1. The application dated 17/6/2025 is not certified urgent. The applicants’ Counsel has appeared virtually and is guided that the Originating Motion application cannot stand as the affidavit in support is fatally defective. It is sworn at Nairobi yet the applicant claims that he is in South Korea and was deported and banned from coming to Kenya.
2. As Counsel Mr. Ojienda for the applicant is guided and he agrees that the said affidavit is fatally defective, and on his oral application, therefore, the Originating Motion and all the documents filed in support are hereby marked as wholly withdrawn with no orders as to costs and this file is closed.
