That if the execution takes}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid1867596\charrsid10703581 place and the appeal succeeds }{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid7237049\charrsid10703581 the appeal would be rendered useless. The application is not intended to delay the process of the court but the applicant believes he would }{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid1867596\charrsid10703581 succeed}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid7237049\charrsid10703581 . It was also contended that since the decretal sum attracts interest }{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid1867596\charrsid10703581 from the date of judgment till }{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid7237049\charrsid10703581 payment postponement of payment is not disadvantageous to the decree holder}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid1867596\charrsid10703581 .}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid7237049\charrsid10703581 He would be }{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid1867596\charrsid10703581 compensated by interest. \par }{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid7237049\charrsid10703581 However the affidavit and submission by M}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid8476047\charrsid10703581 r. Lutakome counsel appearing fo}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid7237049\charrsid10703581 r the respondent/plaintiff did show that that the application i}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid8476047\charrsid10703581 s}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid7237049\charrsid10703581 not maintainable under order }{\rtlch\fcs1 \ai\af0 \ltrch\fcs0 \insrsid7237049\charrsid10703581 19}{\rtlch\fcs1 \ai\af0 \ltrch\fcs0 \i\insrsid7237049\charrsid10703581 }{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid8476047\charrsid10703581 R}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid7237049\charrsid10703581 ule 26 on which the application is based. It is irrelevant. It talks of where a suit is pending against a decree holder. There is no suit pending against a }{ \rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid8476047\charrsid10703581 decree}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid7237049\charrsid10703581 holder in the suit that was Nangunga extra. The meaning of the rule has been extensively considered by this court}{ \rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid8476047\charrsid10703581 . The}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid7237049\charrsid10703581 civil procedure rules do not lay down }{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid8476047\charrsid10703581 what}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid7237049\charrsid10703581 }{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid8476047\charrsid10703581 should be done when a party }{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid7237049\charrsid10703581 wants to appeal }{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid8476047\charrsid10703581 to the Supreme Court pending a d}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid7237049\charrsid10703581 ecree here in the High Court. The application should have been brought by way of notice of motion not by a chamber }{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid8476047\charrsid10703581 summons and in the open court. \par }{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid7237049\charrsid10703581 That the interpretation of rule 2 of rules of the Supreme Court is just general interpretation and the notice of appeal lodged in the Supreme Court did not amount to a suit. }{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid8476047\charrsid10703581 Many notic}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid7237049\charrsid10703581 es of appeal have been thrown out when made out of time on that technical point/procedure the app}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid10703581 lication should be struck out. }{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid7237049\charrsid10703581 On the merits of the application the learned counsel maintained that there is no good merit for this }{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid8476047\charrsid10703581 court}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid7237049\charrsid10703581 to warrant stay of execution. The counsel for the applicant/defendant submitted there had been a delay in the appeal but it could be observed that the } {\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid8476047\charrsid10703581 court}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid7237049\charrsid10703581 made the decree on 16.8.94 a}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid8476047\charrsid10703581 nd up to the present time no } {\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid7237049\charrsid10703581 appeal had been filed in the Supreme Court. The affidavit in support of the application does not sh}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid8476047\charrsid10703581 ow why the applicant had not }{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid7237049\charrsid10703581 filed the appeal in the }{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid8476047\charrsid10703581 Supreme Court while the decree }{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid7237049\charrsid10703581 was extracted long ago. It was submitted that the application was intended to delay the course of justice and }{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid8476047\charrsid10703581 to deprive the successful party/decree holder of the money. As to whether the appeal had }{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid7237049\charrsid10703581 reasonable chance to success. It was submitted that there was none because the decree was based on th} {\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid10703581 e evidence adduced which was a }{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid7237049\charrsid10703581 simple contract of sale of goods which was well processed by the }{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid8476047\charrsid10703581 respondent}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid7237049\charrsid10703581 . The applicant failed to challenge the strong}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid8476047\charrsid10703581 evidence}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid7237049\charrsid10703581 