No. UPX 482 Mitsubishi, }{\insrsid13307539\charrsid13070913 and tried}{\insrsid5512447\charrsid13070913 to overtake another}{\insrsid12989770\charrsid13070913 vehicle and he knocked her and killed her instantly.}{ \insrsid5512447\charrsid13070913 \par }{\insrsid12989770\charrsid13070913 \par The plaintiff in his oral }{\insrsid2767859\charrsid13070913 testimony}{\insrsid12989770\charrsid13070913 }{\insrsid10827902\charrsid13070913 stated}{\insrsid12989770\charrsid13070913 that he was at Kataba}{\insrsid12413169\charrsid13070913 l}{ \insrsid12989770\charrsid13070913 anga trading centre, next to Mubende National Teachers College on Fort Portal Road, on the material date. }{\insrsid10827902\charrsid13070913 His sister}{\insrsid12989770\charrsid13070913 the late Bishagenda had brought foodstuff (fresh cassava and potatoes) to the trading centre for sale. He had escorted her. As they by passed a vehicle selling fish by the road side, a white double cabin }{\insrsid10827902\charrsid13070913 pickup UPX 482, Mitshubishi came very fast and tried to over take a lorry. Both lorry and pick up were coming from Mubende and were heading to Kampala. The plaintiff and his sister were on the l}{\insrsid16714414\charrsid13070913 ef}{ \insrsid10827902\charrsid13070913 t side of the road facing Mubend}{\insrsid7825746\charrsid13070913 e}{\insrsid10827902\charrsid13070913 . The pick up knocked his sister. He saw her bleeding}{\insrsid4597556\charrsid13070913 on head and nose. He }{ \insrsid16714414\charrsid13070913 immediately }{\insrsid4597556\charrsid13070913 got a motorcycle and rushed }{\insrsid12413169\charrsid13070913 to the}{\insrsid4597556\charrsid13070913 village t o inform then that she had been knocked by a motor vehicle. When he returned, he was informed that the police had already taken the body t}{\insrsid16714414\charrsid13070913 o}{\insrsid4597556\charrsid13070913 the hospital. At the hospital, they collected the body and took it for burial at their village at Kataba}{\insrsid16714414\charrsid13070913 l}{\insrsid4597556\charrsid13070913 anga LC1, about 7 miles from Mubende Hospital. He blamed the 1}{ \super\insrsid4597556\charrsid13070913 st}{\insrsid4597556\charrsid13070913 Defendant for the accident. The police report indicated that she died instantly. }{\insrsid16479537\charrsid13070913 T}{\insrsid8921815\charrsid13070913 his evidence is in my view, adequate proof on the balance of probabilities of negligence, that is excessive speed, and overtaking without due regard to }{\insrsid11599984\charrsid13070913 other road users. All the children were minors and were being looked after by their mothers. The widows also qualified as dependants}{\insrsid6233255\charrsid13070913 since the deceased was looking after them. Applying the multiplier, to the }{ \insrsid4089917\charrsid13070913 multiplicand,}{\insrsid16733655\charrsid13070913 the }{\insrsid14524\charrsid13070913 lost}{\insrsid16733655\charrsid13070913 dependence was found to be shs}{\insrsid4089917\charrsid13070913 }{ \insrsid16733655\charrsid13070913 900,000}{\insrsid4089917\charrsid13070913 }{\insrsid16733655\charrsid13070913 X}{\insrsid4089917\charrsid13070913 }{\insrsid16733655\charrsid13070913 20, which gave shs 18,000,000. }{\insrsid4089917\charrsid13070913 The}{\insrsid16733655\charrsid13070913 said amount was reduced by 10% to take care of imponderances and the dependants}{\insrsid11234672\charrsid13070913 were awarded shs 16,200,000.}{\insrsid7622112\charrsid13070913 \par }{\insrsid11234672\charrsid13070913 \par Applying the same formula to the instant case, }{\insrsid10637476\charrsid13070913 C}{\insrsid11234672\charrsid13070913 ourt finds that the deceased earned at least shs 300,000 per month from her produce. It can be safely assumed that she spent at }{ \insrsid2642604\charrsid13070913 least 75}{\insrsid3301436\charrsid13070913 % on the }{\insrsid2642604\charrsid13070913 family that}{\insrsid3301436\charrsid13070913 is shs 225,000}{\insrsid13002196\charrsid13070913 per month}{ \insrsid3301436\charrsid13070913 . That means shs 225,000 X12 }{\insrsid13002196\charrsid13070913 which equals to}{\insrsid3301436\charrsid13070913 shs 2,700,000, per annum on the family. The deceased was aged}{\insrsid1655478\charrsid13070913 35 years. }{\insrsid3301436\charrsid13070913 The post mortem report showed a well nourished person. The brother described }{\insrsid2642604\charrsid13070913 her as }{\insrsid2774434\charrsid13070913 hardworking}{\insrsid2642604\charrsid13070913 lady who made money from the sale of her farm produce such as beans, maize and potatoes. She had about another 20 more years of working life}{\insrsid5589999\charrsid13070913 by Uganda standards}{\insrsid8194027\charrsid13070913 . All her children were minors. The brother }{\insrsid15363817\charrsid13070913 and }{\insrsid15736842\charrsid13070913 it appears}{\insrsid15363817\charrsid13070913 even }{\insrsid15736842\charrsid13070913 the husband}{ \insrsid15363817\charrsid13070913 }{\insrsid8194027\charrsid13070913 also depended on her. They would have continued to depend on her until probably 20 years.}{\insrsid15736842\charrsid13070913 The husband actually died soon thereafter, according to Plot.}{\insrsid11234672\charrsid13070913 \par }{\insrsid8192215\charrsid13070913 \par }{\insrsid8194027\charrsid13070913 Taking into account the above facts especially considering the }{\insrsid15736842\charrsid13070913 l}{\insrsid8194027\charrsid13070913 ife style of the decease}{\insrsid12739456\charrsid13070913 d}{ \insrsid8194027\charrsid13070913 and the fact that the damages will be }{\insrsid12739456\charrsid13070913 p}{\insrsid8194027\charrsid13070913 aid in a lump some, a multiplier of 20 would be appropriate. Applying the multiplier to the multiplicand the dependency would be 2,700,000 X 20 which would give 54,000,000. A saving account was to be opened for each child. \par \par Similarly in the case before me, the damages shall be apportioned in such a way that the younger children receive a larger sum. He was dependent on the sister.
