He also sought}{\insrsid14039850\charrsid14974417 for the nullification of a judgment of the }{\insrsid12651745\charrsid14974417 Village }{\insrsid14039850\charrsid14974417 Local Council (}{\insrsid12651745\charrsid14974417 LCI)}{ \insrsid14039850\charrsid14974417 Court of Rubaga Parish on }{\insrsid4870960\charrsid14974417 which the}{\insrsid14039850\charrsid14974417 eviction order was based.}{\insrsid5391961\charrsid14974417 The application was supported by the }{ \insrsid12651745\charrsid14974417 applicant\rquote s }{\insrsid5391961\charrsid14974417 affidavit sworn on the 16/09/2006. The respondent filed three affidavits in reply}{\insrsid12651745\charrsid14974417 : the first deposed}{ \insrsid5391961\charrsid14974417 by her on the }{\insrsid12341129\charrsid14974417 7/09/06, another }{\insrsid12651745\charrsid14974417 deposed}{\insrsid12341129\charrsid14974417 by Aggrey Wagubi}{\insrsid4870960\charrsid14974417 ,}{ \insrsid12341129\charrsid14974417 }{\insrsid4870960\charrsid14974417 Assistant Administrator General }{\insrsid12341129\charrsid14974417 on the 7/09/06, and }{\insrsid12651745\charrsid14974417 lastly an affidavit }{\insrsid14358431\charrsid14974417 deposed}{\insrsid12341129\charrsid14974417 by Owere Wilson, Vice }{\insrsid4870960\charrsid14974417 Chairperson}{\insrsid12341129\charrsid14974417 of Kamuli }{\insrsid4870960\charrsid14974417 Road }{\insrsid12341129\charrsid14974417 LC1 in Rubaga }{ \insrsid4870960\charrsid14974417 Parish on }{\insrsid12651745\charrsid14974417 7/09/06}{\insrsid12341129\charrsid14974417 . }{\insrsid7501779\charrsid14974417 \par }{\insrsid9129938\charrsid14974417 \par The grounds of the application were that the LCI Kamuli }{\insrsid4870960\charrsid14974417 Road }{\insrsid9129938\charrsid14974417 acted with material irregularity when they purported to hear an unregistered case with no clear claim or description of the case on a public holiday}{\insrsid12651745\charrsid14974417 (i.e. 09/10/05, Independence Day)}{\insrsid9129938\charrsid14974417 . }{\insrsid12651745\charrsid14974417 Further t}{\insrsid9129938\charrsid14974417 hat the court passed the judgment on the same day in the absence of the applicant and as a result he was not informed of his right to appeal. Further grounds were that }{ \insrsid6508789\charrsid14974417 t}{\insrsid9129938\charrsid14974417 he Chief Magistrate acted illegally or with material irregularity when she issued a warrant to evict the applicant and put the respondent in possession of the property. }{ \insrsid5391961\charrsid14974417 \par }{\insrsid16133839\charrsid14974417 \par }{\insrsid5391961\charrsid14974417 The facts on which the application was based can be summarised as follows. }{\insrsid12341129\charrsid14974417 In his affidavit in support of the application t}{\insrsid5391961\charrsid14974417 he applicant }{ \insrsid12341129\charrsid14974417 inferred that he }{\insrsid5391961\charrsid14974417 was the occupant of the land in issue}{\insrsid12341129\charrsid14974417 till the 18/08/2006 when he found three of the grass-thatched houses }{ \insrsid12651745\charrsid14974417 there}{\insrsid12341129\charrsid14974417 on the land had been demolished by a court broker.}{\insrsid5391961\charrsid14974417 }{\insrsid12341129\charrsid14974417 The applicant claimed that he was not aware of any suit that could have resulted into an order for eviction except a claim }{\insrsid6508789\charrsid14974417 that the}{\insrsid12341129\charrsid14974417 respondent had lodged a gainst him with the Human Rights Commission}{\insrsid6508789\charrsid14974417 ,}{\insrsid12341129\charrsid14974417 but which had not been concluded. The applicant later discovered that the structures had been demolished by one Oundo Robert by a warrant of eviction issued by the Chief Magistrate at Jinja in Misc. }{\insrsid12135764\charrsid14974417 Application}{ \insrsid12341129\charrsid14974417 No. 40 of 2006 arising out of a judgement declared by the LC1 Court of Kamuli Road, Rubaga Parish. The applicant further }{\insrsid12135764\charrsid14974417 deposed}{\insrsid12341129\charrsid14974417 that he recalled that