The court found that the Provincial Land Disputes Tribunal Appeals Board exceeded its jurisdiction under section 3(1) of the Land Disputes Tribunal Act, 1990 by ordering the inclusion of the sons of the first wife in the sharing of registered land parcel No. 271. The Act does not empower the Tribunal or Appeals Committee to determine issues of title, ownership, or trust in registered land, nor to order its sharing. The original District Land Disputes Tribunal's award, which merely allowed the sons to use the land, did not contravene the statutory limits. The Appeals Board's decision to order sharing was ultra vires and thus invalid. The appeal was therefore meritorious, and the judgment of the Appeals Board was set aside and substituted with the District Tribunal's award, with each party to bear their own costs.
