A consent judgment was on 28}{\fs24\super\insrsid1837710\charrsid1580288 th}{\fs24\insrsid1837710\charrsid1580288 January 2008 entered against }{\fs24\insrsid2166137\charrsid1580288 t}{\fs24\insrsid1837710\charrsid1580288 he four defendants in favour of the Respondent. The judgment-debtors failed to satisfy the consent judgment and a warrant of attachment and sale of immovable property was issued on 30}{\fs24\super\insrsid1837710\charrsid1580288 th}{\fs24\insrsid1837710\charrsid1580288 June 2008. Among the propert}{\fs24\insrsid2166137\charrsid1580288 ies}{ \fs24\insrsid1837710\charrsid1580288 to be attached were small tenants}{\fs24\insrsid2166137\charrsid1580288 \rquote }{\fs24\insrsid1837710\charrsid1580288 houses located }{\fs24\insrsid11100782\charrsid1580288 in Ki}{ \fs24\insrsid2166137\charrsid1580288 gwany}{\fs24\insrsid11100782\charrsid1580288 i LCI Busega Parish Rubaga Division Kampala, Annexture \'93D\'94 to the affidavit in support of the application is the warrant. In paragraph 8 of the affidavit the Applicant states that on 16}{\fs24\super\insrsid11100782\charrsid1580288 th}{\fs24\insrsid11100782\charrsid1580288 July 2008, the court Bailiff called Fred Bwanika of Frem}{ \fs24\insrsid2166137\charrsid1580288 k}{\fs24\insrsid11100782\charrsid1580288 lia General Agencies to whom the said warrant was issued wrote }{\fs24\insrsid16008993\charrsid1580288 a letter addressed to the first defe ndant and therein requested the tenants occupying the land and houses at Mailo Register Kibuga Block 21 Plot 679 Busega, K}{\fs24\insrsid6647515\charrsid1580288 igwanyi }{\fs24\insrsid16008993\charrsid1580288 zone, Lubaga Division to vacate the premises. }{\fs24\insrsid3890309\charrsid1580288 \par }{\fs24\insrsid16008993\charrsid1580288 \par This application is made under Order 22 rules 55}{\fs24\insrsid6647515\charrsid1580288 -57}{\fs24\insrsid16008993\charrsid1580288 of the Civil Procedure Rules. Rule 55 (}{\fs24\insrsid12074012\charrsid1580288 I}{\fs24\insrsid16008993\charrsid1580288 ) require}{\fs24\insrsid6647515\charrsid1580288 s }{\fs24\insrsid16008993\charrsid1580288 an objector applicat}{\fs24\insrsid6647515\charrsid1580288 ion}{\fs24\insrsid16008993\charrsid1580288 not to be }{\fs24\insrsid6647515\charrsid1580288 designedly}{ \fs24\insrsid16008993\charrsid1580288 delayed. The warrant was issued on 30}{\fs24\super\insrsid16008993\charrsid1580288 th}{\fs24\insrsid16008993\charrsid1580288 June 2008 and the Court Bailiff}{\fs24\insrsid12074012\charrsid1580288 \rquote }{ \fs24\insrsid16008993\charrsid1580288 s letter of attachment issued on 16}{\fs24\super\insrsid16008993\charrsid1580288 th}{\fs24\insrsid16008993\charrsid1580288 July, 2008. I}{\fs24\insrsid10751354\charrsid1580288 n the premises this application was }{ \fs24\insrsid12074012\charrsid1580288 on 25}{\fs24\super\insrsid12074012\charrsid1580288 th}{\fs24\insrsid12074012\charrsid1580288 July 2008 }{\fs24\insrsid10751354\charrsid1580288 filed without delay.