on the 9/10/2006 the same LC court summoned him and he reported at the appointed place. That the LC cour t asked him questions about the land that he occupied but he was not notified that the respondent had filed a claim against him in respect of the land. \par }{\insrsid12135764\charrsid14974417 \par The applicant further averred that he was not informed that judgment had been delivered in favour of the }{\insrsid6508789\charrsid14974417 respondent}{\insrsid12135764\charrsid14974417 . Neither was he informed that he had the right to appeal against the judgment. Further that at the alleged hearing he had not been given an opportunity to call witnesses or to produce documentary evidence to prove }{\insrsid12283529\charrsid14974417 how he acquired the land in disp}{\insrsid12135764\charrsid14974417 ute}{\insrsid12283529\charrsid14974417 .}{\insrsid12135764\charrsid14974417 \par }{\insrsid12283529\charrsid14974417 \par In her affidavit in reply the respondent averred that the suit land belonged to her husband the late Ssosipateli }{\insrsid10230654\charrsid14974417 Sajjabi to}{\insrsid8222199\charrsid14974417 whom she was legally married until his death on 1/07/2005. } {\insrsid10230654\charrsid14974417 That}{\insrsid8222199\charrsid14974417 the property was acquired joi}{\insrsid10230654\charrsid14974417 ntly by the deceased and }{\insrsid12651745\charrsid14974417 her}{\insrsid10230654\charrsid14974417 }{ \insrsid6508789\charrsid14974417 after }{\insrsid10230654\charrsid14974417 they got married in 1969}{\insrsid12651745\charrsid14974417 and it }{\insrsid6508789\charrsid14974417 therefore }{\insrsid10230654\charrsid14974417 formed part of the deceased}{ \insrsid6508789\charrsid14974417 \rquote s}{\insrsid10230654\charrsid14974417 estate. The respondent further averred that after the death of S}{\insrsid9129938\charrsid14974417 s}{\insrsid10230654\charrsid14974417 osipateli Sajjabi the applicant forcefully prevented her from occupying and cultivating the suit land.}{\insrsid12283529\charrsid14974417 }{\insrsid10230654\charrsid14974417 That as a result the applicant }{\insrsid12651745\charrsid14974417 was }{ \insrsid10230654\charrsid14974417 facing criminal charges in the Magistrates Court at Jinja for trespass, threatening violence and intermeddling in the deceased}{\insrsid6508789\charrsid14974417 \rquote s}{\insrsid10230654\charrsid14974417 estate. Further that the }{\insrsid9129938\charrsid14974417 Administrator}{\insrsid10230654\charrsid14974417 General was the Administrator of the estate of the late Ssosipat eli Sajjabi. Aggrey Wagubi, one of the Administrators General confirmed this in his affidavit. He averred that on 27/03/}{\insrsid6508789\charrsid14974417 2005 }{\insrsid10230654\charrsid14974417 the }{\insrsid10556647\charrsid14974417 Administrator General}{\insrsid10230654\charrsid14974417 obtained letters of }{\insrsid9129938\charrsid14974417 administration}{\insrsid10230654\charrsid14974417 in the estate. That at a meeting held on the 15/07/2007 he establishe d that the respondent was the widow of the deceased}{\insrsid1064147\charrsid14974417 . That he instructed the applicant to vacate the land but the applicant refused to do so. As a result the A. G instructed the police to press charges against the applicant for intermeddling. Subsequently the applicant was charged in Jinja }{ \insrsid10556647\charrsid14974417 Criminal}{\insrsid1064147\charrsid14974417 Case}{\insrsid10556647\charrsid14974417 No.}{\insrsid1064147\charrsid14974417 187 0f 2007.}{\insrsid12283529\charrsid14974417 \par }{\insrsid1064147\charrsid14974417 \par In a further affidavit in reply Owere Wilson the Vice Chairman of the LC of the area in which the disputed land}{\insrsid6508789\charrsid14974417 is situated}{\insrsid1064147\charrsid14974417 averred that he was one of the members of the LC who gave judgment against the applicant in a suit that was lodged by the respondent. He further averred that the LC court in his village usually sits on Sunday. That before the 9/10/2007 the applicant was summoned to the LC court on two occasions but he did not respond to the summons. That he finally responded on 9/10/2005 when the court disposed of the matter in favour of the respondent}{\insrsid13220\charrsid14974417 after hearing both parties.