The law applicable therefore would be Section \hich\af0\dbch\af36\loch\f0 46 of the Children Act which deals with inter country adoption. }{\f0\fs24\insrsid1011737 \par {\listtext\pard\plain\s15 \lang2057\langfe1033\langnp2057\insrsid5454791 \hich\af0\dbch\af36\loch\f0 6.\tab}}{\f0\fs24\insrsid5454791 \hich\af0\dbch\af36\loch\f0 Clearly the applicants under Section 46 of the Children Act would not qualify on at least 2 out }{\f0\fs24\insrsid917992 \hich\af0\dbch\af36\loch\f0 of the }{\f0\fs24\insrsid15164705 \hich\af0\dbch\af36\loch\f0 6}{\f0\fs24\insrsid917992 \hich\af0\dbch\af36\loch\f0 conditions that have to be fulfilled. The applicants have not been residents in this c\hich\af0\dbch\af36\loch\f0 ountry for 3 years and have not fostered the infant in question at all let alone the required period of 36 months.}{\f0\fs24\insrsid1929220 \hich\af0\dbch\af36\loch\f0 }{\f0\fs24\insrsid8868456 \hich\af0\dbch\af36\loch\f0 T}{\f0\fs24\insrsid1929220 \hich\af0\dbch\af36\loch\f0 he applicants would fulfil the rest of the conditions.}{\f0\fs24\insrsid15954828 \hich\af0\dbch\af36\loch\f0 I shall set out Section 46 of the Children Act below. }{\f0\fs24\insrsid15219956 \par }\pard \s15\ql \li1440\ri1109\widctlpar\aspalpha\aspnum\faauto\adjustright\rin1109\lin1440\itap0\pararsid13260798 {\f0\fs24\insrsid15219956 \loch\af0\dbch\af36\hich\f0 \lquote }{\f0\fs24\insrsid15954828 \hich\af0\dbch\af36\loch\f0 46 }{ \f0\fs24\insrsid15219956 \hich\af0\dbch\af36\loch\f0 }{\b\f0\fs24\insrsid15954828\charrsid10637642 \hich\af0\dbch\af36\loch\f0 Intercountry Adoption }{\b\f0\fs24\insrsid15219956\charrsid10637642 \hich\af0\dbch\af36\loch\f0 \hich\af0\dbch\af36\loch\f0 }{\f0\fs24\insrsid15954828 \hich\af0\dbch\af36\loch\f0 (1) }{\f0\fs24\insrsid16545077 \hich\af0\dbch\af36\loch\f0 A person who is not a citizen of Uganda may in exceptional circumstances adopt a Ugandan child, if he or she-- }{\f0\fs24\insrsid15219956 \hich\af0\dbch\af36\loch\f0 }{\f0\fs24\insrsid16545077 \hich\af0\dbch\af36\loch\f0 (a) has stayed in Ugan\hich\af0\dbch\af36\loch\f0 da for at least three years; }{\f0\fs24\insrsid15219956 \hich\af0\dbch\af36\loch\f0 }{\f0\fs24\insrsid16545077 \hich\af0\dbch\af36\loch\f0 (b) has fostered the child for at least thirty six months under the supervision of a probation and social welfare officer; }{\f0\fs24\insrsid15219956 \hich\af0\dbch\af36\loch\f0 \hich\af0\dbch\af36\loch\f0 }{\f0\fs24\insrsid16545077 \hich\af0\dbch\af36\loch\f0 (c) does not have a criminal record; }{\f0\fs24\insrsid15219956 \hich\af0\dbch\af36\loch\f0 }{ \f0\fs24\insrsid16545077 \hich\af0\dbch\af36\loch\f0 (d) has a recommendation concerning his or her suitability to adopt a child from his or her country\hich\f0 \rquote \loch\f0 s probation and welfare office or other comp}{\f0\fs24\insrsid15219956 \hich\af0\dbch\af36\loch\f0 e}{\f0\fs24\insrsid16545077 \hich\af0\dbch\af36\loch\f0 tent\hich\af0\dbch\af36\loch\f0 authority; and }{\f0\fs24\insrsid15219956 \hich\af0\dbch\af36\loch\f0 }{\f0\fs24\insrsid16545077 \hich\af0\dbch\af36\loch\f0 (e)}{\f0\fs24\insrsid11744768 \hich\af0\dbch\af36\loch\f0 has satis}{\f0\fs24\insrsid16545077 \hich\af0\dbch\af36\loch\f0 fied the court that his or her country of origin will respect and recognise the adoption order.\hich\f0 \rquote }{\f0\fs24\insrsid5454791 \par {\listtext\pard\plain\s15 \lang2057\langfe1033\langnp2057\insrsid13924280 \hich\af0\dbch\af36\loch\f0 7.