On that day the victim, who was}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid1261847 then aged 14 years old, was at }{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid12724088\charrsid16000762 home with her mother when the appellant came there and called her outside the house. Her mother was then resting. It was around 5 }{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid1261847\charrsid16000762 p.m. }{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid12724088\charrsid16000762 When the victim showed some reluctance the appellant lifted her from the house, took her to the nearby bush and defiled her. She cried out and in so doing woke up her mother who ran from the hous}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid1261847 e to where they were. When she}{\rtlch\fcs1 \ai\af0 \ltrch\fcs0 \insrsid12724088\charrsid1261847 }{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid12724088\charrsid1261847 arrived}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid12724088\charrsid16000762 , the appellant got off his victim and ran away. He was later arrested and charged with the offence of defilement. At his trial, he pleaded alibi which was not accepted. He also argued that the evidence of her mother}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid3474910 }{ \rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid12724088\charrsid16000762 (PW3) was equally suspect as conditions of lighting did not }{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid3474910 favour correct identification. \par }{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid12724088\charrsid16000762 In reply, Mr. Byabakama Mugen}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid3474910 yi, the learned Deputy DPP, who}{\rtlch\fcs1 \ai\af0 \ltrch\fcs0 \i\insrsid12724088\charrsid16000762 }{ \rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid12724088\charrsid16000762 represented the respondent, submitted th}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid3474910 at the appellant was very well }{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid12724088\charrsid16000762 known to the victim and her mother who were his sister and mother respectively. The appellant lifted her and defiled her. Her mother heard her cry }{\rtlch\fcs1 \ab\af0 \ltrch\fcs0 \insrsid3474910\charrsid3474910 out:}{\rtlch\fcs1 \ab\af0 \ltrch\fcs0 \b\insrsid3474910 \'93}{\rtlch\fcs1 \ab\af0 \ltrch\fcs0 \b\insrsid12724088\charrsid16000762 Kyalimpa why are you killing me\'94. }{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid12724088\charrsid16000762 When she ran to the scene, she saw her own son defiling his sister.}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid3474910 He then got off and ran away. \par }\pard \ltrpar\s15\qj \li0\ri0\sb100\sa240\sbauto1\sl360\slmult1\widctlpar\wrapdefault\aspalpha\aspnum\faauto\adjustright\rin0\lin0\itap0\ipgp1\pararsid3474910 {\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid12724088\charrsid16000762 Both counsel appeared to be under the impress ion that the conditions of lighting at the time of the offence were not testified to by the prosecution witnesses. However, the victim stated that it was during daytime. She clearly described how the appellant was dr}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid3474910 essed and exactly what he did. }{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid12724088\charrsid16000762 Her mother was very positive in her identification of the appellant. She stated under cross-examination: - \line }{\rtlch\fcs1 \ab\af0 \ltrch\fcs0 \b\insrsid12724088\charrsid16000762 \'93He did it to her }{\rtlch\fcs1 \ab\af0 \ltrch\fcs0 \b\insrsid12724088\charrsid3474910 around }{\rtlch\fcs1 \af0 \ltrch\fcs0 \b\insrsid12724088\charrsid3474910 8}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid12724088\charrsid16000762 }{\rtlch\fcs1 \ab\af0 \ltrch\fcs0 \b\insrsid3474910 p.m. Identifying him was not }{\rtlch\fcs1 \ab\af0 \ltrch\fcs0 \b\insrsid12724088\charrsid16000762 a problem. I know him we}{\rtlch\fcs1 \ab\af0 \ltrch\fcs0 \b\insrsid3474910 ll. I even called him by name. }{\rtlch\fcs1 \ab\af0 \ltrch\fcs0 \b\insrsid12724088\charrsid16000762 I found him playing sex with her. He just jumped off and stood in a distance.\'94 }{\rtlch\fcs1 \ab\af0 \ltrch\fcs0 \b\insrsid3474910

\par }\pard \ltrpar\s15\qj \li0\ri0\sb100\sa240\sbauto1\sl360\slmult1\widctlpar\wrapdefault\aspalpha\aspnum\faauto\adjustright\rin0\lin0\itap0\ipgp1\pararsid16000762 {\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid12724088\charrsid16000762 The learned trial judge found both these witnesses credible and believed them. He also found that though PW2 was an invalid (a polio victim) she was not so mentally deranged as to fail to recognise her brothe}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid3474910 r and what he}{\rtlch\fcs1 \ai\af0 \ltrch\fcs0 \i\insrsid12724088\charrsid16000762 }{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid12724088\charrsid16000762 did to her. The appellant tried to plead alibi saying that he was not at home on the material day but under cross-examination, he admitted that on 26/12/98 he returned home early and spent the day at home which is near that of his mot}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid3474910 her. \par }{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid12724088\charrsid16000762 We have carefully scrutinised all the avai}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid3474910 lable evidence on record on the i}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid12724088\charrsid16000762 ssue of identification. We agree with the tr}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid3474910 ial judge that the offence was }{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid12724088\charrsid16000762 