1. Having gone through the Notice of Motion application dated June 23, 2023 and the supporting affidavit of the applicant of even date seeking an order that the Psychiatric Evaluation Report and the Probation report demonstrates the applicant has met the conditions for ensuring the safety and welfare of the person and of the public and that he be released from prison and set free, I accordingly issue the following orders:1. That the matter is notcertified urgent.2. That the Deputy Registrar (DR) to avail case file No HCCHR/E323/2020, Harrison Mugo Moses v Attorney General (AG) & Director of Public Prosecutions (DPP) on July 21, 2023. 3.That the application and order of this court be served upon the respondent within three (3) days from the date hereof.4. That upon service, the respondent to file a response on or before August 10, 2023. 5.That this matter shall be mentioned before Hon Justice Kimondo on September 20, 2023 for allocation and or directions.
