J S J……………………………RESPONDENT JUDGMENT

The Petitioner and the Respondent J K J and J S J got married on 29th June 1980. They cohabited as man and wife residing in Nairobi, Kenya. They have three children from the marriage namely:

(1) G K J born on the 26th April, 1981

(2) M S J born on the 25th May, 1983

(3) H K J born on the 3rd November, 1985

From the evidence given by the Petitioner, I am satisfied that the Respondent has treated the Petitioner and the children with cruelty by physically assaulting them on several occasions. This has made cohabitation between the Petitioner and the respondent no longer possible. The marriage has irretrievably broken down.

The marriage between the Petitioner and the Respondent is hereby dissolved.

The Petitioner shall have the custody of the children of the marriage and there shall be maintenance of the Petitioner and the children by the Respondent.

The cost of this suit shall be born by the Petitioner.

The decree nisi shall last two weeks.