}{\fs24\insrsid16008993\charrsid1580288 \par }{\fs24\insrsid10751354\charrsid1580288 \par Rule 56 requires the Objector to adduce evidence to show that a}{\fs24\insrsid163786\charrsid1580288 t}{\fs24\insrsid10751354\charrsid1580288 the time of attachment he had interest in the property. While rules 57 and 58 require proof that the property was at the time of attachment in possession of the Objector, so held on his own account. The issues }{\fs24\insrsid163786\charrsid1580288 for courts investigation are}{\fs24\insrsid10751354\charrsid1580288 basically that of possession coupled with interest that the Objector has in the property. The questions of legal right and title are not relevant except so far as they may affect the decision as to whether the possession is }{ \fs24\insrsid163786\charrsid1580288 o}{\fs24\insrsid10751354\charrsid1580288 n account of or in trust for the judgment debtor or some other person. To that extent the title may be part of inquiry. See }{\i\fs24\ul\insrsid10751354\charrsid1580288 Her}{ \i\fs24\ul\insrsid163786\charrsid1580288 i}{\i\fs24\ul\insrsid10751354\charrsid1580288 la}{\i\fs24\ul\insrsid163786\charrsid1580288 l}{\i\fs24\ul\insrsid10751354\charrsid1580288 & Co Vs Buganda Industries Ltd (1960) EA 318, David Muhenda & Others Vs Margaret Kamunye S. C. C. Appeal No. 9 of 1999}{\fs24\insrsid10751354\charrsid1580288 . \par \par In his affidavit, the Applicant states that he bought the property from the judgment }{\fs24\insrsid16400300\charrsid1580288 debtor on 3}{\fs24\super\insrsid16400300\charrsid1580288 rd}{\fs24\insrsid16400300\charrsid1580288 August 2007 at an agreed consideration of Shs30,000,000/= of which he paid shs28,000,000/= }{\fs24\insrsid163786\charrsid1580288 and had}{\fs24\insrsid16400300\charrsid1580288 an out standing balance of Shs2,000,000/= Annexture \'93A\'94 to the affidavit is the agreement by which the judgment debtor sold the property to the Objector. The Objector further states that he took immediate possession of the land upon buying it and undertook renovations to the dilapidated building}{ \fs24\insrsid12074012\charrsid1580288 s}{\fs24\insrsid16400300\charrsid1580288 then thereon and constructed thereo}{\fs24\insrsid163786\charrsid1580288 n}{\fs24\insrsid16400300\charrsid1580288 other houses. That all the houses are occupied by his tenants from whom he collects rent. Annexture B to the Affidavit are copies of rental receipts issued to various tenants }{\fs24\insrsid163786\charrsid1580288 dat}{ \fs24\insrsid16400300\charrsid1580288 ing from 3}{\fs24\super\insrsid16400300\charrsid1580288 rd}{\fs24\insrsid16400300\charrsid1580288 October 2007 to 29}{\fs24\super\insrsid16400300\charrsid1580288 th}{\fs24\insrsid16400300\charrsid1580288 June 2008. Mr. Lutakome, Counsel for the Applicant}{\fs24\insrsid163786\charrsid1580288 submitted that the Applicant }{\fs24\insrsid16400300\charrsid1580288 had adduced evidence to prove that by the time court issued the warrant he had acquired interest in the property as per the sale agreement as purchaser the reof and had already taken possession of the property. Counsel submitted that rules 56 and 57, respectively emphasizes interest and possession. }{\fs24\insrsid14029162\charrsid1580288 \par }{\fs24\insrsid16400300\charrsid1580288 \par }{\fs24\insrsid163786\charrsid1580288 The R}{\fs24\insrsid16400300\charrsid1580288 e}{\fs24\insrsid163786\charrsid1580288 spondent filed an affidavit in r}{\fs24\insrsid16400300\charrsid1580288 eply deponed to by Fred Bwanika, the Court }{ \fs24\insrsid3148008\charrsid1580288 Bailiff to wh}{\fs24\insrsid163786\charrsid1580288 o}{\fs24\insrsid3148008\charrsid1580288 m the warrant was issued. He avers therein