Ruling

1. The Applicant seeks review of sentence of imprisonment of two (2) years for the offence of stealing contrary to section 368 (1) as read together with section 275 of the Penal Code.

2. This Court has called for and reviewed the entire proceedings in Molo CM’s Criminal Case E1506 of 2022 with a view of satisfying itself as to the correctness, legality or propriety of the sentence.The Court finds no fault with the sentence as imposed.

3. The trial Court took into consideration the Applicant’s 1st offender status.

4. The Applicant was a repeat offender having contravened terms a 3 month’s probation for a similar offence in Criminal Case No E140 of 2022.

5. This Court finds no reason to disturb the sentence as imposed by the trial Court.

6. The application is dismissed for lack of merit.

It is so ordered.
