Mr. Kibaya,}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid10239158\charrsid3024565 for the applicants, submitted that this application was brought under the second }{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid14562887\charrsid3024565 leg }{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid10239158\charrsid3024565 of the rule \endash }{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid14562887\charrsid3024565 \'93}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid10239158\charrsid3024565 for any other good cause}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid14562887\charrsid3024565 \'94}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid10239158\charrsid3024565 . He cited }{\rtlch\fcs1 \af0 \ltrch\fcs0 \ul\insrsid10239158\charrsid3024565 Caltex Oil (U) Ltd vs Kyobe [1988-1990] HCB 141}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid10239158\charrsid3024565 , where Justice Byamugisha held that Court was endowed with wide and discretionary powers to set aside a decree obtained under Order 33 rule 3 (no}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid14562887\charrsid3024565 w}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid10239158\charrsid3024565 Order 36 rule 3). That}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid14562887\charrsid3024565 ,}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid10239158\charrsid3024565 however}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid14562887\charrsid3024565 ,}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid10239158\charrsid3024565 the applicant has to sati sfy court either that there was no effective service or he has to show any other good cause. That sufficient cause had to relate to the failure by the applicant to take the necessary }{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid14562887\charrsid3024565 step at}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid10239158\charrsid3024565 the right time. There was no hard and fast rule as to what constituted any other good cause. Each case had to be considered}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid8849237\charrsid3024565 on its own peculiar }{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid14562887\charrsid3024565 circumstances}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid8849237\charrsid3024565 . \par \par }\pard \ltrpar\qj \li0\ri0\sl480\slmult1\widctlpar\wrapdefault\aspalpha\aspnum\faauto\adjustright\rin0\lin0\itap0\pararsid8849237 {\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid8849237\charrsid3024565 The Application is also brought under Section 33 of the Judicature Act. The High Court is thereby empowered to grant all such remedies in respect of any cla im brought before it so that as far as possible all matters in controversy between the parties may be completely and finally determined and all multiplication of legal proceedings concerning any of those matters avoided. The application was further broug ht under section 98 of the }{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid14177937\charrsid3024565 C}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid8849237\charrsid3024565 ivil Procedure Act which provides Court with inherent power to make such orders as may be necessary for the ends of justice or to prevent abuse of the process of the court.}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid1908724\charrsid3024565 \par }{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid8849237\charrsid3024565 \par The Applica}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid4008158\charrsid3024565 tion}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid8849237\charrsid3024565 is supported by an }{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid4008158\charrsid3024565 affidavit}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid8849237\charrsid3024565 deponed to by the 1}{\rtlch\fcs1 \af0 \ltrch\fcs0 \super\insrsid8849237\charrsid3024565 st}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid8849237\charrsid3024565 Applicant, Jayantlal Amratlal Bhimji, wherein he states;

