The applicant has applied for leave to file his appeal out of time. He has explained that though the relatives were supposed to file the same for him, they never did so.

The state, through Mr. Gumo, Assistant Deputy Public Prosecutor has not opposed the application. In view of the above, the applicant is hereby granted 21 days leave to file the appeal out of time. Appeal will be heard on 13th October, 2005. MUGA APONDIJUDGE
