The applicant is facing a charge of rape as defined in s 65 of the Criminal Law (Codification and Reform) Act [Cap 9:23] and escaping from lawful custody as defined in s 185 (1) (a) of the Criminal Law (Codification and Reform) Act [Cap 9:23]. The applicant’s trial is imminent and I believe at the time of this judgment it has already commenced. On that ground alone I refuse to grant bail. Accordingly the application for bail is dismissed.
