Between

Justus Kang’Ethe

Applicant

and

Republic

Respondent

Ruling

1. This matter having been placed before me this morning to exercise my revision jurisdiction under Section 364 of the Criminal Procedure Code. I have perused the Record and noted that the sentence review report on the applicant is positive.

2. He was sentenced to serve 9 months. I find that the sentence of imprisonment may not be the most ideal considering his relatively young age.

3. I alter the sentence of fine of Ksh. 15,000/= in default 9 months and substitute therefore with an order that he serves community service for a period of 9 months at the Chief Camp to plant trees and turn the place green. It is so ordered.
