbch\af39\loch\f0 is\hich\af0\dbch\af39\loch\f0 position is a home with loving parents and a family. This infant is being provided an opportunity to grow up in a loving family environment to be provided by the applicants. The infant\hich\f0 \rquote \loch\f0 s current circumstances}{\f0\fs24\insrsid9659156\charrsid467424 \hich\af0\dbch\af39\loch\f0 as a resident of an orphanage are \hich\af0\dbch\af39\loch\f0 only intended to be temporary}{\f0\fs24\insrsid11155884\charrsid467424 \hich\af0\dbch\af39\loch\f0 , pending the availability of a suitable home in which this infant can be raised.}{\f0\fs24\insrsid619970\charrsid467424 \hich\af0\dbch\af39\loch\f0 }{\f0\fs24\insrsid11155884\charrsid467424 \hich\af0\dbch\af39\loch\f0 The fate of the infant\hich\f0 \rquote \loch\f0 s parents is not known. No information is available on them.}{\f0\fs24\insrsid3231746\charrsid467424 \par {\listtext\pard\plain\s15 \lang2057\langfe1033\langfenp1033\insrsid619970\charrsid467424 \hich\af0\dbch\af39\loch\f0 13.\tab}}{\f0\fs24\insrsid619970\charrsid467424 \hich\af0\dbch\af39\loch\f0 No governmental support, be it local or central, is availabl \hich\af0\dbch\af39\loch\f0 e for the care and upkeep of the infants generally or specifically in the case of this child. }{\f0\fs24\insrsid3231746\charrsid467424 \hich\af0\dbch\af39\loch\f0 Right now it is under the care of a local non-governmental organisation. }{\f0\fs24\insrsid8786365\charrsid467424 \hich\af0\dbch\af39\loch\f0 There is no offer from Ugandans or non-Ugandans resident in Uganda to take up the respons \hich\af0\dbch\af39\loch\f0 ibility of looking after this infant. }{\f0\fs24\insrsid619970\charrsid467424 \hich\af0\dbch\af39\loch\f0 I find therefore that exceptional circumstances exist for an order to be made in favour of non \hich\af0\dbch\af39\loch\f0 citizens\hich\af0\dbch\af39\loch\f0 who are the only viable alternative. \par {\listtext\pard\plain\s15 \lang2057\langfe1033\langfenp1033\insrsid619970\charrsid467424 \hich\af0\dbch\af39\loch\f0 14.\tab}\hich\af0\dbch\af39\loch\f0 I am satisfied that it is in the infant\hich\f0 \rquote \loch\f0 s best interests to grant rather tha \hich\af0\dbch\af39\loch\f0 n refuse this application. Accordingly I grant an order of legal guardianship of }{\f0\fs24\insrsid11082507\charrsid467424 \hich\af0\dbch\af39\loch\f0 Micheal}{\f0\fs24\insrsid619970\charrsid467424 \hich\af0\dbch\af39\loch\f0 to the applicants effective immediately.}{\f0\fs24\insrsid10180523\charrsid467424 \par {\listtext\pard\plain\s15 \lang2057\langfe1033\langfenp1033\insrsid10180523\charrsid467424 \hich\af0\dbch\af39\loch\f0 15.\tab}\hich\af0\dbch\af39\loch\f0 Before I take leave of this matter I wish to draw the attention of Government to the unsatisfactory state of the law with rega\hich\af0\dbch\af39\loch\f0 rd to guardianship of children and inter}{\f0\fs24\insrsid10646549\charrsid467424 \hich\af0\dbch\af39\loch\f0 -}{\f0\fs24\insrsid10180523\charrsid467424 \hich\af0\dbch\af39\loch\f0 country adoption. Based on the}{\f0\fs24\insrsid9712494\charrsid467424 \hich\af0\dbch\af39\loch\f0 increasing frequency and volume of }{ \f0\fs24\insrsid10180523\charrsid467424 \hich\af0\dbch\af39\loch\f0 applications for guardianship by non resident}{\f0\fs24\insrsid6386877\charrsid467424 \hich\af0\dbch\af39\loch\f0 s}{\f0\fs24\insrsid10180523\charrsid467424 \hich\af0\dbch\af39\loch\f0 } {\f0\fs24\insrsid6570583\charrsid467424 \hich\af0\dbch\af39\loch\f0 and non citizens of this country in our courts it is apparent that this is so because of the stringent\hich\af0\dbch\af39\loch\f0 nature}{\f0\fs24\insrsid619970\charrsid467424 \hich\af0\dbch\af39\loch\f0 }{\f0\fs24\insrsid16341690\charrsid467424 \hich\af0\dbch\af39\loch\f0 