}{\insrsid14371029\charrsid14974417 That though the }{ \insrsid9129938\charrsid14974417 applicant}{\insrsid14371029\charrsid14974417 was ordered to vacate the suit within 14 days after the judgment}{\insrsid9129938\charrsid14974417 }{\insrsid14371029\charrsid14974417 he refused to do so}{ \insrsid9129938\charrsid14974417 . As a result he referred the matter to the LCII }{\insrsid10556647\charrsid14974417 Court}{\insrsid9129938\charrsid14974417 }{\insrsid10556647\charrsid14974417 for further action}{\insrsid9129938\charrsid14974417 .}{ \insrsid14371029\charrsid14974417 }{\insrsid9129938\charrsid14974417 There }{\insrsid10556647\charrsid14974417 was }{\insrsid9129938\charrsid14974417 no evidence to show that the LCII court dealt with the matter. It would appear that is why the respondent filed an application in the Chief Magistrate\rquote s court for execution of the orders of the LCI court.}{\insrsid1064147\charrsid14974417 \par }{\insrsid9129938\charrsid14974417 \par }{\insrsid16133839\charrsid14974417 At the hearing of the application Ms Mildred Nassiwa}{\insrsid10556647\charrsid14974417 for the applicant}{\insrsid16133839\charrsid14974417 submitted that the LC I court had no jurisdiction in land matters because s.30 of the Land (Amendment) Act (2004) introduced a new section, s. 76A int o the Land Act. By virtue of s.76A the Parish or Ward Executive Committees were established as the courts of first instance for land matters. It was further }{\insrsid408375\charrsid14974417 contended}{\insrsid16133839\charrsid14974417 for the applicant that the eviction order that resulted from these proceedings was null and void and had no legal effect}{\insrsid408375\charrsid14974417 . Further that prosecution of the applicant for criminal trespass was also based on the order of the Chief Magistrate and was therefore improper. Counsel for the applicant also challenged the respondent\rquote s reliance on the gra nt of letters of administration to the Administrator General for the reason that the grant was made in 2007 after this application was filed in 2006. She contended that the grant was obtained to sabotage the application for revision of the Chief Magistrat e\rquote s order.}{\insrsid15934383\charrsid14974417 }{\insrsid408375\charrsid14974417 She prayed that the application be allowed.}{\insrsid16133839\charrsid14974417 \par }{\insrsid473629\charrsid14974417 \par In reply, Ms. Juliet Musoke for the respondent }{\insrsid15934383\charrsid14974417 opposed the application. She }{\insrsid7672151\charrsid14974417 submitted that the Administrator General had powers over the property in dispute since letters of administration were granted to him. That the application before court was of no consequence because it sought to obtain orders for ownership of the property yet the property is part of an estate under the trusteeship of the }{\insrsid15934383\charrsid14974417 Administrator}{ \insrsid7672151\charrsid14974417 General. }{\insrsid11405256\charrsid14974417 Further that}{\insrsid7672151\charrsid14974417 if court }{\insrsid10556647\charrsid14974417 made }{\insrsid7672151\charrsid14974417 any orders}{ \insrsid10556647\charrsid14974417 in favour of the applicant}{\insrsid7672151\charrsid14974417 in respect of the property }{\insrsid15934383\charrsid14974417 such}{\insrsid7672151\charrsid14974417 orders }{\insrsid10556647\charrsid14974417 would }{ \insrsid7672151\charrsid14974417 challeng}{\insrsid3541327\charrsid14974417 e}{\insrsid7672151\charrsid14974417 the }{\insrsid6903225\charrsid14974417 powers or authority}{\insrsid7672151\charrsid14974417 of the Administrator General}{ \insrsid15934383\charrsid14974417 over the estate. With regard to the legality of hearing the suit in the LC court on a public holiday, Ms. Musoke submitted that the}{\insrsid3541327\charrsid14974417 re}{\insrsid15934383\charrsid14974417 is no law th}{ \insrsid3541327\charrsid14974417 at}{\insrsid15934383\charrsid14974417 prohibits an LC court from disposing of matters on a public holiday}{\insrsid3541327\charrsid14974417 .