that when he investigated }{\fs24\insrsid6100359\charrsid1580288 in the Land Registration Office he found that the land was registered in Benjamin}{\fs24\insrsid163786\charrsid1580288 \rquote s}{\fs24\insrsid6100359\charrsid1580288 names with his caveat }{\fs24\insrsid5842579\charrsid1580288 registered on}{ \fs24\insrsid6100359\charrsid1580288 15}{\fs24\super\insrsid6100359\charrsid1580288 th}{\fs24\insrsid6100359\charrsid1580288 June 2007. He contends that the agreement of purchase looked suspicious }{\fs24\insrsid163786\charrsid1580288 as the date on}{ \fs24\insrsid6100359\charrsid1580288 which the lawyer witnessed it looked tempered with, the Objector did not have a duplicate certificate title or transfer deed executed in his favour by the seller/judgment debtor and he had not lodged a caveat o}{ \fs24\insrsid163786\charrsid1580288 n}{\fs24\insrsid6100359\charrsid1580288 the title to protect his inter est. In his view the sale agreement may be a forgery by Benjamin Byarugaba to hide the property in a fabricated sale agreement and in the meantime he went into hiding, not to study abroad as claimed. \par \par The }{\fs24\insrsid163786\charrsid1580288 R}{\fs24\insrsid6100359\charrsid1580288 espondent thereby raises issues concerning }{\fs24\insrsid12680195\charrsid1580288 ownership and}{\fs24\insrsid6100359\charrsid1580288 of title to the property. He also raise}{\fs24\insrsid163786\charrsid1580288 s the}{\fs24\insrsid6100359\charrsid1580288 question of validity of the agreement, collusion between the judgment-debtor and the Objector to defeat the judgment-creditors right of attachment of the property and even forgery. However, Order 22 rules 56 \endash 57 CPR only call on the objector to show that }{\fs24\insrsid163786\charrsid1580288 at }{\fs24\insrsid6100359\charrsid1580288 the time of attachment he had some interest in the property and that he was in possession of the property on his own account but not on account of some other person. Court is clearly excluded from investigating the issues raised by the }{ \fs24\insrsid5842579\charrsid1580288 Respondent}{\fs24\insrsid6100359\charrsid1580288 . }{\fs24\insrsid16400300\charrsid1580288 \par }{\fs24\insrsid6100359\charrsid1580288 \par In }{\i\fs24\ul\insrsid6100359\charrsid1580288 Harila}{\i\fs24\ul\insrsid163786\charrsid1580288 l}{\i\fs24\ul\insrsid6100359\charrsid1580288 & Co Vs Buganda Industries Ltd (1960) EA 313 at page 319}{\fs24\insrsid6100359\charrsid1580288 L}{ \fs24\insrsid163786\charrsid1580288 e}{\fs24\insrsid6100359\charrsid1580288 wis J quoted }{\fs24\insrsid534911\charrsid1580288 C}{\fs24\insrsid12074012\charrsid1580288 hitaley }{\fs24\insrsid6100359\charrsid1580288 and Rao\rquote s }{ \fs24\insrsid163786\charrsid1580288 C}{\fs24\insrsid534911\charrsid1580288 ode of Civil Procedure 6}{\fs24\super\insrsid534911\charrsid1580288 th}{\fs24\insrsid534911\charrsid1580288 Ed. The question to be decided is, whether on the date of attachment, the judgment \endash debtor or the objector was in }{\fs24\insrsid12680195\charrsid1580288 possession or}{\fs24\insrsid4218847\charrsid1580288 where the court is satisfied that the property was in the possession of the objector, it must be found whether he held it on his own account }{\fs24\insrsid12074012\charrsid1580288 or }{\fs24\insrsid4218847\charrsid1580288 in trust for the judgment debtor. The sole quest}{\fs24\insrsid14568425\charrsid1580288 ion to be investigated is, thus one of possession}{\fs24\insrsid163786\charrsid1580288 .