committed in such circumstances that identification of the appellant could not have presented any problems. Both PW2 and PW3 knew the appellant very well. He came into very close contact with both of them. They narrated their ordeal firmly and convincingl }{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid3474910 y to the trial judge and in }{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid12724088\charrsid16000762 contrast, the appellant tried to set up an alibi that could not ho ld. The trial judge was therefore right to hold that the appellant was positively identified}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid3474910 . This ground of appeal fails. \par }{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid12724088\charrsid16000762 The second ground of appeal was that the trial judge failed to consider is material contradictions in the prosecution case. The only}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid3474910 contradiction that }{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid12724088\charrsid16000762 Mr. Tayebwa was able to point out was that whereas the indictment alleged that the offence was committed on 26/12/98, the mother of the victim said it was on 20/12/98. However, Mr. Tayebwa appears to have abandoned this ground when it was pointed out to him that the }{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid3474910 mother of the victim stated in }{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid12724088\charrsid16000762 cross-examination that the offence took place around Christmas festivities. Mr. Tayebwa was unable to substantiate the second ground of }{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid3474910 appeal and it therefore fails. \par }{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid12724088\charrsid16000762 The third ground of appeal was that the trial judge erred to reject the }{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid3474910 appellant\rquote s alibi. I have already al}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid3474910\charrsid16000762 luded}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid12724088\charrsid16000762 to th}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid3474910 is defence which the appellant }{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid12724088\charrsid16000762 tried to put up and the circumstances in which the trial judge rejected it. Though the appellant half-heartedly tried to raise it, he admitted under cross}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid3474910 -}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid12724088\charrsid16000762 examination that on 26-12-98, at least most of that day, he had returned to his home and was certainly there at the material time of the defilement. The trial judge considered the defence but found it wanting and rejected it. In our view, he rightly rejected it as the appella}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid879121 nt failed to sustain it. We do }{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid12724088\charrsid16000762 not mean here that he failed to prove it. He had no duty to do so. However, he first tried to raise it and then abandoned it under cross-examination. It was therefore no longer a valid defence of ali}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid879121 bi. This ground too must fail. \par }{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid12724088\charrsid16000762 We have subjected the whole record of procee}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid879121 dings in this trial with a view}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid12724088\charrsid16000762 to arriving at our own conclusion. We are sa}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid879121 tisfied that the learned trial }{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid12724088\charrsid16000762 judge diligently handled the facts and the law properly and arrived at a correct conclusion. We see no reason to interfere or disturb his findings or conclusions. The appe}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid879121 llant was correctly convicted. \par }\pard \ltrpar\s15\qj \li0\ri0\sl360\slmult1\widctlpar\wrapdefault\aspalpha\aspnum\faauto\adjustright\rin0\lin0\itap0\ipgp1\pararsid12339312 {\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid12724088\charrsid16000762 Before we take leave of this case, we wish to comment on the sentence that was imposed on the appellant. In passing the sentence, the learned trial judge stated: }{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid12339312 - \par }\pard \ltrpar\s15\qj \li720\ri0\sl360\slmult1\widctlpar\wrapdefault\aspalpha\aspnum\faauto\adjustright\rin0\lin720\itap0\ipgp1\pararsid12339312 {\rtlch\fcs1 \ab\af0 \ltrch\fcs0 \b\insrsid12724088\charrsid16000762 For the terrible offence he committed, and the manner in which he committed the same, the best this court can do towards extending leniency to him is to reduce the sentence from death }{\rtlch\fcs1 \ab\af0 \ltrch\fcs0 \b\ul\insrsid12724088\charrsid16000762 to imprisonment of thirteen (13) }{\rtlch\fcs1 \ab\af0 \ltrch\fcs0 \b\ul\insrsid12339312\charrsid16000762 years}{\rtlch\fcs1 \ab\af0 \ltrch\fcs0 \b\ul\insrsid12339312 ,}{\rtlch\fcs1 \ab\af0 \ltrch\fcs0 \b\ul\insrsid12724088\charrsid16000762 the period spent on remand since 19/4/99 inclusive.