1. The Applicant was charged with the offence of;Malicious damage to property Contrary to Section 339 (1) of the Penal Code.The particulars are that;On the 4th September 2023 at Bahati area in Nakuru North sub county within Nakuru County wilfully and unlawfully damaged from left car window registration no KCV 533T MAKE Honda CRV White in colour valued at Kshs. 5000 by damaging it, the property of Eunice Wanjiru Ndungu.

2. I have perused the Sentence Review Report on the Applicant. It is recommended that he completes his sentence as he is undergoing counselling sessions, which are of benefit to him.

3. Having considered the report, I am inclined to agree with the Probation Officer that accused completes his sentence, subject to any remission period available to him.