\tab}}\pard \s15\qj \fi-360\li720\ri0\sl360\slmult1\widctlpar\aspalpha\aspnum\faauto\ls1\adjustright\rin0\lin720\itap0\pararsid13260798 { \f0\fs24\insrsid13924280 \hich\af0\dbch\af36\loch\f0 As the clear route of adoption is closed}{\f0\fs24\insrsid1929220\charrsid15232272 \hich\af0\dbch\af36\loch\f0 the applicants \hich\af0\dbch\af36\loch\f0 have resorted to}{\f0\fs24\insrsid7292210 \hich\af0\dbch\af36\loch\f0 another route. They have}{\f0\fs24\insrsid1929220\charrsid15232272 \hich\af0\dbch\af36\loch\f0 appl}{\f0\fs24\insrsid7292210 \hich\af0\dbch\af36\loch\f0 ied}{\f0\fs24\insrsid1929220\charrsid15232272 \hich\af0\dbch\af36\loch\f0 for legal guardianship under the provisions of the law }{\f0\fs24\insrsid1840473 \hich\af0\dbch\af36\loch\f0 noted above}{\f0\fs24\insrsid1929220\charrsid15232272 \hich\af0\dbch\af36\loch\f0 . }{ \f0\fs24\insrsid1140412\charrsid15232272 \hich\af0\dbch\af36\loch\f0 I am sceptical whether those provisions would grant this court the authority to grant an order of legal guardianship}{\f0\fs24\insrsid1933106\charrsid15232272 \hich\af0\dbch\af36\loch\f0 in the circumstances\hich\af0\dbch\af36\loch\f0 of this case.}{\f0\fs24\insrsid15099220\charrsid15232272 \hich\af0\dbch\af36\loch\f0 Firstly}{\f0\fs24\insrsid1840473 \hich\af0\dbch\af36\loch\f0 ,}{ \f0\fs24\insrsid15099220\charrsid15232272 \hich\af0\dbch\af36\loch\f0 because clearly the law that would govern the circumstances of this case}{\f0\fs24\insrsid15212024 \hich\af0\dbch\af36\loch\f0 is the law related to inter}{\f0\fs24\insrsid11545892 \hich\af0\dbch\af36\loch\f0 }{\f0\fs24\insrsid15212024 \hich\af0\dbch\af36\loch\f0 country adoption,}{\f0\fs24\insrsid15099220\charrsid15232272 \hich\af0\dbch\af36\loch\f0 which is evaded by the p}{\f0\fs24\insrsid13183197 \hich\af0\dbch\af36\loch\f0 resent application. Secondly th}{\f0\fs24\insrsid15099220\charrsid15232272 \hich\af0\dbch\af36\loch\f0 e provisions}{\f0\fs24\insrsid13183197 \hich\af0\dbch\af36\loch\f0 cited as the basis for this application}{\f0\fs24\insrsid15099220\charrsid15232272 \hich\af0\dbch\af36\loch\f0 d}{\f0\fs24\insrsid15232272 \hich\af0\dbch\af36\loch\f0 o no\hich\af0\dbch\af36\loch\f0 t provide expressly that this court is seized with the jurisdiction to grant orders of the kind now sought.}{\f0\fs24\insrsid264342 \hich\af0\dbch\af36\loch\f0 However}{\f0\fs24\insrsid13370705 \hich\af0\dbch\af36\loch\f0 , }{\f0\fs24\insrsid264342 \hich\af0\dbch\af36\loch\f0 the Court of Appeal has in }{\f0\fs24\insrsid264342\charrsid15232272 \hich\af0\dbch\af36\loch\f0 the case of }{\i\f0\fs24\ul\insrsid264342\charrsid13370705 \hich\af0\dbch\af36\loch\f0 In the Matter of Francis Palmer an Infant, Civil Appeal No. 32 of 2006}{\f0\fs24\insrsid264342\charrsid15232272 \hich\af0\dbch\af36\loch\f0 , and in the case of }{ \i\f0\fs24\ul\insrsid264342\charrsid13370705 \hich\af0\dbch\af36\loch\f0 In the m\hich\af0\dbch\af36\loch\f0 atter of Howard Amani Little, an infant, Civil Appeal No.33 of 2006}{\f0\fs24\insrsid264342 \hich\af0\dbch\af36\loch\f0 }{ \f0\fs24\insrsid10052513 \hich\af0\dbch\af36\loch\f0 held }{\f0\fs24\insrsid5127077 \hich\af0\dbch\af36\loch\f0 that this court has jurisdiction and authority to grant orders of legal guardianship. In that regard I am bound to follow that decision.}{ \f0\fs24\insrsid10708398 \hich\af0\dbch\af36\loch\f0 }{\f0\fs24\insrsid1011737\charrsid10708398 \hich\af0\dbch\af36\loch\f0 What that decision does not make clear are}{\f0\fs24\insrsid10445951 \hich\af0\dbch\af36\loch\f0 th\hich\af0\dbch\af36\loch\f0 e} {\f0\fs24\insrsid1011737\charrsid10708398 \hich\af0\dbch\af36\loch\f0 circumstances }{\f0\fs24\insrsid10708398 \hich\af0\dbch\af36\loch\f0 in which a}{\f0\fs24\insrsid1011737\charrsid10708398 \hich\af0\dbch\af36\loch\f0 court}{\f0\fs24\insrsid10708398 \hich\af0\dbch\af36\loch\f0 }{\f0\fs24\insrsid13121230 \hich\af0\dbch\af36\loch\f0 may }{\f0\fs24\insrsid13121230\charrsid10708398 \hich\af0\dbch\af36\loch\f0 issue}{\f0\fs24\insrsid1011737\charrsid10708398 \hich\af0\dbch\af36\loch\f0 that kind of order, especially in cases that are akin to inter country adoptions. \par {\listtext\pard\plain\s15 \lang2057\langfe1033\langnp2057\insrsid1011737 \hich\af0\dbch\af36\loch\f0 8.