She testified that she stayed in the matrimonial home with her late husband for 47 years. After the deceased\hich\f0 \rquote \loch\f0 s death children started stoning her an}{\f0\fs24\insrsid1781433\charrsid1315841 \hich\af0\dbch\af39\loch\f0 d attempted to burn her.}{\f0\fs24\insrsid10623162\charrsid1315841 \hich\af0\dbch\af39\loch\f0 A door to the house was burnt.}{\f0\fs24\insrsid1781433\charrsid1315841 \hich\af0\dbch\af39\loch\f0 Afterwards the defendant came to the house an \hich\af0\dbch\af39\loch\f0 d broke a pipe}{\f0\fs24\insrsid6778931\charrsid1315841 \hich\af0\dbch\af39\loch\f0 from the }{\f0\fs24\insrsid10357983\charrsid1315841 \hich\af0\dbch\af39\loch\f0 house. He ordered the plaintiff to move out of the house claiming it as belonging to him. The plaintiff saw that the defendant was tough and decided to move away from the hous}{\f0\fs24\insrsid4659046\charrsid1315841 \hich\af0\dbch\af39\loch\f0 e. She now stays with one of her children.}{\f0\fs24\insrsid10235744\charrsid1315841 \par {\listtext\pard\plain\s15 \lang2057\langfe1033\langfenp1033\insrsid10623162\charrsid1315841 \hich\af0\dbch\af39\loch\f0 4.\tab}}{\f0\fs24\insrsid10623162\charrsid1315841 \hich\af0\dbch\af39\loch\f0 In cross exami\hich\af0\dbch\af39\loch\f0 nation she revealed that }{\f0\fs24\insrsid11081694\charrsid1315841 \hich\af0\dbch\af39\loch\f0 several }{\f0\fs24\insrsid10623162\charrsid1315841 \hich\af0\dbch\af39\loch\f0 gran}{\f0\fs24\insrsid11081694\charrsid1315841 \hich\af0\dbch\af39\loch\f0 d children of the deceased, sons of the PW2, Ssalongo Lulika, the heir to her late husband were the ones occupying the premises in question. Their names are }{\f0\fs24\insrsid1590203\charrsid1315841 \hich\af0\dbch\af39\loch\f0 Kato Twaha, }{ \f0\fs24\insrsid5388476\charrsid1315841 \hich\af0\dbch\af39\loch\f0 Ser\hich\af0\dbch\af39\loch\f0 u\hich\af0\dbch\af39\loch\f0 ntenga}{\f0\fs24\insrsid1590203\charrsid1315841 \hich\af0\dbch\af39\loch\f0 Kassim and Isma }{ \f0\fs24\insrsid5388476\charrsid1315841 \hich\af0\dbch\af39\loch\f0 Muk\hich\af0\dbch\af39\loch\f0 i\hich\af0\dbch\af39\loch\f0 ibi}{\f0\fs24\insrsid1590203\charrsid1315841 \hich\af0\dbch\af39\loch\f0 . One of her ste\hich\af0\dbch\af39\loch\f0 p children, Nkubi was also occupying part of the house.}{\f0\fs24\insrsid16469722\charrsid1315841 \hich\af0\dbch\af39\loch\f0 These people started staying in the house after the death of her husband.}{\f0\fs24\insrsid4659046\charrsid1315841 \par {\listtext\pard\plain\s15 \lang2057\langfe1033\langfenp1033\insrsid10703347\charrsid1315841 \hich\af0\dbch\af39\loch\f0 5.\tab}}{\f0\fs24\insrsid10703347\charrsid1315841 \hich\af0\dbch\af39\loch\f0 PW2 was Ssalongo Lulika, the heir to the plaintiff \hich\f0 \rquote \loch\f0 s husband. }{\f0\fs24\insrsid12347933\charrsid1315841 \hich\af0\dbch\af39\loch\f0 He testified that the plaintiff was the widow of their late fath\hich\af0\dbch\af39\loch\f0 er after living with him for 47 years until his death}{ \f0\fs24\insrsid11403559\charrsid1315841 \hich\af0\dbch\af39\loch\f0 . Waswa Umah and Kato Twaha were his children. }{\f0\fs24\insrsid12347933\charrsid1315841 \hich\af0\dbch\af39\loch\f0 .