}{\insrsid473629\charrsid14974417 \par }{\insrsid3541327\charrsid14974417 \par }\pard \qj \li0\ri0\sl360\slmult1\widctlpar\faauto\rin0\lin0\itap0\pararsid14974417 {\insrsid3541327\charrsid14974417 In }{\insrsid15093377\charrsid14974417 this}{\insrsid3541327\charrsid14974417 application }{\insrsid15093377\charrsid14974417 this court }{\insrsid3541327\charrsid14974417 has}{\insrsid15093377\charrsid14974417 been called on}{\insrsid3541327\charrsid14974417 to determine whether the Magistrate\rquote s court }{\insrsid15093377\charrsid14974417 failed to exercise a jurisdiction vested in it and whether the court acted in the exercise of its jurisdiction illegally or with material illegality or injustice. Having determined those two questions the }{\insrsid2582688\charrsid14974417 court may make such order in it as it thinks (s. 83 Civil Procedure Act).}{\insrsid10556647\charrsid14974417 }{\insrsid3541327\charrsid14974417 The questions that arise from the above facts and submissions are basically four}{ \insrsid15746859\charrsid14974417 and I shall dispose of them in the order that they are stated}{\insrsid10556647\charrsid14974417 below}{\insrsid15746859\charrsid14974417 .}{\insrsid3541327\charrsid14974417 \par }\pard \qj \li0\ri0\sl360\slmult1\widctlpar\aspalpha\aspnum\faauto\adjustright\rin0\lin0\itap0\pararsid14974417 {\insrsid2582688\charrsid14974417 \par {\listtext\pard\plain\lang2057\langfe1033\dbch\af0\langnp2057\insrsid812892\charrsid14974417 \hich\af0\dbch\af0\loch\f0 (i)\tab}}\pard \qj \fi-72\li720\ri0\sl360\slmult1\widctlpar \jclisttab\tx720\aspalpha\aspnum\faauto\ls1\adjustright\rin0\lin720\itap0\pararsid14974417 {\insrsid812892\charrsid14974417 Did }{\insrsid2582688\charrsid14974417 the absence of a serial number of the case}{\insrsid812892\charrsid14974417 from the record of }{\insrsid2582688\charrsid14974417 the LC Court }{\insrsid812892\charrsid14974417 render the proceedings illegal}{\insrsid2582688\charrsid14974417 ? \par {\listtext\pard\plain\lang2057\langfe1033\dbch\af0\langnp2057\insrsid2582688\charrsid14974417 \hich\af0\dbch\af0\loch\f0 (ii)\tab}Could the LCI court lawfully hear and dispose of a case on a public holiday? \par {\listtext\pard\plain\lang2057\langfe1033\dbch\af0\langnp2057\insrsid2582688\charrsid14974417 \hich\af0\dbch\af0\loch\f0 (iii)\tab}Did the LCI court have the jurisdiction to entertain the case before it? \par {\listtext\pard\plain\lang2057\langfe1033\dbch\af0\langnp2057\insrsid2582688\charrsid14974417 \hich\af0\dbch\af0\loch\f0 (iv)\tab}}\pard \qj \fi-72\li720\ri0\sl360\slmult1\widctlpar\jclisttab\tx720\faauto\ls1\rin0\lin720\itap0\pararsid14974417 { \insrsid2582688\charrsid14974417 Did the Chief Magistrate fail to exercise her jurisdiction in }{\insrsid2754187\charrsid14974417 the }{\insrsid2582688\charrsid14974417 matter or did she act in the exercise of her jurisdiction illegally or wi th material irregularity or injustice? \par }\pard \ql \li0\ri0\sl360\slmult1\widctlpar\faauto\rin0\lin0\itap0\pararsid14974417 {\insrsid2582688\charrsid14974417 \par }\pard \qj \li0\ri0\sl360\slmult1\widctlpar\aspalpha\aspnum\faauto\adjustright\rin0\lin0\itap0\pararsid14974417 {\insrsid15746859\charrsid14974417 Regarding the first question,}{\insrsid8274800\charrsid14974417 s. 17 (1) of the Executive}{ \insrsid16086794\charrsid14974417 Committees (Judicial Powers) Act }{\insrsid3945431\charrsid14974417 (Repealed) }{\insrsid16086794\charrsid14974417 provided that}{\insrsid2711504\charrsid14974417 }{\insrsid6508789\charrsid14974417 in }{ \insrsid16086794\charrsid14974417 every case the court shall keep a record of its proceedings in}{\insrsid2711504\charrsid14974417 }{\insrsid16086794\charrsid14974417 writing, and every such rec}{\insrsid2711504\charrsid14974417 ord shall contain }{ \insrsid16086794\charrsid14974417 particulars }{\insrsid2711504\charrsid14974417 including the serial number of the case, the statement of claim and a brief description of the case, among other things. In