ORDER ON REVISION

1. I have examined the Lower Court Record.  This convict MICHAEL GITONGA IRERI, was sentenced to a cumulative sentence of 2 years imprisonment on 09. 10. 2019 for handling stolen property contrary to section 322(1) & (2) of the Penal Code and possession of narcotic drugs contrary to Section 3(1) & (2)(a) of the Narcotic Drugs & Psychotropic Substances (Control) Act.

2.  In view of the current Coronavirus (COVID – 19) emergency, and in exercise of the powers of the court under Article 159(2) of the Constitution of Kenya and Section 362 and 364 of the Criminal Procedure, I hereby set aside the sentences imposed upon the convict and substitute therefor the time already served.

3.  The convict shall therefore be set at liberty forthwith unless otherwise lawfully held.  It is so ordered.