}{\f0\fs24\insrsid16349395\charrsid1315841 \hich\af0\dbch\af39\loch\f0 He}{\f0\fs24\insrsid6035000\charrsid1315841 \hich\af0\dbch\af39\loch\f0 stated that his children at the instigation of the }{\f0\fs24\insrsid5388476\charrsid1315841 \hich\af0\dbch\af39\loch\f0 defendant}{ \f0\fs24\insrsid6035000\charrsid1315841 \hich\af0\dbch\af39\loch\f0 were torturing the plaintiff. He claimed that he knew these children were acting on the ins\hich\af0\dbch\af39\loch\f0 tigation of the defendant because when they arrested them and took them to court, it was the defendant that stood surety for them to be released. }{\f0\fs24\insrsid12145152\charrsid1315841 \par {\listtext\pard\plain\s15 \lang2057\langfe1033\langfenp1033\insrsid16349395\charrsid1315841 \hich\af0\dbch\af39\loch\f0 6.\tab}}\pard \s15\ql \fi-360\li720\ri0\sl480\slmult1 \widctlpar\aspalpha\aspnum\faauto\ls1\adjustright\rin0\lin720\itap0\pararsid12145152 {\f0\fs24\insrsid16349395\charrsid1315841 \hich\af0\dbch\af39\loch\f0 In cross examination he admitted that Sadik Kaya and Zaidi Mulimira were his children who also stayed at the \hich\af0\dbch\af39\loch\f0 house in Nakulabye.}{\f0\fs24\insrsid1729189\charrsid1315841 \hich\af0\dbch\af39\loch\f0 But that these two were not staying in the main house. They were staying in boys}{\f0\fs24\insrsid12145152\charrsid1315841 \loch\af0\dbch\af39\hich\f0 \rquote }{\f0\fs24\insrsid9383208\charrsid1315841 \hich\af0\dbch\af39\loch\f0 quarter}{ \f0\fs24\insrsid1729189\charrsid1315841 \hich\af0\dbch\af39\loch\f0 and had been doing so before the death of his father.}{\f0\fs24\insrsid12145152\charrsid1315841 \hich\af0\dbch\af39\loch\f0 \hich\af0\dbch\af39\loch\f0 None of the defendant\hich\f0 \rquote \loch\f0 s children are living on the premises in question.}{\f0\fs24\insrsid16349395\charrsid1315841 \par {\listtext\pard\plain\s15 \lang2057\langfe1033\langfenp1033\insrsid8280834\charrsid1315841 \hich\af0\dbch\af39\loch\f0 7.\tab}}\pard \s15\ql \fi-360\li720\ri0\sl480\slmult1 \widctlpar\aspalpha\aspnum\faauto\ls1\adjustright\rin0\lin720\itap0\pararsid7879742 {\f0\fs24\insrsid8280834\charrsid1315841 \hich\af0\dbch\af39\loch\f0 PW3 was David Livin\hich\af0\dbch\af39\loch\f0 gstone Seruwo the Chairman of the Local Council One of Nakulabye, Katende Zone. He stated that he knew the plaintiff as the widow to the late Juma Katende. They were living in his zone before the deceased\hich\f0 \rquote \loch\f0 s death. After the death of her husband, grand chi\hich\af0\dbch\af39\loch\f0 l\hich\af0\dbch\af39\loch\f0 dren of the deceased came and chased away the plaintiff\hich\f0 \rquote \loch\f0 s children from the house, and later chased away the plaintiff herself. }{\f0\fs24\insrsid5982135\charrsid1315841 \hich\af0\dbch\af39\loch\f0 They claimed that their father who was the heir was the one entitled to the house.