adduced by failure to }{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid8476047\charrsid10703581 summon}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid7237049\charrsid10703581 their key witnesses. By rule }{\rtlch\fcs1 \ai\af0 \ltrch\fcs0 \insrsid593303\charrsid10703581 3(}{\rtlch\fcs1 \ai\af0 \ltrch\fcs0 \insrsid7237049\charrsid10703581 2)}{\rtlch\fcs1 \ai\af0 \ltrch\fcs0 \i\insrsid7237049\charrsid10703581 }{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid7237049\charrsid10703581 of th}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid10703581 e }{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid593303\charrsid10703581 appellate jurisdiction Acts. \par }{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid7237049\charrsid10703581 In the instant case there was no memorandum of appeal pending in the Supreme Court. The application was therefore misconceived since it was based on a misconception of a pending appeal. In Muntunu}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid593303\charrsid10703581 \rquote }{ \rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid7237049\charrsid10703581 s case supra it was argued that there was a provisional memorandum of appeal but in the instant case there was }{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid12811127\charrsid10703581 none. In fact on that authority }{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid7237049\charrsid10703581 alone the application would have been disposed of. In }{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid12811127\charrsid10703581 fact}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid7237049\charrsid10703581 this would dispose of the first ground }{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid12811127\charrsid10703581 for this application. \par As regards the rest}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid7237049\charrsid10703581 of the grounds of appeal, I will deal with them }{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid12811127\charrsid10703581 specifically. This, court heard}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid7237049\charrsid10703581 the parties and pr}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid12811127\charrsid10703581 onounced its judgment in favour}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid7237049\charrsid10703581 of the respondent. I do not have to review the Evidence adduced since I am of the view that that is a matter for the Supreme Court but the gist of the judg ment is that the parties entered into a contract for the sale of goods commodities which were supplied and the applicant refused to pay the agreed amount. With that background I am of the opinion that the appeal is not bonafide and there are slim chances o}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid12811127\charrsid10703581 f}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid7237049\charrsid10703581 its success. This would dispose of grounds 2 and 3. Perhaps I would add here that a stay of the judgment being appealed from would not prejudice the applicant and the same would not render the appeal being nugatory. I do not see how execution would destroy the substratum of}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid12811127\charrsid10703581 the appeal and cause the appell}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid7237049\charrsid10703581 a}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid12811127\charrsid10703581 n}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid7237049\charrsid10703581 t irreparable damage. The respondent had the means to refund the decretal sum in case the appeal which is not pending in the Supreme Court }{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid12811127\charrsid10703581 succeeded. \par }{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid7237049\charrsid10703581 In the end I see no miscarriage of justice that would be }{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid12811127\charrsid10703581 occasioned}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid7237049\charrsid10703581 to the applicant. Also no substantial loss would be }{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid12811127\charrsid10703581 occasioned}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid7237049\charrsid10703581 from a refusal to grant the stay of execution and the dictates of justice do not demand so. This reasoning disposes of}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid12811127\charrsid10703581 grounds 4 of the application. \par }{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid7237049\charrsid10703581 As to the fifth ground }{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid12811127\charrsid10703581 that the application is not}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid7237049\charrsid10703581 intended to delay the court process. I was not addressed sufficiently on this ground. However what is apparent was that the judgment in this case was delivered as far back as 16th August, 1987. The learned counsel explained that he has not got the }{ \rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid12811127\charrsid10703581 proceedings so }{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid7237049\charrsid10703581 as to file in the necessary papers and there are some of his}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid12811127\charrsid10703581 correspondences}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid7237049\charrsid10703581 on the record. I think he succeeds on this ground. }{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid12811127\charrsid10703581 \par }{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid7237049\charrsid10703581 As regards the sixth ground that the decret}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid10703581\charrsid10703581 al amount was }{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid12811127\charrsid10703581 interest earning,}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid7237049\charrsid10703581 I do not agree with Mr. Byaruhanga that because the decretal sum carries interest that is a ground of stay of }{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid12811127\charrsid10703581 execution}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid7237049\charrsid10703581 because of the reasons I have }{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid12811127\charrsid10703581 endeavored}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid7237049\charrsid10703581 to explain above.
