Ruling

1. This file was opened for purposes of considering whether the convict Lenox Marube is suitable for consideration of his sentence review in the spirit of prison decongestion pursuant to the Chief Justice Memo dated 7th December 2022.

2. The applicant was convicted for the offence being in possession of narcotic drugs contrary to section 3(1) as read with section 3(2)(a) if the Narcotic Drugs and Psychotropic Substances (Control) Act, No. 3 of 1994. He was sentenced to serve one-year imprisonment.

3. I have considered the record of the trial court. I note that the applicant was sentenced on 26th February 2025. In my view, the time spent in remand custody, the time served is sufficient sentence.

4. The applicant is released forthwith unless otherwise lawfully held. He is directed to report to Kibera Probation Office for reintegration.