That in July 2007, I instructed lawyers at}{ \rtlch\fcs1 \af0 \ltrch\fcs0 \i\insrsid3237020\charrsid3024565 MWM Advocates & Solicitors (Mw}{\rtlch\fcs1 \af0 \ltrch\fcs0 \i\insrsid8849237\charrsid3024565 a}{\rtlch\fcs1 \af0 \ltrch\fcs0 \i\insrsid4008158\charrsid3024565 n}{\rtlch\fcs1 \af0 \ltrch\fcs0 \i\insrsid8849237\charrsid3024565 dha, Wabwire & Muwanga) to file an application for leave to appear and defend Civil Suit No. 307 of 2007}{\rtlch\fcs1 \af0 \ltrch\fcs0 \i\insrsid1211208\charrsid3024565 :}{\rtlch\fcs1 \af0 \ltrch\fcs0 \i\insrsid8849237\charrsid3024565 \par }{\rtlch\fcs1 \af0 \ltrch\fcs0 \i\insrsid1211208\charrsid3024565 3. That the above mentioned firm of lawyers assured me that an application would be filed but that since I was outside of the Country at the time, an affidavit in support of the application would be sworn by Steven Mwandha one of the part}{\rtlch\fcs1 \af0 \ltrch\fcs0 \i\insrsid16149867\charrsid3024565 ner}{\rtlch\fcs1 \af0 \ltrch\fcs0 \i\insrsid1211208\charrsid3024565 s in the above mentioned firm of advocates }{\rtlch\fcs1 \af0 \ltrch\fcs0 \i\insrsid16149867\charrsid3024565 (based on information provided by myself and the said applicant), and that }{\rtlch\fcs1 \af0 \ltrch\fcs0 \i\insrsid2640449\charrsid3024565 I would later swear a supplementary affidavit which would be filed in further support of the application.}{ \rtlch\fcs1 \af0 \ltrch\fcs0 \i\insrsid1211208\charrsid3024565 \par }{\rtlch\fcs1 \af0 \ltrch\fcs0 \i\insrsid2640449\charrsid3024565 4. }{\rtlch\fcs1 \af0 \ltrch\fcs0 \i\insrsid16078105\charrsid3024565 That}{\rtlch\fcs1 \af0 \ltrch\fcs0 \i\insrsid2640449\charrsid3024565 going by the e}{\rtlch\fcs1 \af0 \ltrch\fcs0 \i\insrsid4008158\charrsid3024565 rrone}{\rtlch\fcs1 \af0 \ltrch\fcs0 \i\insrsid2640449\charrsid3024565 ous advice given by the said lawyers, I agreed to proceed as stated in paragraph 3 above. \par 5. }{\rtlch\fcs1 \af0 \ltrch\fcs0 \i\insrsid16078105\charrsid3024565 T}{\rtlch\fcs1 \af0 \ltrch\fcs0 \i\insrsid2640449\charrsid3024565 hat on the 18}{\rtlch\fcs1 \af0 \ltrch\fcs0 \i\super\insrsid2640449\charrsid3024565 th}{\rtlch\fcs1 \af0 \ltrch\fcs0 \i\insrsid2640449\charrsid3024565 day of April, 2008, I was informed by the lawyers at MWM Advocates & Solicitors that the application for leave to appear and defendant Civil Suit 307 of 2007 was dismis sed because the said application was supported by an affidavit sworn by Steven Mwandha Esq, an advocate who is barred by the Advocates Professional }{\rtlch\fcs1 \af0 \ltrch\fcs0 \i\insrsid4008158\charrsid3024565 C}{\rtlch\fcs1 \af0 \ltrch\fcs0 \i\insrsid2640449\charrsid3024565 onduct }{\rtlch\fcs1 \af0 \ltrch\fcs0 \i\insrsid16078105\charrsid3024565 Regulations}{\rtlch\fcs1 \af0 \ltrch\fcs0 \i\insrsid2640449\charrsid3024565 from deponing affidavits on contentious matters which he as an advocate cannot }{\rtlch\fcs1 \af0 \ltrch\fcs0 \i\insrsid16078105\charrsid3024565 prove.}{\rtlch\fcs1 \af0 \ltrch\fcs0 \i\insrsid2640449\charrsid3024565 \par }{\rtlch\fcs1 \af0 \ltrch\fcs0 \i\insrsid16078105\charrsid3024565 6. }{\rtlch\fcs1 \af0 \ltrch\fcs0 \i\insrsid1720778\charrsid3024565 That prior to filing the application, the lawyers at MWM Advocates and Solicitor did not inform me that advocates cannot depone affidavits in matters on behalf of clients relating to matters which they cannot prove.}{\rtlch\fcs1 \af0 \ltrch\fcs0 \i\insrsid16078105\charrsid3024565 \par }{\rtlch\fcs1 \af0 \ltrch\fcs0 \i\insrsid1720778\charrsid3024565 7. That I am advised by my present lawyer Mr. Bogere that I have suffered great misfortune by having Miscellaneous Application 407 of 2007 f}{\rtlch\fcs1 \af0 \ltrch\fcs0 \i\insrsid6894320\charrsid3024565 or}{\rtlch\fcs1 \af0 \ltrch\fcs0 \i\insrsid1720778\charrsid3024565 leave to appear and defend High Court Civil Suit 307}{\rtlch\fcs1 \af0 \ltrch\fcs0 \i\insrsid6894320\charrsid3024565 o}{\rtlch\fcs1 \af0 \ltrch\fcs0 \i\insrsid1720778\charrsid3024565 f 2007 dismissed because I was misinformed and misadvised by my then lawyers at MWM Advocates and Solicitors}{\rtlch\fcs1 \af0 \ltrch\fcs0 \i\insrsid14767652\charrsid3024565 .}{\rtlch\fcs1 \af0 \ltrch\fcs0 \i\insrsid1720778\charrsid3024565 \par }{\rtlch\fcs1 \af0 \ltrch\fcs0 \i\insrsid489188\charrsid3024565 8. My present}{\rtlch\fcs1 \af0 \ltrch\fcs0 \i\insrsid14767652\charrsid3024565 lawyer Mr. Bogere ha}{\rtlch\fcs1 \af0 \ltrch\fcs0 \i\insrsid489188\charrsid3024565 s}{\rtlch\fcs1 \af0 \ltrch\fcs0 \i\insrsid14767652\charrsid3024565 advised me that the said mistake a}{\rtlch\fcs1 \af0 \ltrch\fcs0 \i\insrsid6894320\charrsid3024565 nd}{\rtlch\fcs1 \af0 \ltrch\fcs0 \i\insrsid14767652\charrsid3024565 o}{\rtlch\fcs1 \af0 \ltrch\fcs0 \i\insrsid6894320\charrsid3024565 r}{\rtlch\fcs1 \af0 \ltrch\fcs0 \i\insrsid14767652\charrsid3024565 misadvise by MWM Advocates and Solicitors is an error}{\rtlch\fcs1 \af0 \ltrch\fcs0 \i\insrsid489188\charrsid3024565 by counsel which should not be visited on the applicants, as the applicants are in court to seek justice, and have a good case which should be heard and decided on the merits.