Ruling

1. Despite encouragement by the court on various occasions as per the record, the beneficiaries of the Estate herein have failed to agree on the mode of sharing the Estate. On 4/6/2025 the court undertook to give further directions on the matter which are as hereunder.

2. Contrary to the 1st Administrator’s advocate’s concern that no amended Grant of Letters of Administration has been issued following revocation of the original Grant in the court’s ruling of 18th October 2023, an amended Grant dated 18th October 2023 is in fact on file.

3. In the said ruling of 18th October 2023, the court made orders on distribution of the estate save two properties to wit; Parcel No. Baringo/Sabatia/103/39 and L.R. No. 943 (Kabarak Farm). It was ordered that valuaton of these two properties be conducted for further directions of the court thereon.

4. It appears that each of the houses of the deceased commissioned a Valuer to undertake the task and the Valuation Reports have been put in. The court will proceed to peruse the reports and give orders as to transmission of the two remaining properties, if all the necessary mareial has been placed before the court.

5. Upon full distribution of the Estate a Certificate of Confirmation of Grant will be issued in accordance with the court’s decision.
