KINGSLEY KOFI NYARKO FIAGBEDZI RESPONDENT Parties Present Joyce Agyemang Attafuah Present for Petition Theresa Tabi Present holding brief for Nana Adjei Baffour-Awuah for Respondent By Court – Judgment Having read the pleadings put before this Court by the Parties, Having read their Witness Statements and perused the Exhibits A and 1, attached to the Parities witness statements, And having due regard to Section 2(1) (f) of the Matrimonial Causes Act (Act 367), I am of the considered opinion that on all the evidence on record; a) The fact of the Parties having irreconcilable differences, and b) The fact of the Parties not living together as husband and wife for a continuous period of more than 5 years immediately preceeding the presentation of this Divorce Petition is established In the circumstances, I find that the Ordinance marriage celebrated between the Parties on the 19th day of June 2007 has broken down beyond reconciliation. I accordingly dissolve the said Ordinance Marriage this 28th day of October 2022. The Registrar of this Court shall issue to the Parties a Divorce Certificate after canceling their marriage Certificate (to be brought by the Petitioner). The Registrar of this Court shall issue to this Parties a Divorce Certificate after cancelling their Marriage Certificate (Exhibit 1). Further, the Terms of Settlement duly executed by the Parties on the 1st day of August 2022 and filed in this court on the 29th day of September 2022 is hereby adopted as Consent Judgment this 28th day of October 2022 in Final resolution of all ancillary issues raised by the instant Divorce Petition.
