JUDGMENT BY CONSENT McKee J [1] This action commenced following disagreement as to the disposal of the funds referred to in paragraph 3 of this judgment. I am advised that all disagreements have now been resolved between parties. [2] The three Applicants and the Respondent in this suit are the only heirs of the late Orpheline Valentin nee Anacoura [otherwise known as”Marie Valentin or Anacoura”], who is hereinafter referred to as “the deceased”, and who died intestate in Seychelles on 23rd January 2011. [3] At the date of her death the deceased had a sum of money standing at her credit in Savings Account Number 5156000111 with the Seychelles Commercial Bank, Praslin, Seychelles. [4] Following the resolution of their disagreement, the three Applicants and the Respondent hereby now agree and consent to the entering of a Judgment in full and final settlement of their respective claims to the funds at the credit of said Savings Account Number 5156000111 in accordance with the terms hereof. [5] The free proceeds at the credit of the Savings Account 5156000111 shall be distributed as follows: [6] A One Quarter (25%) share of the amount at the credit of the Savings Account Number 5156000111 shall be distributed equally between Lucille Valentin, Eveline Suzy Valentin, Letis Madeleine Barra nee Valentin and Therese Adrienne nee Valentin, namely, the three Applicants and the Respondent. [7] Each party will bear her own costs to these proceedings. [8] This judgment is authority to the Seychelles Commercial Bank, Praslin, Seychelles to close the Savings Account 5156000111 and to release the total funds at its credit into the hands of the Executor in the estate of the deceased for distribution amongst the heirs. [9] The parties to this suit hereby agree and consent that this Agreement shall be entered as a judgment of the Supreme Court in this suit.