}{\rtlch\fcs1 \af0 \ltrch\fcs0 \i\insrsid14767652\charrsid3024565 \par }{\rtlch\fcs1 \af0 \ltrch\fcs0 \i\insrsid489188\charrsid3024565 9. That my lawyer Mr. Bogere ha}{\rtlch\fcs1 \af0 \ltrch\fcs0 \i\insrsid6894320\charrsid3024565 s}{\rtlch\fcs1 \af0 \ltrch\fcs0 \i\insrsid489188\charrsid3024565 advised me that }{ \rtlch\fcs1 \af0 \ltrch\fcs0 \i\insrsid6894320\charrsid3024565 t}{\rtlch\fcs1 \af0 \ltrch\fcs0 \i\insrsid489188\charrsid3024565 his is a proper case where mistake of counsel should not }{\rtlch\fcs1 \af0 \ltrch\fcs0 \i\insrsid10489187\charrsid3024565 be visited}{\rtlch\fcs1 \af0 \ltrch\fcs0 \i\insrsid489188\charrsid3024565 on a litigant\'94. \par \par }\pard \ltrpar\qj \li0\ri0\sl480\slmult1\widctlpar\wrapdefault\aspalpha\aspnum\faauto\adjustright\rin0\lin0\itap0\pararsid16603387 {\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid489188\charrsid3024565 Mr. Kibaya argued that the Applicants were lay people, who were at the material time out of the }{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid4619664\charrsid3024565 Country and who instructed lawyers to defend the matter. He submitted that the Applicants exhibited the intention to defend the matter but for the lawyers mistake and or misadvise, their application was }{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid3237020\charrsid3024565 dismissed}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid4619664\charrsid3024565 . He argued that such mistake of counsel should not be visited on the Applicant. He relied on the authorities below;}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid489188\charrsid3024565 \par }{\rtlch\fcs1 \af0 \ltrch\fcs0 \ul\insrsid4619664\charrsid3024565 Godfrey Ma}{\rtlch\fcs1 \af0 \ltrch\fcs0 \ul\insrsid11748010\charrsid3024565 gezi & A}{\rtlch\fcs1 \af0 \ltrch\fcs0 \ul\insrsid4619664\charrsid3024565 nor vs Sudhir R uparelia SCC Appeal No. 10 of 2002 \par }{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid4619664\charrsid3024565 Where Karokora JSC stated: \par }\pard \ltrpar\qj \li1440\ri0\sl480\slmult1\widctlpar\wrapdefault\aspalpha\aspnum\faauto\adjustright\rin0\lin1440\itap0\pararsid489188 {\rtlch\fcs1 \af0 \ltrch\fcs0 \i\insrsid11748010\charrsid3024565 \'93It}{\rtlch\fcs1 \af0 \ltrch\fcs0 \i\insrsid4619664\charrsid3024565 is }{\rtlch\fcs1 \af0 \ltrch\fcs0 \i\insrsid10778083\charrsid3024565 now }{\rtlch\fcs1 \af0 \ltrch\fcs0 \i\insrsid4619664\charrsid3024565 settled that omission or mistake or inadvertence of counsel ought not to be visited on the litigant, leading to }{\rtlch\fcs1 \af0 \ltrch\fcs0 \i\insrsid11748010\charrsid3024565 striking }{\rtlch\fcs1 \af0 \ltrch\fcs0 \i\insrsid4619664\charrsid3024565 out of his appeal thereby denying him justice. Kyobe Seruyange vs }{\rtlch\fcs1 \af0 \ltrch\fcs0 \ul\insrsid13982854\charrsid3024565 N}{\rtlch\fcs1 \af0 \ltrch\fcs0 \ul\insrsid13912953\charrsid3024565 aks Ltd[1980] HCB 30}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid13912953\charrsid3024565 where}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid13982854\charrsid3024565 }{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid13912953\charrsid3024565 Odoki , A}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid9904310\charrsid3024565 g}{ \rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid13912953\charrsid3024565 . }{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid9904310\charrsid3024565 J.}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid13912953\charrsid3024565 (as he then was) held that a mistake or oversight on the part of an advocate though negligent is a sufficient cause for setting aside an expar}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid13444796\charrsid3024565 t}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid13912953\charrsid3024565 e decree. \par \par Mr. Rexida, counsel for the Respondent, }{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid3237020\charrsid3024565 argued that}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid13444796\charrsid3024565 chronological events of the conduct of th e Applicants and their counsel show that the Applicant were guilty of }{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid5572515\charrsid3024565 dilatory}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid13444796\charrsid3024565 conduct.