of the law with regard to inter}{\f0\fs24\insrsid10646549\charrsid467424 \hich\af0\dbch\af39\loch\f0 -}{\f0\fs24\insrsid16341690\charrsid467424 \hich\af0\dbch\af39\loch\f0 country adoptions that makes virtually impossible }{\f0\fs24\insrsid11798649\charrsid467424 \hich\af0\dbch\af39\loch\f0 adoptions of children born and living in Uganda by }{\f0\fs24\insrsid16341690\charrsid467424 \hich\af0\dbch\af39\loch\f0 non citizens not resident in}{\f0\fs24\insrsid9183393\charrsid467424 \hich\af0\dbch\af39\loch\f0 Uganda}{\f0\fs24\insrsid16341690\charrsid467424 \hich\af0\dbch\af39\loch\f0 .}{\f0\fs24\insrsid6386877\charrsid467424 \hich\af0\dbch\af39\loch\f0 \par {\listtext\pard\plain\s15 \lang2057\langfe1033\langfenp1033\insrsid6386877\charrsid467424 \hich\af0\dbch\af39\loch\f0 16.\tab}\hich\af0\dbch\af39\loch\f0 During the proceedings for }{\f0\fs24\insrsid9183393\charrsid467424 \hich\af0\dbch\af39\loch\f0 g}{ \f0\fs24\insrsid6386877\charrsid467424 \hich\af0\dbch\af39\loch\f0 uardianship there is no independent representatio\hich\af0\dbch\af39\loch\f0 n of the child or infant in question}{\f0\fs24\insrsid7894562\charrsid467424 \hich\af0\dbch\af39\loch\f0 to test the suitability of the applicants and the information that they present to court}{\f0\fs24\insrsid6386877\charrsid467424 \hich\af0\dbch\af39\loch\f0 . Basically it is the applicants and the child or children only before the court with a supporting cast of counsel, relatives of th\hich\af0\dbch\af39\loch\f0 e child and or those in custody of the child.}{\f0\fs24\insrsid619970\charrsid467424 \par {\listtext\pard\plain\s15 \lang2057\langfe1033\langfenp1033\insrsid16341690\charrsid467424 \hich\af0\dbch\af39\loch\f0 17.\tab}}{\f0\fs24\insrsid16341690\charrsid467424 \hich\af0\dbch\af39\loch\f0 There are no statutory guidelines with regard to guardianship of children}{\f0\fs24\insrsid14036467\charrsid467424 \hich\af0\dbch\af39\loch\f0 . There is no register for guardianship orders issued by this court, especially in the case of non citizens who take the children outside}{\f0\fs24\insrsid7894562\charrsid467424 \hich\af0\dbch\af39\loch\f0 the country}{ \f0\fs24\insrsid14036467\charrsid467424 \hich\af0\dbch\af39\loch\f0 , unlike the one available for adoption orders.}{\f0\fs24\insrsid12925944\charrsid467424 \hich\af0\dbch\af39\loch\f0 This is bound to make it difficult if any information is required at some stage in the child\hich\f0 \rquote \loch\f0 s or its guardians\hich\f0 \rquote \loch\f0 life.}{\f0\fs24\insrsid16341690\charrsid467424 \par {\listtext\pard\plain\s15 \lang2057\langfe1033\langfenp1033\insrsid6882346\charrsid467424 \hich\af0\dbch\af39\loch\f0 18.\tab}}{\f0\fs24\insrsid6882346\charrsid467424 \hich\af0\dbch\af39\loch\f0 It appears to me that in its effect Section 46 of the Children }{\f0\fs24\insrsid8729936\charrsid467424 \hich\af0\dbch\af39\loch\f0 Act }{\f0\fs24\insrsid6882346\charrsid467424 \hich\af0\dbch\af39\loch\f0 effectivel\hich\af0\dbch\af39\loch\f0 y denies children the possibility}{\f0\fs24\insrsid7894562\charrsid467424 \hich\af0\dbch\af39\loch\f0 of adoption and care}{\f0\fs24\insrsid8024000\charrsid467424 \hich\af0\dbch\af39\loch\f0 ,}{\f0\fs24\insrsid6882346\charrsid467424 \hich\af0\dbch\af39\loch\f0 }{\f0\fs24\insrsid8024000\charrsid467424 \hich\af0\dbch\af39\loch\f0 at times, of the only adoptive parents available to them, simply on the }{\f0\fs24\insrsid8729936\charrsid467424 \hich\af0\dbch\af39\loch\f0 basis that those prospective adoptive parents}{\f0\fs24\insrsid8024000\charrsid467424 \hich\af0\dbch\af39\loch\f0 are non-citizens of this country. In doing so this may not be in the best interest\hich\af0\dbch\af39\loch\f0 s of those children in distress}{\f0\fs24\insrsid8743456\charrsid467424 \hich\af0\dbch\af39\loch\f0 with no parents to look after them}{\f0\fs24\insrsid8729936\charrsid467424 \hich\af0\dbch\af39\loch\f0 and no offer from local adoptive parents}{ \f0\fs24\insrsid8024000\charrsid467424 \hich\af0\dbch\af39\loch\f0 .