the instant case counsel for the applicant complained that the record of proceedings from the LC court did no t show that the case had been given a serial number and that put together with the fact that the case was heard on a public holiday made the proceedings illegal. }{\insrsid2754187\charrsid14974417 \par \par }{\insrsid2711504\charrsid14974417 With regard to the serial number}{\insrsid3945431\charrsid14974417 of the case}{\insrsid9527929\charrsid14974417 ,}{\insrsid11804759\charrsid14974417 }{\insrsid3945431\charrsid14974417 s.17 (}{ \insrsid11804759\charrsid14974417 2) of the Executive Committees (Judicial Powers) Act provide}{\insrsid9527929\charrsid14974417 d}{\insrsid11804759\charrsid14974417 that subject to the Act, the court would hear the case before it expeditiously and without undue regard to technical rules of evidence or procedure. The Act thus reproduced the provision in Article 126 (2) (e)}{\insrsid9527929\charrsid14974417 of the Constitution of the Republic of Uganda}{\insrsid11804759\charrsid14974417 that substantive justice shall be dispensed without undue regard to technicalities. I am therefore unable to agree with counsel for the applicant that the mere fact that the record bore no serial number rendered the proceedings a nullity. \par \par }{\insrsid812892\charrsid14974417 Turning to the }{\insrsid6508789\charrsid14974417 question }{\insrsid812892\charrsid14974417 of hearing the case on a public holiday, it is true that the 9/10/2005 was Independence Day in Uganda and }{ \insrsid14686045\charrsid14974417 is }{\insrsid812892\charrsid14974417 a}{\insrsid6768969\charrsid14974417 }{\insrsid812892\charrsid14974417 gazetted public holiday. The Vice Chairman of the LC confirmed that the case was heard and disposed of on that d ay. He explained that the day was not only a public holiday but also a Sunday. Further that the court was in the habit of sitting on Sundays because that }{\insrsid6508789\charrsid14974417 was }{\insrsid812892\charrsid14974417 when most of the members were able to spare time for their LC duties since they were also employed elsewhere.}{\insrsid6496539\charrsid14974417 Although Counsel for the applicant complained about the LC not observing the public holiday she did not cite any law that prohibits public institutions or public officers from executing their duties on public holidays. I have not found any}{ \insrsid6508789\charrsid14974417 either}{\insrsid6496539\charrsid14974417 . }{\insrsid5785885\charrsid14974417 \par \par }{\insrsid6496539\charrsid14974417 On the contrary the Public Holidays Act which provides a schedule of public holidays to be observed in Uganda }{\insrsid6508789\charrsid14974417 also }{\insrsid6496539\charrsid14974417 provides for remuneration of persons, both in the private and public }{\insrsid6508789\charrsid14974417 service }{\insrsid6496539\charrsid14974417 who may have to work on a public holiday}{\insrsid6508789\charrsid14974417 (s. 3)}{ \insrsid6496539\charrsid14974417 . }{\insrsid6508789\charrsid14974417 S.4 of the Act provides that }{\insrsid6496539\charrsid14974417 Government is bound by }{\insrsid6508789\charrsid14974417 the }{\insrsid6496539\charrsid14974417 provisions of s.3 of the Act, i.e. it h}{\insrsid12091350\charrsid14974417 as to pay its employees who}{\insrsid6496539\charrsid14974417 sometimes have to work on public holidays. By implication working on a public holiday is not illegal if the employee is paid for it. The fact that the court sat on Independence Day did not therefore invalidate the proceedings of the court. It was in fact}{\insrsid5785885\charrsid14974417 done}{\insrsid6496539\charrsid14974417 in compliance with the Executive Committees (Judicial Powers) Act which also provided that matters brought before }{\insrsid3945431\charrsid14974417 LC Courts }{\insrsid5785885\charrsid14974417 had to}{\insrsid6496539\charrsid14974417 be dis posed of expeditiously. If a public holiday presented itself as one on which }{\insrsid3945431\charrsid14974417 the }{\insrsid6496539\charrsid14974417 court could }{\insrsid5785885\charrsid14974417 expeditiously }{\insrsid6496539\charrsid14974417 dispose of the case, it was its duty to do so.