Full Case Text
REPUBLIC OF KENYA
IN THE HIGH COURT AT NAIROBI
CRIMINAL DIVISION
CRIMINAL REVISION NO. 694 OF 2018
KENNETH KASYOKI MUTHEA.........APPELLNT
VERSUS
REPUBLIC..........................................RESPONDENT
RULING
1. The Appellant was granted a bond of Kshs. 300,000/= with a surety of a similar amount. As condition that would ensure he attends court, the bond terms must be commensurate with the offence. A surety bond would be sufficient in the circumstances given that the offence is serious.
2. Accordingly, I decline to substitute the surety bond with cash bail. Instead, I reduce the bond to one of Kshs. 100,000/= with one surety of a similar amount to be assessed by the trial court.
3. The trial court file to be remitted to trial court for hearing on 16/5/2019 as scheduled. Production order to issue.
DATED and DELIVERED THIS 7TH DAY OF MAY, 2019.

2. M/s Akunja for the Respondent.
