1. Whereas the Applicant Kennedy Onyango Muga has moved this court seeking order of a retrial for purposes of re-sentencing, he has not annexed the proceedings in Maseno Cr. Case No. 1082 of 2005, High Court Cr. Appeal No. 117 of 2006 and Kisumu Court of Appeal Cr. A No. 273 of 2008 wherefore this application is fatally and incurably defective.

2. I thus strike it out with no orders as to costs.
