He }{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid15010115\charrsid16592309 appealed to this C}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid3168632\charrsid16592309 ourt against both the conviction and sentence. \par \par The following are the brief facts of the case as accepted by the trial court. \par \par The appellant is an army sergeant attached to Angoko army guard Unit. He went back to Ongako which was also his village. The appellant }{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid5001702\charrsid16592309 placed the gun }{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid15149585\charrsid16592309 near}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid5001702\charrsid16592309 her head and raped her. Following a report she made, the appellant was arrested and the victim was medically examined after 3 days. }{ \rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid15010115\charrsid16592309 Being formally a married }{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid5001702\charrsid16592309 woman }{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid15010115\charrsid16592309 who had}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid5001702\charrsid16592309 recently produced}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid15010115\charrsid16592309 ,}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid5001702\charrsid16592309 no noticeable injuries were seen by }{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid2363912\charrsid16592309 the doctor}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid5001702\charrsid16592309 who examined her. \par }{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid15149585\charrsid16592309 \par In his defence the appellant }{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid15010115\charrsid16592309 stated that}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid5001702\charrsid16592309 while he went to infor m his mother that he had accidentally shot Olanya, he did not go away with the victim who}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid15010115\charrsid16592309 m}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid5001702\charrsid16592309 he left standing near the hedge of the compound.}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid15149585\charrsid16592309 The trial judge rejected his defence and }{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid5001702\charrsid16592309 found him guilty as charged and sentenced him to 15years, hence this appeal. He submitted that for the learned }{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid2363912\charrsid16592309 trial judge}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid5186912\charrsid16592309 to have relied on the medical report and the only word of the complainant was a serious error and it occasioned miscarriage of justice. Appeal N0. 241/2003.}{\rtlch\fcs1 \af0 \ltrch\fcs0 \b\ul\insrsid5904570\charrsid16592309 \par }{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid13442016\charrsid16592309 \par We have heard the submissions of both counsel and appraised the evidence as we are required as a first appellate court. \par \par We are also satisfied like the trial judge did that the complainant was telling the truth}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid12596460\charrsid16592309 and that}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid13442016\charrsid16592309 the appellant on gun point raped her. \par \par We are equally satisfied }{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid12596460\charrsid16592309 with the}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid13442016\charrsid16592309 evidence on record that the victim reported to her mother in law immediately after sh e was raped but her mother in law with held this information by telling lies to save her only son. \par }{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid12596460\charrsid16592309 \par We can}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid2499887\charrsid16592309 not}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid12596460\charrsid16592309 fault the trial judge when he found corroboration of the victim\rquote }{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid2499887\charrsid16592309 s testimony and that }{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid12596460\charrsid16592309 penetration }{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid2499887\charrsid16592309 was }{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid12596460\charrsid16592309 proved. Grounds 1 and 2 would therefore fail. \par \par On sentence }{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid2499887\charrsid16592309 o}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid12596460\charrsid16592309 ur Constitution states that the power belongs to the people}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid2499887\charrsid16592309 of Uganda}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid12596460\charrsid16592309 . We are persuaded by the prayer of the Assistant DPP that on our}{ \rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid13698385\charrsid16592309 own }{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid2499887\charrsid16592309 motion }{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid12596460\charrsid16592309 and section }{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid2499887\charrsid16592309 11 of the judicat}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid6970833\charrsid16592309 ure Act and section 132 of the T}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid2363912\charrsid16592309 r}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid6970833\charrsid16592309 ial on I}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid2499887\charrsid16592309 ndictment Act}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid6970833\charrsid16592309 , we}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid2499887\charrsid16592309 should }{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid2363912\charrsid16592309 enhance}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid2499887\charrsid16592309 the }{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid2363912\charrsid16592309 sentence.}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid6970833\charrsid16592309 In the circumstances of this case, a sentence of 15 years was very much on the lower side.}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid13698385\charrsid16592309 \par }{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid2363912\charrsid16592309 \par }{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid13698385\charrsid16592309 We find no merit in the reply counsel for the appellant gave. He infact did not dissuade us from doing so. \par \par In the result the appeal against both conviction and sentence is dismissed. We enhance the sentence from 15 years}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid6448794\charrsid16592309 to}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid13698385\charrsid16592309 25 years.