}{\fs24\insrsid14568425\charrsid1580288 }{ \fs24\insrsid6388213\charrsid1580288 Q}{\fs24\insrsid14568425\charrsid1580288 uestions of legal right and title are not relevant, except so far as they may affect the decision as to whether the possession is on account of or in trust for the judgment debtor or some other person. To that extent the title may be part of the inquiry. However, this presumption of interest cannot be conclusive evidence of ownership. It is rebutt}{ \fs24\insrsid6388213\charrsid1580288 able}{\fs24\insrsid15876449\charrsid1580288 and Order 22 rule 60 CPR is very clear on this. ( as he then was ) stated that at the }{\fs24\insrsid6388213\charrsid1580288 end }{\fs24\insrsid2054533\charrsid1580288 of the objector proceedings one of the parties must sue in order to determine the issue of the }{ \fs24\insrsid6388213\charrsid1580288 title of the }{\fs24\insrsid2054533\charrsid1580288 property as the order made under the rules is only pro}{\fs24\insrsid6388213\charrsid1580288 visional}{\fs24\insrsid2054533\charrsid1580288 .}{ \fs24\insrsid8084612\charrsid1580288 \par }{\fs24\insrsid2054533\charrsid1580288 \par The }{\fs24\insrsid6388213\charrsid1580288 A}{\fs24\insrsid2054533\charrsid1580288 pplicant/Objector avers in hi}{\fs24\insrsid6388213\charrsid1580288 s}{\fs24\insrsid2054533\charrsid1580288 affidavit that he still owed the judgment \endash debtor a sum of Shs2,000,000/= as balance on the agreed consideration of Shs30,000,000/= . Paragraph 5 of the sale Agreement provides: \par }\pard \qj \li1440\ri1440\sl360\slmult1\widctlpar\aspalpha\aspnum\faauto\adjustright\rin1440\lin1440\itap0\pararsid1580288 {\fs24\insrsid2054533\charrsid1580288 \par \'93The Vendor shall handover to the Purchaser the duplicate title deed in respect of the said land and also sign a transfer instrument in favour of the Purchaser upon payment of all the said agreed consideration.\'94 \par }\pard \qj \li0\ri0\sl360\slmult1\widctlpar\aspalpha\aspnum\faauto\adjustright\rin0\lin0\itap0\pararsid1580288 {\fs24\insrsid2054533\charrsid1580288 \par The judgment \endash debtor still had an interest in the land worth Shs }{\fs24\insrsid15543140\charrsid1580288 2,000,000/= and this explains his caveat }{\fs24\insrsid14701561\charrsid1580288 lodged on the land. The Applicant in paragraphs 10 to 12 }{ \fs24\insrsid9333704\charrsid1580288 explains why}{\fs24\insrsid14701561\charrsid1580288 he had not paid the balance of shs2, 000,000/= within the agreed period of six months. He states that the judgment debtor had informed him that he had lost the duplicate certificate of the title and requested }{\fs24\insrsid9333704\charrsid1580288 him to be patient until his return from South Africa. I agree with Mr. Erick Muhw}{\fs24\insrsid1535505\charrsid1580288 e}{\fs24\insrsid9333704\charrsid1580288 zi , counsel for the Respondent, that the Applicant has not shown interest in the land by his failure to protect the same by lodgment of a caveat on the land title. However such laxity on }{\fs24\insrsid12082287\charrsid1580288 the part}{ \fs24\insrsid9333704\charrsid1580288 of the Objector cannot be interpreted to extinguish his interest in the