}{ \f0\fs24\insrsid15668184\charrsid1315841 \hich\af0\dbch\af39\loch\f0 Wasswa Umaru was one of those children.}{\f0\fs24\insrsid13590069\charrsid1315841 \hich\af0\dbch\af39\loch\f0 In cr\hich\af0\dbch\af39\loch\f0 oss examination he admitted that in a report he made to the police he never indicated that the defendant was involved in evicting the plaintiff.}{\f0\fs24\insrsid6322822\charrsid1315841 \par {\listtext\pard\plain\s15 \lang2057\langfe1033\langfenp1033\insrsid13590069\charrsid1315841 \hich\af0\dbch\af39\loch\f0 8.\tab}}{\f0\fs24\insrsid13590069\charrsid1315841 \hich\af0\dbch\af39\loch\f0 PW4 was }{\f0\fs24\insrsid4457228\charrsid1315841 \hich\af0\dbch\af39\loch\f0 Mukiibi Sadak Kaya.}{\f0\fs24\insrsid15742925\charrsid1315841 \hich\af0\dbch\af39\loch\f0 He stated that he is a son of the PW2. He lives in the }{\f0\fs24\insrsid5388476\charrsid1315841 \hich\af0\dbch\af39\loch\f0 servants \hich\f0 \rquote }{\f0\fs24\insrsid15742925\charrsid1315841 \hich\af0\dbch\af39\loch\f0 quarters next to t\hich\af0\dbch\af39\loch\f0 he disputed house. }{\f0\fs24\insrsid15739360\charrsid1315841 \hich\af0\dbch\af39\loch\f0 He knows the plaintiff. She is the widow of the late Juma Katende, his }{\f0\fs24\insrsid5388476\charrsid1315841 \hich\af0\dbch\af39\loch\f0 grandfather}{\f0\fs24\insrsid15739360\charrsid1315841 \hich\af0\dbch\af39\loch\f0 . The widow was chased out of the house by children whose father is PW2. Those children were under the influence of the defendant who promised to bail them\hich\af0\dbch\af39\loch\f0 out should they be arrested. He did bail them out when they were arrested. }{\f0\fs24\insrsid9856172\charrsid1315841 \hich\af0\dbch\af39\loch\f0 He knew this as he was also approached by the defendant but for him he was spy. }{ \f0\fs24\insrsid9504748\charrsid1315841 \hich\af0\dbch\af39\loch\f0 The defendant claims that this house was bequeathed to him.}{\f0\fs24\insrsid1190759\charrsid1315841 \hich\af0\dbch\af39\loch\f0 The children, that is Kassim Seruntenga}{ \f0\fs24\insrsid1127978\charrsid1315841 \hich\af0\dbch\af39\loch\f0 ,\hich\af0\dbch\af39\loch\f0 Isma Juma Mukiibi, Swaibu Nkubi, and Twaha Kato,}{\f0\fs24\insrsid1190759\charrsid1315841 \hich\af0\dbch\af39\loch\f0 threw stones on the roof of the house and at its doors. They attempted to burn the house. They abused the plaintiff in public.}{\f0\fs24\insrsid1127978\charrsid1315841 \hich\af0\dbch\af39\loch\f0 Nkubi was an Uncle to PW4.}{ \f0\fs24\insrsid6759232\charrsid1315841 \hich\af0\dbch\af39\loch\f0 That was the close of the case for the plaintiff.}{\f0\fs24\insrsid13590069\charrsid1315841 \par {\listtext\pard\plain\s15 \lang2057\langfe1033\langfenp1033\insrsid16130944\charrsid1315841 \hich\af0\dbch\af39\loch\f0 9.