Ruling

1. The applicant herein was charged with an offence of being in possession of Narcotic Drugs contrary to section 3(1) as read with sub section 3(2) of the Narcotic Drugs and psychotropic substances control Act No 4 of 1994. The particulars of the offence are that on the 19. 1.2025 at Jerusalem area in Soy sub county within Uasingishu county was found in possession of cannabis sativa to with 146 Rolls valued at Kshs 7300 in contravention of the said Act.

2. The Applicant pleaded guilty and was sentenced to 6 months imprisonment on 21. 1.2025. On consideration for the Application for review there is sufficient evidence that the matter has been compromised by the expiry of the period contemplated by the Probation Officer. With that in mind the Applicant shall be released forthwith unless otherwise lawfully held