land. }{\fs24\insrsid2054533\charrsid1580288 \par }{\fs24\insrsid9333704\charrsid1580288 \par Mr. Muh}{\fs24\insrsid12082287\charrsid1580288 wez}{\fs24\insrsid9333704\charrsid1580288 i doubted }{\fs24\insrsid15788\charrsid1580288 the Agreement}{\fs24\insrsid9333704\charrsid1580288 of sale of the land due to what appeared like }{ \fs24\insrsid12074012\charrsid1580288 a}{\fs24\insrsid9333704\charrsid1580288 n ink drop beside the month of purchase in the Advocate}{\fs24\insrsid12074012\charrsid1580288 \rquote }{\fs24\insrsid9333704\charrsid1580288 s stamp witness}{ \fs24\insrsid12082287\charrsid1580288 ing}{\fs24\insrsid9333704\charrsid1580288 the agreement. However, what is clear form the Agreement is that }{\fs24\insrsid12082287\charrsid1580288 the }{\fs24\insrsid9333704\charrsid1580288 transa ction was in 2007 while the warrant was issued on 30}{\fs24\super\insrsid9333704\charrsid1580288 th}{\fs24\insrsid9333704\charrsid1580288 June 2008. }{\fs24\insrsid15788\charrsid1580288 T}{\fs24\insrsid9333704\charrsid1580288 he Agreement is stated made on 3}{\fs24\super\insrsid9333704\charrsid1580288 rd}{\fs24\insrsid9333704\charrsid1580288 August 2007. \par \par Considering all the above I find that by the date of attachment the Objector had an interest in the land as purchase}{\fs24\insrsid12082287\charrsid1580288 r}{\fs24\insrsid9333704\charrsid1580288 thereof. \par \par As evidence of possession the Objector attached rental receipts. The receipts are headed and signed for \'93Henry Kiyegga Housing Estate\'94 In paragraph 9 of the Respondent\rquote s affidavit in reply, Fisal Bwanika states that the above business}{ \fs24\insrsid12082287\charrsid1580288 name}{\fs24\insrsid9333704\charrsid1580288 is not registered in the Registry of Business}{\fs24\insrsid12082287\charrsid1580288 na}{\fs24\insrsid9333704\charrsid1580288 me}{\fs24\insrsid12074012\charrsid1580288 s}{ \fs24\insrsid9333704\charrsid1580288 . He therefore contends that the name is f}{\fs24\insrsid12082287\charrsid1580288 i}{\fs24\insrsid9333704\charrsid1580288 ctitious. Mr. Muhwezi for the Respondent argued that there was no connection between the Objector and Henry }{\fs24\insrsid8944466\charrsid1580288 Kiyega Housing Estate.}{\fs24\insrsid9333704\charrsid1580288 \par }{\fs24\insrsid8944466\charrsid1580288 \par With due respect to counsel, section 2 of the Business }{\fs24\insrsid12082287\charrsid1580288 N}{\fs24\insrsid8944466\charrsid1580288 ames Registration }{\fs24\insrsid12082287\charrsid1580288 A}{\fs24\insrsid8944466\charrsid1580288 ct only }{ \fs24\insrsid15788\charrsid1580288 requires to be registered a f}{\fs24\insrsid12082287\charrsid1580288 irm}{\fs24\insrsid15788\charrsid1580288 carrying on business under a name which does not consist o}{\fs24\insrsid12082287\charrsid1580288 f}{ \fs24\insrsid15788\charrsid1580288 the true Christian names of the partners. In his affidavit the Objector states that he is \'93Kiyega Henry\'94}{\fs24\insrsid12082287\charrsid1580288 .