\tab}}{\f0\fs24\insrsid16130944\charrsid1315841 \hich\af0\dbch\af39\loch\f0 DW\hich\af0\dbch\af39\loch\f0 1 was the defendant. He stated that he is a resident of Busega and that the plaintiff is actually his neighbour in Busega. He denied that he ever evicted her from the house at Nakulabye. Instead he stated that }{\f0\fs24\insrsid7353228\charrsid1315841 \hich\af0\dbch\af39\loch\f0 he was out of Kampala from 27}{\f0\fs24\super\insrsid7353228\charrsid1315841 \hich\af0\dbch\af39\loch\f0 th}{\f0\fs24\insrsid7353228\charrsid1315841 \hich\af0\dbch\af39\loch\f0 November 2006 \hich\af0\dbch\af39\loch\f0 to 30}{ \f0\fs24\super\insrsid7353228\charrsid1315841 \hich\af0\dbch\af39\loch\f0 th}{\f0\fs24\insrsid7353228\charrsid1315841 \hich\af0\dbch\af39\loch\f0 November 2006 as they had gone to a village in Mityana to survey land.}{ \f0\fs24\insrsid1991336\charrsid1315841 \hich\af0\dbch\af39\loch\f0 He stated that he did not have any control over the children mentioned in this case as these children belong to PW2. }{\f0\fs24\insrsid6759232\charrsid1315841 \par {\listtext\pard\plain\s15 \lang2057\langfe1033\langfenp1033\insrsid1991336\charrsid1315841 \hich\af0\dbch\af39\loch\f0 10.\tab}}{\f0\fs24\insrsid1991336\charrsid1315841 \hich\af0\dbch\af39\loch\f0 DW1 did not }{\f0\fs24\insrsid6968028\charrsid1315841 \hich\af0\dbch\af39\loch\f0 have any problem with the plaintiff. When she h\hich\af0\dbch\af39\loch\f0 as no food in Busega she comes to him for food which he provides. }{\f0\fs24\insrsid7281348\charrsid1315841 \hich\af0\dbch\af39\loch\f0 He stated that the cause of the problem is PW2 who is covetous of the home in Nakulabye though it was not given to him.}{\f0\fs24\insrsid9447422\charrsid1315841 \hich\af0\dbch\af39\loch\f0 It is PW2 who put his sons in the house in question.}{ \f0\fs24\insrsid1991336\charrsid1315841 \par {\listtext\pard\plain\s15 \lang2057\langfe1033\langfenp1033\insrsid16085726\charrsid1315841 \hich\af0\dbch\af39\loch\f0 11.\tab}}{\f0\fs24\insrsid16085726\charrsid1315841 \hich\af0\dbch\af39\loch\f0 DW2 was Sande }{\f0\fs24\insrsid5388476\charrsid1315841 \hich\af0\dbch\af39\loch\f0 Yus\hich\af0\dbch\af39\loch\f0 uf}{\f0\fs24\insrsid16085726\charrsid1315841 \hich\af0\dbch\af39\loch\f0 Mukasa Lubwama. He is a }{\f0\fs24\insrsid5388476\charrsid1315841 \hich\af0\dbch\af39\loch\f0 grandchild}{ \f0\fs24\insrsid16085726\charrsid1315841 \hich\af0\dbch\af39\loch\f0 of the late Juma Katende. Juma Katende was the father of his mother. He stated that on 27}{\f0\fs24\super\insrsid16085726\charrsid1315841 \hich\af0\dbch\af39\loch\f0 th}{ \f0\fs24\insrsid16085726\charrsid1315841 \hich\af0\dbch\af39\loch\f0 November 2006 he went with DW1 to Mityana Singo and they came back on 30}{\f0\fs24\super\insrsid16085726\charrsid1315841 \hich\af0\dbch\af39\loch\f0 th}{ \f0\fs24\insrsid16085726\charrsid1315841 \hich\af0\dbch\af39\loch\f0 November 2006. They had gone together as he was buy\hich\af0\dbch\af39\loch\f0 ing land from DW1 and they were also inspecting land of other people.}{ \f0\fs24\insrsid6122111\charrsid1315841 \hich\af0\dbch\af39\loch\f0 He knew the people staying in Juma Katende\hich\f0 \rquote \loch\f0 s house. It is PW2\hich\f0 \rquote \loch\f0 s children.