RULING

1. By consent, Motor Vehicle Reg. No. KAR 344C Toyota Station Wagon being held at Siaya Police Station in respect of Siaya HC Cr. Case No.  6 of 2020 be and is hereby released to the Applicant Mary Jocinter Atieno Oduor on the following conditions:

1) That the said motor vehicle shall be photographed on the outside and inside by scenes of crime personnel and photographs and films preserved for production in the said criminal case.

2) That the applicant shall ensure safe custody of the said motor vehicle and shall if required avail it to court for viewing as an exhibit in the said criminal case.

3) That the applicant shall not change any component of the said motor vehicle such as colour or engine or ownership without leave of this court.

4) That the custody of the said vehicle shall be in the applicant throughout until the criminal case mentioned herein is heard and determined.

2. The prayer for release of two mobile phones is declined.

3. File closed.

4. Orders accordingly.
