((From the original conviction and sentence in Criminal Case No.720 of 2012 of the SPM’s court at Kapenguria))
Ruling
1. The applicant filed the application dated 30/7/2024 seeking that the court do revise his sentence. It is clear from the court records that in Misc. Criminal Application No. E007 of 2023, the court ordered resentencing of the applicant and on 10/8/2023, the Chief Magistrate’s court resentenced him to forty (40) years imprisonment.
2. I note too the applicant has so far filed four (4) Miscellaneous applications in this court. It is an abuse of court process, If aggrieved, he should move to the Court of Appeal.
3Application dismissed.