}{\f0\fs24\insrsid11561569\charrsid1315841 \hich\af0\dbch\af39\loch\f0 In 2007 the plaintiff complained to him about these children mistreating her and he advised her to report to the\hich\af0\dbch\af39\loch\f0 police.}{\f0\fs24\insrsid16085726\charrsid1315841 \par {\listtext\pard\plain\s15 \lang2057\langfe1033\langfenp1033\insrsid6426786\charrsid1315841 \hich\af0\dbch\af39\loch\f0 12.\tab}}{\f0\fs24\insrsid6426786\charrsid1315841 \hich\af0\dbch\af39\loch\f0 DW3 was Patrick Kitandore Segindu. He was the chairman of the local council one at Busega. He knew the late Juma Katende. He had property in Busega. He was staying at Nakulabye. He knew the plaintiff. She stays in Busega now in the houses left by \hich\af0\dbch\af39\loch\f0 Juma Katende.}{\f0\fs24\insrsid8484430\charrsid1315841 \hich\af0\dbch\af39\loch\f0 }{\f0\fs24\insrsid8544359\charrsid1315841 \hich\af0\dbch\af39\loch\f0 Her son also built a house there. }{ \f0\fs24\insrsid8484430\charrsid1315841 \hich\af0\dbch\af39\loch\f0 Juma Katende\hich\f0 \rquote \loch\f0 s land in Busega was distributed to the children and the widow.}{\f0\fs24\insrsid8544359\charrsid1315841 \hich\af0\dbch\af39\loch\f0 And that was the close of the case for the defence.}{\f0\fs24\insrsid6426786\charrsid1315841 \par {\listtext\pard\plain\s15 \lang2057\langfe1033\langfenp1033\insrsid3107374\charrsid1315841 \hich\af0\dbch\af39\loch\f0 13.\tab}}\pard \s15\ql \fi-360\li720\ri0\sl480\slmult1 \widctlpar\aspalpha\aspnum\faauto\ls1\adjustright\rin0\lin720\itap0\pararsid7434039 {\f0\fs24\insrsid3107374\charrsid1315841 \hich\af0\dbch\af39\loch\f0 The parties did not frame any issues. And so the court will do so. Issue 1 is w \hich\af0\dbch\af39\loch\f0 hether the defendant evicted or participated in the eviction of the plaintiff from her matrimonial home}{\f0\fs24\insrsid6298456\charrsid1315841 \hich\af0\dbch\af39\loch\f0 . Issue 2 is if the answer to issue 1 is in the affirmative, }{\f0\fs24\insrsid11354213\charrsid1315841 \hich\af0\dbch\af39\loch\f0 whether }{\f0\fs24\insrsid6298456\charrsid1315841 \hich\af0\dbch\af39\loch\f0 the}{ \f0\fs24\insrsid11354213\charrsid1315841 \hich\af0\dbch\af39\loch\f0 plaintiff suffered any damages.}{\f0\fs24\insrsid6298456\charrsid1315841 \hich\af0\dbch\af39\loch\f0 }{\f0\fs24\insrsid11354213\charrsid1315841 \hich\af0\dbch\af39\loch\f0 Issue 3 is whether the plaintiff may be entitled\hich\af0\dbch\af39\loch\f0 to any other relief.}{\f0\fs24\insrsid7434039\charrsid1315841 \par {\listtext\pard\plain\s15 \lang2057\langfe1033\langfenp1033\insrsid5839811\charrsid1315841 \hich\af0\dbch\af39\loch\f0 14.