}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid13912953\charrsid3024565 \par }{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid5450435\charrsid3024565 \par }\pard \ltrpar\qj \li0\ri0\sl480\slmult1\widctlpar\wrapdefault\aspalpha\aspnum\faauto\adjustright\rin0\lin0\itap0\pararsid5450435 {\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid9393567\charrsid3024565 C}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid13444796\charrsid3024565 ivil Suit 307 of 2007 was }{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid9393567\charrsid3024565 fil}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid13444796\charrsid3024565 ed on 7}{\rtlch\fcs1 \af0 \ltrch\fcs0 \super\insrsid13444796\charrsid3024565 th}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid13444796\charrsid3024565 May 2007. It is not disputed}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid5450435\charrsid3024565 }{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid8347126\charrsid3024565 th}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid5450435\charrsid3024565 at the Applicants were not the}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid8935778\charrsid3024565 n}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid5450435\charrsid3024565 in Uganda. Infact service of summons w}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid8935778\charrsid3024565 as}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid5450435\charrsid3024565 by way of substituted service. \par On 6}{\rtlch\fcs1 \af0 \ltrch\fcs0 \super\insrsid5450435\charrsid3024565 th}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid5450435\charrsid3024565 July, 2007, through M/S MWM Advocates & Solicitors, the applicants file}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid8347126\charrsid3024565 d}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid5450435\charrsid3024565 Miscellaneous Application No. 467 of 2007. The Application was supported by an affidavit deponed to by Mr. Steven Mwandha, one of the advocates in M/s MWM Advocates and solicitors. Later a supplementary affidavit deponed to}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid8935778\charrsid3024565 by}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid5450435\charrsid3024565 Jayanttlila Amraltal Bhimji was filed in further support of the application. \par This court found that Mr. Mwondha\rquote s affidavit in support to the application contraven}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid8935778\charrsid3024565 ed the provisions of regulation}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid5450435\charrsid3024565 9 of the Advocates (Professional Conduct) Regulations 1979 and thus incurably defective. Further that}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid13444796\charrsid3024565 in the circumstances Jayantlilal Amiraltal Bhimji\rquote s supplementary affidavit had nothing to supplementary thereby rendering the Application unsupported by any affidavit. It was accordingly dismissed and judgment and decree entered. Thus this application. \par }\pard \ltrpar\qj \li0\ri0\sl480\slmult1\widctlpar\wrapdefault\aspalpha\aspnum\faauto\adjustright\rin0\lin0\itap0\pararsid10778083 {\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid13444796\charrsid3024565 \par I have carefully studied the circumstance of this application and I find that the Applicant had acted diligently and instructed M/S MWM Advocates and Solicitors to}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid8595219\charrsid3024565 apply for them to defend this suit. The said advocates had a legal duty to professionally represent the Applicants which they failed to. This they failed to do resulting into the dismissal of the Applica}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid9393567\charrsid3024565 nts Misc. Appl. No. 467 of 2007 }{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid8076274\charrsid3024565 for leave to defend Civil Suit No. 307 of 2007 and consequently to judgment in favour of the Respondent. I have carefully p}{ \rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid9393567\charrsid3024565 eru}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid8076274\charrsid3024565 sed paragraphs 4 to 22 of the Respondents affidavit}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid9393567\charrsid3024565 in reply deponed to by }{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid14619153\charrsid3024565 Mohamed Ali. I have found the event outlined therein subse quent to the filing of Misc. app No. 467 of 2007 thus of no effect to the said lawyers conduct in the filing thereof. In the premises I find that the Applicants\rquote said lawyers}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid9393567\charrsid3024565 \rquote }{ \rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid14619153\charrsid3024565 shortcomings should not be visited on the Applicants. It is the said Advocates, as professionals}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid9393567\charrsid3024565 ,}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid14619153\charrsid3024565 who are responsible for the dismissal of the Applicants\rquote application. Otherwise the Applicants were interested to defend the respondents claim against them.