}{\f0\fs24\insrsid8743456\charrsid467424 \hich\af0\dbch\af39\loch\f0 In such cases it may well be that Section 46 of the Children Act runs counter to Article 34 of the Constitution that requires}{\f0\fs24\insrsid4536891\charrsid467424 \hich\af0\dbch\af39\loch\f0 , inter alia,}{\f0\fs24\insrsid8743456\charrsid467424 \hich\af0\dbch\af39\loch\f0 }{\f0\fs24\insrsid1059491\charrsid467424 \hich\af0\dbch\af39\loch\f0 laws rel\hich\af0\dbch\af39\loch\f0 ating to children to be enacted in their best interests.}{\f0\fs24\insrsid2365725\charrsid467424 \hich\af0\dbch\af39\loch\f0 It is questionable if Section 46 is in the best interests of children.}{\f0\fs24\insrsid6882346\charrsid467424 \par {\listtext\pard\plain\s15 \lang2057\langfe1033\langfenp1033\insrsid3364227\charrsid467424 \hich\af0\dbch\af39\loch\f0 19.\tab}}{\f0\fs24\insrsid3364227\charrsid467424 \hich\af0\dbch\af39\loch\f0 A somewhat similar point was considered by the Constitutional Court of South Africa in The Minister of Welfare and Population De\hich\af0\dbch\af39\loch\f0 velopment v Sara Jane Fitzpatrick and Anor Case No. CCT 08/2000}{ \f0\fs24\insrsid10824617\charrsid467424 \hich\af0\dbch\af39\loch\f0 . }{\f0\fs24\insrsid6898068\charrsid467424 \hich\af0\dbch\af39\loch\f0 Section 18 (4) (f) of t}{\f0\fs24\insrsid10824617\charrsid467424 \hich\af0\dbch\af39\loch\f0 he South African Children }{\f0\fs24\insrsid6898068\charrsid467424 \hich\af0\dbch\af39\loch\f0 Care Act bluntly }{\f0\fs24\insrsid10824617\charrsid467424 \hich\af0\dbch\af39\loch\f0 barred non South African citizens from being able to adopt South African children.}{\f0\fs24\insrsid12719154\charrsid467424 \hich\af0\dbch\af39\loch\f0 }{\f0\fs24\insrsid5576451\charrsid467424 \hich\af0\dbch\af39\loch\f0 The Constitutional Court held }{ \f0\fs24\insrsid4526384\charrsid467424 \hich\af0\dbch\af39\loch\f0 that Sectio\hich\af0\dbch\af39\loch\f0 n 18 (4) (f) was un}{\f0\fs24\insrsid4724304\charrsid467424 the wording is varied. }{ \f0\fs24\insrsid9984682\charrsid467424 \hich\af0\dbch\af39\loch\f0 To an extent, and in its effect, Section 46 of our Children Act is similar to Section 18 (4) (f) of the South Africa Children Care Act although}{\f0\fs24\insrsid7096676\charrsid467424 \hich\af0\dbch\af39\loch\f0 it is not as pervasive as the }{\f0\fs24\insrsid4536891\charrsid467424 \hich\af0\dbch\af39\loch\f0 former}{\f0\fs24\insrsid7096676\charrsid467424 \hich\af0\dbch\af39\loch\f0 .}{\f0\fs24\insrsid9984682\charrsid467424 \hich\af0\dbch\af39\loch\f0 }{\f0\fs24\insrsid7096676\charrsid467424 \hich\af0\dbch\af39\loch\f0 I}{\f0\fs24\insrsid9984682\charrsid467424 \hich\af0\dbch\af39\loch\f0 t leave\hich\af0\dbch\af39\loch\f0 s a small window of opportunity for resident non-citizens.}{\f0\fs24\insrsid3364227\charrsid467424 \par {\listtext\pard\plain\s15 \lang2057\langfe1033\langfenp1033\insrsid16404982\charrsid467424 \hich\af0\dbch\af39\loch\f0 20.\tab}}{\f0\fs24\insrsid16404982\charrsid467424 \hich\af0\dbch\af39\loch\f0 Section 46 of the Children Act does not possibly run counter to our Constitution only but may also be in conflict with Uganda\hich\f0 \rquote \loch\f0 s obligations under }{\f0\fs24\insrsid15157174\charrsid467424 \hich\af0\dbch\af39\loch\f0 Article 3(1) of}{\f0\fs24\insrsid16404982\charrsid467424 \hich\af0\dbch\af39\loch\f0 }{\f0\fs24\insrsid13980411\charrsid467424 \hich\af0\dbch\af39\loch\f0 the International}{\f0\fs24\insrsid15157174\charrsid467424
