Ruling

1. The applicant was charged and convicted for the offence of defilement contrary to section 8(1) as read with 8(2) of the Sexual Offences, No. 3 of 2006. He was sentenced to serve fifteen (15) years imprisonment.

2. He filed the present application and an affidavit in support of his motion seeking sentence review. The arguments raised are that the trial court failed to consider the mitigating circumstances of the case during the sentencing.

3. I have considered the application, the grounds in support and the applicable law. From the record of the trial court, the court considered the applicant’s mitigation, the pre-sentence report and the fact that the applicant was a first offender before sentencing.

4. In my view I find no good cause or reason to revise the sentence imposed by the trial court. The application dismissed.Orders accordingly.