}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid10778083\charrsid3024565 \par }{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid14619153\charrsid3024565 \par The }{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid9393567\charrsid3024565 Applicants further}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid14619153\charrsid3024565 contend that the Respondent is a money lender who lent money to the Applicants at an interest rate over 52% per annum beyond what is permitted by the Money Lender\rquote s Act. It is the }{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid9393567\charrsid3024565 Respondents}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid14619153\charrsid3024565 \rquote case that it}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid9393567\charrsid3024565 is}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid14619153\charrsid3024565 a licensed money lender. It claims that it provided loan facilities to the Applicant in 2006 which stood at an aggregate of US$ 380,000 repay}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid9393567\charrsid3024565 able}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid14619153\charrsid3024565 with}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid9393567\charrsid3024565 in}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid14619153\charrsid3024565 10 installments coupled with an agreed interest of 1% per week}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid4879966\charrsid3024565 within 5 months, with further interest of 1% per week}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid14619153\charrsid3024565 on the outstanding balance until the liquidation of the loan. \par }{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid11418513\charrsid3024565 \par Section 12 of the Money Lenders Act provides: \par }\pard \ltrpar\qj \li720\ri0\sl480\slmult1\widctlpar\wrapdefault\aspalpha\aspnum\faauto\adjustright\rin0\lin720\itap0\pararsid5255090 {\rtlch\fcs1 \af0 \ltrch\fcs0 \i\insrsid5255090\charrsid3024565 \'93W}{\rtlch\fcs1 \af0 \ltrch\fcs0 \i\insrsid2637961\charrsid3024565 here in any proceedings in respect of any money lent by a money lender, after the commencement of this Act, or in respect of any agreement or security made or taken after the commencement of this Act in respect of money that eithe}{\rtlch\fcs1 \af0 \ltrch\fcs0 \i\insrsid5255090\charrsid3024565 r before or after t}{\rtlch\fcs1 \af0 \ltrch\fcs0 \i\insrsid2637961\charrsid3024565 he commencement of this Act, it is found that the interest charged exceeds the rate to 24 percent per yea}{\rtlch\fcs1 \af0 \ltrch\fcs0 \i\insrsid27850\charrsid3024565 r}{\rtlch\fcs1 \af0 \ltrch\fcs0 \i\insrsid2637961\charrsid3024565 , on the corresponding rate in respect of any other period, the Court shall presume for the purposes of section}{\rtlch\fcs1 \af0 \ltrch\fcs0 \i\insrsid4726281\charrsid3024565 11 that the inter est charged is excessive and that that the transaction is harsh and unconscionable, but this provision shall be without prejudice to the powers of the court under that section where the Court is satisfied that the interest charged, although not exceeding 24 percent per year is excessive\'94}{\rtlch\fcs1 \af0 \ltrch\fcs0 \i\insrsid2637961\charrsid3024565 \par }\pard \ltrpar\qj \li0\ri0\sl480\slmult1\widctlpar\wrapdefault\aspalpha\aspnum\faauto\adjustright\rin0\lin0\itap0\pararsid4726281 {\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid4726281\charrsid3024565 The }{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid6782553\charrsid3024565 above is to the effect that a}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid4726281\charrsid3024565 money lender}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid6782553\charrsid3024565 should not charge interest exceeding 24% per annum.