\tab}}{\f0\fs24\insrsid5839811\charrsid1315841 \hich\af0\dbch\af39\loch\f0 Before I deal with the issues set out above I shall out the law with regard to the both the burden and standard of proof. \hich\af0\dbch\af39\loch\f0 The standard of proof in civil cases is on a balance of probability. The party that wishes to establish a fact m\hich\af0\dbch\af39\loch\f0 ust do so on a balance of probability. As stated by Denning J., (as he then was), in }{ \f0\fs24\ul\insrsid5839811\charrsid1315841 \hich\af0\dbch\af39\loch\f0 Miller v Minister of Pensions [1947] 2 All E R 372, at pp 373-374, }{\f0\fs24\insrsid5839811\charrsid1315841 \par }\pard\plain \ql \li1440\ri1440\sa200\sl276\slmult1\widctlpar\aspalpha\aspnum\faauto\adjustright\rin1440\lin1440\itap0\pararsid7434039 \fs22\lang2057\langfe1033\loch\af39\hich\af39\dbch\af39\cgrid\langnp2057\langfenp1033 { \f0\fs24\insrsid5839811\charrsid1315841 \loch\af0\dbch\af39\hich\f0 \lquote \loch\f0 That degree is well settled. It must carry a reasonable degree of probability but not so high as it is\hich\af0\dbch\af39\loch\f0 \hich\f0 required in a criminal case. If the evidence is such that the tribunal can say \'93\loch\f0 \hich\f0 we think it more probable than not,\'94\loch\f0 the burden is discharged, but if the probabilities are equal, it is not.\hich\f0 \rquote \par {\listtext\pard\plain\s15 \lang2057\langfe1033\langfenp1033\insrsid10187171\charrsid1315841 \hich\af0\dbch\af39\loch\f0 15.\tab}}\pard\plain \s15\ql \fi-360\li720\ri0\sl480\slmult1 \widctlpar\aspalpha\aspnum\faauto\ls1\adjustright\rin0\lin720\itap0\pararsid7879742 \fs22\lang2057\langfe1033\loch\af39\hich\af39\dbch\af39\cgrid\langnp2057\langfenp1033 {\f0\fs24\insrsid10187171\charrsid1315841 \hich\af0\dbch\af39\loch\f0 The Plaintiff on her pleadings asserted that }{\f0\fs24\insrsid6382168\charrsid1315841 \hich\af0\dbch\af39\loch\f0 a certain }{\f0\fs24\insrsid5388476\charrsid1315841 \hich\af0\dbch\af39\loch\f0 Wasswa}{\f0\fs24\insrsid6382168\charrsid1315841 \hich\af0\dbch\af39\loch\f0 Um\hich\af0\dbch\af39\loch\f0 aru}{\f0\fs24\insrsid10187171\charrsid1315841 \hich\af0\dbch\af39\loch\f0 evicted her from the house in question on 28}{\f0\fs24\super\insrsid10187171\charrsid1315841 \hich\af0\dbch\af39\loch\f0 th}{\f0\fs24\insrsid10187171\charrsid1315841 \hich\af0\dbch\af39\loch\f0 November\hich\af0\dbch\af39\loch\f0 2006}{\f0\fs24\insrsid6382168\charrsid1315841 \hich\af0\dbch\af39\loch\f0 and he did so with the assistance of the defendant}{ \f0\fs24\insrsid10187171\charrsid1315841 \hich\af0\dbch\af39\loch\f0 . }{\f0\fs24\insrsid6382168\charrsid1315841 \hich\af0\dbch\af39\loch\f0 This she repeated in her testimony to this court, alleging that the defendant broke a pipe at the house and this frightened her.}{\f0\fs24\insrsid10685489\charrsid1315841 \hich\af0\dbch\af39\loch\f0 None of he\hich\af0\dbch\af39\loch\f0 r witnesses supported this version of direct participation of the defendant in her eviction. He contended that it was PW2 who put his sons \hich\af0\dbch\af39\loch\f0 into that house. On the face of it this would be logical. What is held against him is that he }{\f0\fs24\insrsid10842065\charrsid1315841 \hich\af0\dbch\af39\loch\f0 stood as a surety for the children on some charge.