\tab}}{\f0\fs24\insrsid1011737 \hich\af0\dbch\af36\loch\f0 In that decision the }{\f0\fs24\insrsid4016593 \hich\af0\dbch\af36\loch\f0 C}{ \f0\fs24\insrsid1011737 \hich\af0\dbch\af36\loch\f0 ourt of }{\f0\fs24\insrsid4016593 \hich\af0\dbch\af36\loch\f0 A}{\f0\fs24\insrsid1011737 \hich\af0\dbch\af36\loch\f0 ppeal was divided as to when and how the High Court may grant orders of legal guardianship in the ci\hich\af0\dbch\af36\loch\f0 rcumstances where the applicants were foreign applicants resident outside this country and whose intention of applying for legal guardianship was to take the children outside this jurisdiction}{\f0\fs24\insrsid10163931 \hich\af0\dbch\af36\loch\f0 , with the eventual aim of adopting such children}{\f0\fs24\insrsid1011737 \hich\af0\dbch\af36\loch\f0 . \par {\listtext\pard\plain\s15 \lang2057\langfe1033\langnp2057\insrsid1011737 \hich\af0\dbch\af36\loch\f0 9.\tab}\hich\af0\dbch\af36\loch\f0 One of the ju\hich\af0\dbch\af36\loch\f0 dges was of the view that legal guardianship was to be resorted to where the applicants could not fulfil the conditions under Section 46 of the Children\hich\f0 \rquote \loch\f0 s Act. Another judge disagreed. Though in agreement that this court had jurisdiction to grant orders o\hich\af0\dbch\af36\loch\f0 f\hich\af0\dbch\af36\loch\f0 legal guardianship, the judge stated that it should not be applicable where the applicants were foreign applicants who did not qualify un}{\f0\fs24\insrsid13924280 \hich\af0\dbch\af36\loch\f0 der Section 46 of the Children}{\f0\fs24\insrsid1011737 \hich\af0\dbch\af36\loch\f0 Act. To allow such applicants to obtain orders of legal guardianship, while they did no\hich\af0\dbch\af36\loch\f0 t qualify to adopt the children under the Act, would be an infringement of the Act. The third judge did not agree that the High Court had the power to grant orders of legal guardianship, such power being only av}{\f0\fs24\insrsid10163931 \hich\af0\dbch\af36\loch\f0 ailable to Family and Children}{\f0\fs24\insrsid1011737 \hich\af0\dbch\af36\loch\f0 Court, by the \hich\af0\dbch\af36\loch\f0 issue of care orders and appointment of Foster Parents.}{\f0\fs24\insrsid5051431 \hich\af0\dbch\af36\loch\f0 Nevertheless the judge concurred in the orders proposed for legal guardianship }{\f0\fs24\insrsid7165265 \hich\af0\dbch\af36\loch\f0 by the first judge.}{\f0\fs24\insrsid1011737 \par {\listtext\pard\plain\s15 \lang2057\langfe1033\langnp2057\insrsid1011737 \hich\af0\dbch\af36\loch\f0 10.\tab}\hich\af0\dbch\af36\loch\f0 The Court of Appeal decision, given the conflicting legal positions taken by each judge, provides no \hich\af0\dbch\af36\loch\f0 authoritative guidance as to how this court should exercise its power in granting orders of legal guardianship. In the resul}{\f0\fs24\insrsid15164705 \hich\af0\dbch\af36\loch\f0 t,}{\f0\fs24\insrsid1011737 \hich\af0\dbch\af36\loch\f0 perhaps}{\f0\fs24\insrsid15164705 \hich\af0\dbch\af36\loch\f0 ,}{\f0\fs24\insrsid1011737 \hich\af0\dbch\af36\loch\f0 I must turn to simply one question. Is the grant of such an order in the best interest of the infant? \par {\listtext\pard\plain\s15 \lang2057\langfe1033\langnp2057\insrsid4016593 \hich\af0\dbch\af36\loch\f0 11.\tab}}{\f0\fs24\insrsid4016593 \hich\af0\dbch\af36\loch\f0 The circumstances \hich\af0\dbch\af36\loch\f0 of this case are rather unusual. The parents of the twins have not been identified. Neither is the woman to whom the child}{\f0\fs24\insrsid7875105 \hich\af0\dbch\af36\loch\f0 }{\f0\fs24\insrsid4016593 \hich\af0\dbch\af36\loch\f0 were abandoned.}{ \f0\fs24\insrsid7351901 \hich\af0\dbch\af36\loch\f0 Ibanda Babies Home did not file an affidavit in support of this application though it is the institution now with the\hich\af0\dbch\af36\loch\f0 legal custody of the children.