\'94 }{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid12339312 [Emphasis supplied] \par }\pard \ltrpar\s15\qj \li0\ri0\sb100\sa240\sbauto1\sl360\slmult1\widctlpar\wrapdefault\aspalpha\aspnum\faauto\adjustright\rin0\lin0\itap0\ipgp1\pararsid16000762 {\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid12724088\charrsid16000762 We were unable to tell with certainty exactly what sentence the learned trial judge had imposed. Both learned counsel who appeared before us thought that it was 13 years imprisonment. It is also possible to construe the underlined words to mean that the period the appellant spent on remand is to be deducted }{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid12339312 from the sentence of 13 years. \par }\pard \ltrpar\s15\qj \li0\ri0\sl360\slmult1\widctlpar\wrapdefault\aspalpha\aspnum\faauto\adjustright\rin0\lin0\itap0\ipgp1\pararsid12339312 {\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid12724088\charrsid16000762 It has now become very frequent for trial courts to pass a sentence in vague 5 terms that it is not possible to tell exactly }{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid12339312 what sentence has been passed. \par }{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid12724088\charrsid16000762 Common forms are: }{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid12339312 - \par }{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid12724088\charrsid16000762 - You are sentenced to 10 years imprisonmen}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid12339312 t, period on remand inclusive. \par }{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid12724088\charrsid16000762 - }{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid12339312 Sentenced to 15 years }{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid12724088\charrsid16000762 Period on remand to}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid12339312 be taken into account. \par }{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid12724088\charrsid16000762 - You will serve 18 years in prison minus}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid12339312 period spent on remand e.t.c. \par }\pard \ltrpar\s15\qj \li0\ri0\sb100\sa240\sbauto1\sl360\slmult1\widctlpar\wrapdefault\aspalpha\aspnum\faauto\adjustright\rin0\lin0\itap0\ipgp1\pararsid16000762 {\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid12724088\charrsid16000762 In all these examples, it appears as if the trial court leaves the task of determining the exact sentence on someone else. It seems that this confusion occu}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid12339312 rs in an attempt to comply with }{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid12724088\charrsid16000762 Article 23(8) of the Constitution which states: }{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid12339312 - \par }\pard \ltrpar\s15\qj \li720\ri0\sb100\sa240\sbauto1\sl360\slmult1\widctlpar\wrapdefault\aspalpha\aspnum\faauto\adjustright\rin0\lin720\itap0\ipgp1\pararsid12339312 {\rtlch\fcs1 \ab\af0 \ltrch\fcs0 \b\insrsid12724088\charrsid16000762 \'93 Where a person is convicted and sentenced to a term of imprisonment for an offence any period he or she spends in lawful custody in respect of the offence before the c ompletion of his or her trial shall be taken into account in imposing the term of imprisonment.\'94 }{\rtlch\fcs1 \ab\af0 \ltrch\fcs0 \b\insrsid12339312 \par }\pard \ltrpar\s15\qj \li0\ri0\sb100\sa240\sbauto1\sl360\slmult1\widctlpar\wrapdefault\aspalpha\aspnum\faauto\adjustright\rin0\lin0\itap0\ipgp1\pararsid16000762 {\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid12724088\charrsid16000762 We have stated before, and we feel we must state so again, that this provision does not require a trial court to mathematically add or deduct the period spent on remand from the proposed sentence. It only requires the trial court to TAKE INTO ACCOUNT the per}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid12339312 iod lawfully spent in custody. }{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid12724088\charrsid16000762 The court is under duty to pass an }{\rtlch\fcs1 \af0 \ltrch\fcs0 \ul\insrsid12724088\charrsid16000762 ascertainable and final sentence }{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid12724088\charrsid16000762 after it has taken the remand period into account. }{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid12339312 \par }{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid12724088\charrsid16000762 It would be an abdication of its duty if it left the sentence to be worked out by the Criminal Registries or prison authorities}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid12339312 as seems to be happening now. \par }{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid12724088\charrsid16000762 In the instant case, after taking into account the period the appellant spent on remand, we direct that he will serve a sentence of 13 years imprisonment from the date he was}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid12339312 sentenced by the trial court. \par }{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid12724088\charrsid16000762 In the result, we find no merits in this appeal}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid12339312 which we dismiss accordingly. \par }{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid12724088\charrsid16000762 We also direct that a copy of this judgment be sent to the Hon. the Principal Judge for wide ci}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid12339312 rculation to the trial judges. \par }{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid12724088\charrsid16000762 Da}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid12339312 ted at Kampala this 8}{\rtlch\fcs1 \af0 \ltrch\fcs0 \super\insrsid12339312\charrsid12339312 th}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid12339312 day of May 2003. \par }\pard \ltrpar\s15\ql \li0\ri0\sb100\sa240\sbauto1\sl360\slmult1\widctlpar\wrapdefault\aspalpha\aspnum\faauto\adjustright\rin0\lin0\itap0\ipgp1\pararsid12339312 {\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid12724088\charrsid16000762 Hon.
