Ruling

1. The application for sentence review is considered in the light of the materials before the court, namely the lower court proceedings, the affidavit in support thereof, the response and the pre-sentence review report. I note that, the value of the subject matter of the suit is Kshs 2,300. I also note that, the applicant has served over six months in custody. The pre-sentence review report is positive or favourable. I therefore find that, this matter is suitable for review and I direct that, the same be and is hereby reviewed under the Community Service Order Actand direct that, the applicant serve the remaining period of his sentence of 5 months on Community Service Order at Mbaruk Chief Office. The chief through Probation Department to file a report of successful completion of the sentence or otherwise.