}{\fs24\insrsid15788\charrsid1580288 }{ \fs24\insrsid12082287\charrsid1580288 H}{\fs24\insrsid1777921\charrsid1580288 is}{\fs24\insrsid15788\charrsid1580288 identity is not disputed. In the circumstances the Objector}{\fs24\insrsid12082287\charrsid1580288 was under no obligation}{ \fs24\insrsid15788\charrsid1580288 to register his trade }{\fs24\insrsid1777921\charrsid1580288 name of \'93Henry Kiyegga Housing Estate\'94}{\fs24\insrsid8944466\charrsid1580288 \par }{\fs24\insrsid1777921\charrsid1580288 \par Fred Bwanika stated in his affidavit that }{\fs24\insrsid12082287\charrsid1580288 a}{\fs24\insrsid1777921\charrsid1580288 n informant ha}{\fs24\insrsid12082287\charrsid1580288 d}{\fs24\insrsid1777921\charrsid1580288 told him that the judgment \endash debtor had land with small commercial houses at Busega, Rubaga Division, K}{\fs24\insrsid12082287\charrsid1580288 ampala}{\fs24\insrsid1777921\charrsid1580288 and had shown him the suit houses as the houses. The above averment was based on information from an undisclosed source}{\fs24\insrsid12082287\charrsid1580288 and as such not admissible - S}{\fs24\insrsid1777921\charrsid1580288 ee Order 19 rule 3 (}{ \fs24\insrsid12082287\charrsid1580288 I}{\fs24\insrsid1777921\charrsid1580288 ) of the Civil Procedure Rules. \par \par In paragr}{\fs24\insrsid9203007\charrsid1580288 aph 6 Fred Bwanika states that o}{\fs24\insrsid1777921\charrsid1580288 n attachment of the land he found one Nalongo Jennifer who told him that she was a tenant o}{\fs24\insrsid9203007\charrsid1580288 f}{ \fs24\insrsid1777921\charrsid1580288 the Judgment Debtor, Benjamin Bya}{\fs24\insrsid9203007\charrsid1580288 ruhanga}{\fs24\insrsid1777921\charrsid1580288 , and that she also oversees the house for the tenants }{\fs24\insrsid13975066\charrsid1580288 in the judgment \endash debtor}{\fs24\insrsid12074012\charrsid1580288 \rquote }{\fs24\insrsid13975066\charrsid1580288 s absence and that she received the letter giving notice }{\fs24\insrsid12074012\charrsid1580288 of }{ \fs24\insrsid13975066\charrsid1580288 attachment which she undertook to deliver to the judgment debtor. In paragraphs 5 he states that he was assured by the area LC1 Chairman one L Mukasa on Mobile telephone No. 0752-896826 that the houses indeed belonged to the judgment debtor. Both the said Nalongo Jennifer and L Mukasa did not swear an}{\fs24\insrsid9203007\charrsid1580288 y}{\fs24\insrsid13975066\charrsid1580288 affidavit to verify the information attributed to them. Further there was no evidence adduced to show that Nalongo Jennifer was caretaking the houses on behalf of the Judgment Debtor. }{\fs24\insrsid1777921\charrsid1580288 \par }{\fs24\insrsid9203007\charrsid1580288 \par }{\fs24\insrsid13975066\charrsid1580288 I am satisfied by the evidence adduced by the Objector that he was in possession of the property on his own account by the time of the att}{\fs24\insrsid9203007\charrsid1580288 achment}{ \fs24\insrsid13975066\charrsid1580288 . \par }{\fs24\insrsid12074012\charrsid1580288 \par \par \par \par \par }{\fs24\insrsid13975066\charrsid1580288 \par It is accordingly }{\fs24\insrsid9203007\charrsid1580288 ordered}{\fs24\insrsid13975066\charrsid1580288 that the land }{\fs24\insrsid9203007\charrsid1580288 and }{\fs24\insrsid13975066\charrsid1580288 the development comprised in Ma ilo Register Kibuga Block 21 Plot 697 Buunga, Kig}{\fs24\insrsid9203007\charrsid1580288 wan}{\fs24\insrsid13975066\charrsid1580288 ya Zone, Lubaga Division Kampala}{\fs24\insrsid9203007\charrsid1580288 i}{\fs24\insrsid12074012\charrsid1580288 s}{ \fs24\insrsid9203007\charrsid1580288 hereby released}{\fs24\insrsid13975066\charrsid1580288 from attachment and sale.
