JUSTICE ANUP SINGH CHOUDRY}{ \b\insrsid5847951\charrsid12195928 \par \par }{\insrsid16192490\charrsid12195928 \par }{\insrsid11630786\charrsid12195928 \par }{\insrsid5847951\charrsid12195928 RULING \par }\pard \ql \li0\ri0\sl360\slmult1\widctlpar\aspalpha\aspnum\faauto\adjustright\rin0\lin0\itap0\pararsid12195928 {\insrsid16192490\charrsid12195928 \par }\pard \qj \li0\ri0\sl360\slmult1\widctlpar\aspalpha\aspnum\faauto\adjustright\rin0\lin0\itap0\pararsid12195928 {\insrsid16192490\charrsid12195928 This is a written Application dated 21}{\super\insrsid16192490\charrsid12195928 st}{ \insrsid16192490\charrsid12195928 January 2009 addressed to the Registrar that the Judge should disqualify himself from this case; the letter was brought to my attention this morning. \par \par The matter came before this court on 23}{\super\insrsid16192490\charrsid12195928 rd}{\insrsid16192490\charrsid12195928 January when it was fixed for scheduling on 29}{\super\insrsid16192490\charrsid12195928 th}{\insrsid16192490\charrsid12195928 January so that the case could be disposed off before March this year. \par \par On 23}{\super\insrsid16192490\charrsid12195928 rd}{\insrsid16192490\charrsid12195928 January Mr. Kavuma Terence counsel for the Defendant invited the Judge to disqualify himself as he felt that the Judge had made up his mind by having made certain observations and comments on the points of law raised during the Application for injunction that was granted on 27}{\super\insrsid16192490\charrsid12195928 th}{\insrsid16192490\charrsid12195928 October 2008 in favour of the Plaintiffs which is now subject of appeal in the Court of Appeal. \par The comments made by me w}{\insrsid15276551\charrsid12195928 ere simply}{\insrsid16192490\charrsid12195928 to assist the parties by drawing their attention to the fact that the fixed term agreement dated 1}{\super\insrsid16192490\charrsid12195928 st}{ \insrsid16192490\charrsid12195928 January 2005 could only be terminated under Clause 2 of the Agreement which referred to }{\insrsid15276551\charrsid12195928 obligation }{\insrsid16192490\charrsid12195928 in clause 5 and }{ \insrsid15276551\charrsid12195928 breaches thereof }{\insrsid16192490\charrsid12195928 gave rise to remedies under Clause 6 when the parties inter-alia could then terminate the agreement as per clause 6(c) by giving 14 days notice, I am sure the Defendants would have taken instructions f}{\insrsid15276551\charrsid12195928 rom their clients on this point, or advised them accordingly.}{\insrsid16192490\charrsid12195928 \par \par The Plaintiff\rquote s counsel opposed the Application on the 23}{\super\insrsid16192490\charrsid12195928 rd}{\insrsid5664562\charrsid12195928 January}{\insrsid16192490\charrsid12195928 and today }{\insrsid8794433\charrsid12195928 and suggested that the Judge should continue. The Counsel Mr. Siraj}{\insrsid15276551\charrsid12195928 Ali rightly submitted that the}{\insrsid8794433\charrsid12195928 r}{\insrsid15276551\charrsid12195928 e}{\insrsid8794433\charrsid12195928 was no conflict of interest or bias and that another Judge would only delay matters and i}{\insrsid15276551\charrsid12195928 t would cause }{\insrsid8794433\charrsid12195928 great prejudice to the Plaintiff who have already suffered loss and delay}{ \insrsid15276551\charrsid12195928 that}{\insrsid13500470\charrsid12195928 would}{\insrsid7820188\charrsid12195928 }{\insrsid8794433\charrsid12195928 exacerbate the damages.}{\insrsid16192490\charrsid12195928 \par }{\insrsid8794433\charrsid12195928 \par It is a situat}{\insrsid13500470\charrsid12195928 ion where both parties are not i}{\insrsid8794433\charrsid12195928 n agreement }{\insrsid16667066\charrsid12195928 jointly to move to another Judge. On 23}{\super\insrsid16667066\charrsid12195928 rd}{ \insrsid5664562\charrsid12195928 January}{\insrsid16667066\charrsid12195928 I refused to disqualify myself because to do so would have pleased the Defendants but not the Plaintiff and there were no grounds to disqualify myself. I therefore ordered that the scheduling should go ahead on 29}{ \super\insrsid16667066\charrsid12195928 th}{\insrsid5664562\charrsid12195928 January}{\insrsid16667066\charrsid12195928 .}{\insrsid8794433\charrsid12195928 \par }{\insrsid16667066\charrsid12195928 \par On 21}{\super\insrsid16667066\charrsid12195928 st}{\insrsid16667066\charrsid12195928 January 2009 the Defendant\rquote s lawyers had written to the Registrar at that time the letter had not come before me, the letter set out the grounds on which the Judge ought to disqualify himself. \par The Defendants very strongly feel uncomfortable and the court must ensure that justice is not done but must seem to be done when one of the parties expresses concern even if the concerns are unfounded. \par \par In this case there are no grounds to disqualify myself as a presiding Judge, but it is important that all the partie s should feel happy and in those circumstances, I have no problem in disqualifying myself from hearing this case; although undoubtedly it will cause some very considerable delay and prejudice to both parties.
