(Being an appeal from the Judgment and Decree of the Senior Resident Magistrate’s Court at Ruiru, Hon. C. L. Adisa dated 27th November, 2024 in Ruiru CMCC NO.E480 of 2023)

Ruling

1. This matter came up for parties to confirm compliance of directions issued on 24th March, 2025. However, the Appellant’s counsel was not in attendance and neither had they filed a Record of Appeal as directed then.

2. The Appellant’s counsel has then come onto the Platform just after the court has rendered a decision with regard to their unexplained absence and failure to comply with its directions. She has explained the reason for not having been on the Platform and why they had not filed a Record of Appeal. She has then sought for court’s indulgence and for the period within which an appeal could be filed to be enlarged.

3. However, this request has been overtaken by events and therefore the same is declined with directions that the Appellant moves the court formally in an appropriate manner.It is so ordered.