}{ \rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid4726281\charrsid3024565 \par }{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid6782553\charrsid3024565 \par Mr. Kibaya argued that there are 52 weeks}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid27850\charrsid3024565 in}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid6782553\charrsid3024565 a year and submitted }{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid27850\charrsid3024565 that }{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid6782553\charrsid3024565 interest at the rate of 1% per week if translated in to a year would be 52% per annum which exceeds 24% per annum. That with further penalty interest of 1% on the outstanding balance would translate to 104% per annum. He accordingly submitted that the interest charged by the Respondent was illegal and sho uld not be sanctioned by court. \par }{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid14033398\charrsid3024565 In }{\rtlch\fcs1 \af0 \ltrch\fcs0 \ul\insrsid14033398\charrsid3024565 Makula International Ltd vs His Eminence Cardinal Nsubuga and Anor [1982]}{\rtlch\fcs1 \af0 \ltrch\fcs0 \ul\insrsid6891171\charrsid3024565 HCB 11 }{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid6891171\charrsid3024565 the Court of Appeal held that a Court of law cannot sanction what is illegal }{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid6779949\charrsid3024565 a}{ \rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid6891171\charrsid3024565 nd illegality once brought to the attention of the Court, over rides all questions of pleadings, including any admissions made thereon. Where the issue }{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid9376077\charrsid3024565 of legality of the interest is brought to the attention of C}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid8928784\charrsid3024565 o}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid9376077\charrsid3024565 urt should a judgment on such interest be sustained without being investigated}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid11026384\charrsid3024565 !!}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid9376077\charrsid3024565 To}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid3237020\charrsid3024565 }{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid9376077\charrsid3024565 do so court w}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid11026384\charrsid3024565 ou}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid9376077\charrsid3024565 l}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid11026384\charrsid3024565 d}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid9376077\charrsid3024565 be }{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid3237020\charrsid3024565 promoting}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid9376077\charrsid3024565 such illegality. However, Mr. Rexida for the }{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid3237020\charrsid3024565 Respondent}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid9376077\charrsid3024565 argued that the clear intention }{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid7614386\charrsid3024565 o}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid9376077\charrsid3024565 f the Money Lender}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid7614386\charrsid3024565 s}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid9376077\charrsid3024565 Act is to guard against un}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid3024565\charrsid3024565 }{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid9376077\charrsid3024565 cautionable interest. He gave an example of 13}{\rtlch\fcs1 \af0 \ltrch\fcs0 \super\insrsid9376077\charrsid3024565 th}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid9376077\charrsid3024565 }{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid7614386\charrsid3024565 May,}{ \rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid9376077\charrsid3024565 2006 where the Applicants borrow a sum of US$50,000 for three weeks at the agreed interest of 1% per }{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid2188414\charrsid3024565 which would attract interest of only U$1515. }{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid7614386\charrsid3024565 He}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid2188414\charrsid3024565 submitted that such interest wou ld not be uncautionable but fair and reasonable. In the event Court finds in the main suit that the interest charge}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid5785298\charrsid3024565 d}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid8284466\charrsid3024565 was excessive that does not discharge the Applicants from liability on the principle sum.
