The court found that the applicants failed to meet the threshold for revocation of grant under Section 76 of the Law of Succession Act. There was no evidence that the grant was obtained fraudulently, by concealment, or by untrue allegations. Ndegwa did not prove that the respondent was aware of his existence at the time of the petition, nor did he obtain a grant for his late mother's estate to step into her shoes. Solomon's claim failed as he was only entitled to what his father inherited, and there was no evidence of fraud or non-disclosure. Joseph's claim, being one of trust, was outside the jurisdiction of the probate court and should be determined by the Environment and Land Court. The allegations of forged consents were unsupported, as the signatures were witnessed by commissioners of oaths who were not called to testify, and no police report was made. The applicants collectively failed to meet the civil standard of proof required for revocation of the grant.
