Ruling

1. The Petitioner John Luvai Kadanya is a convict in Ukwala PM SO 29/2016. He was sentenced to serve 20 years imprisonment.

2. He appealed vide Siaya HCCRA 82/2016 which appeal was dismissed on 19/2/2018. He petitioned for resentencing vide Cr. Pet. E008/2023 which petition was dismissed on 28/2/2023.

3. He now petitions for another resentencing after the judges who heard his appeal and resentence application were transferred from Siaya High Court.

4. I find the petition dated 14/3/2023 to be an abuse of court process. It is devoid of merit and the same is hereby dismissed.