}{\insrsid812892\charrsid14974417 \par \par }{\insrsid12091350\charrsid14974417 The applicant\rquote s further complaint was that the court did not give him the opportunity to call witnesses to prove his case and that this also rendered the proceedings ir}{\insrsid11159782\charrsid14974417 regular. I carefully perused the translation of the record of proceedings in the }{\insrsid8929927\charrsid14974417 LC}{\insrsid5785885\charrsid14974417 I }{\insrsid8929927\charrsid14974417 C}{\insrsid11159782\charrsid14974417 ourt, Annexure }{ \insrsid8929927\charrsid14974417 \'93C2\'94}{\insrsid11159782\charrsid14974417 to the affidavit in support.}{\insrsid12091350\charrsid14974417 }{\insrsid11159782\charrsid14974417 There }{\insrsid12091350\charrsid14974417 is no indication that the applicant informed the court that he needed to call witnesses to prove his case. The court could not be faulted for }{\insrsid5785885\charrsid14974417 that}{\insrsid12091350\charrsid14974417 . \par \par }\pard \qj \li0\ri0\sl360\slmult1\widctlpar\faauto\rin0\lin0\itap0\pararsid14974417 {\insrsid12091350\charrsid14974417 The applicant also complained that judgment was delivered in}{\insrsid11159782\charrsid14974417 his absence and that as a resu}{ \insrsid12091350\charrsid14974417 lt, the court did not notify him of his right of appeal. The record }{\insrsid3945431\charrsid14974417 showed }{\insrsid12091350\charrsid14974417 that the applicant attended court }{\insrsid5785885\charrsid14974417 on that day }{\insrsid12091350\charrsid14974417 and even testified. There is therefore no doubt that judgment was delivered in his presence. However, the record does not show that he was informed that he had a right to appeal against the decision of the court. S.19 of the Executive Committees (Judicial Powers) Act specifically provided that after the delivery of its judgment the LC Court had to inform the parties of their right to appeal. }{\insrsid11233492\charrsid14974417 S. 17 (2) }{ \insrsid5785885\charrsid14974417 provided }{\insrsid11233492\charrsid14974417 that }{\dbch\af36\insrsid11233492\charrsid14974417 \hich\af0\dbch\af36\loch\f0 in exercising its jurisdiction, the\hich\af0\dbch\af36\loch\f0 court }{ \dbch\af36\insrsid3945431\charrsid14974417 \hich\af0\dbch\af36\loch\f0 would\hich\af0\dbch\af36\loch\f0 }{\dbch\af36\insrsid11233492\charrsid14974417 \hich\af0\dbch\af36\loch\f0 be guided by the principle of impartiality, i.e. it shall adjudicate without fear or favour}{\dbch\af36\insrsid3945431\charrsid14974417 \hich\af0\dbch\af36\loch\f0 . Court also had to}{\dbch\af36\insrsid11233492\charrsid14974417 \hich\af0\dbch\af36\loch\f0 adhere to the rules of natural justice. Where a right of appeal has been provided for, it is a principle of natural justice that par\hich\af0\dbch\af36\loch\f0 ties be accorded }{\dbch\af36\insrsid2754187\charrsid14974417 \hich\af0\dbch\af36\loch\f0 th\hich\af0\dbch\af36\loch\f0 e\hich\af0\dbch\af36\loch\f0 }{\dbch\af36\insrsid11233492\charrsid14974417 \hich\af0\dbch\af36\loch\f0 right. }{\insrsid12091350\charrsid14974417 Failure to notify a party of the right }{ \insrsid11233492\charrsid14974417 is}{\insrsid12091350\charrsid14974417 fatal to}{\insrsid5785885\charrsid14974417 the}{\insrsid12091350\charrsid14974417 proceedings.}{\dbch\af36\insrsid812892\charrsid14974417 \par }\pard \qj \li0\ri0\sl360\slmult1\widctlpar\aspalpha\aspnum\faauto\adjustright\rin0\lin0\itap0\pararsid14974417 {\insrsid812892\charrsid14974417 \par }{\insrsid11159782\charrsid14974417 As to whether the court had the jurisdiction to entertain a land matter, there was some contention as to whether the case before the LC}{\insrsid7613781\charrsid14974417 I}{\insrsid11159782\charrsid14974417 court was a customary land matter or not. There was no evidence as to how the }{\insrsid3499483\charrsid14974417 respondent\rquote s}{\insrsid11159782\charrsid14974417 husband came to be in possession of the land. Counsel for the applicant submitted that the land was held under customary law while counsel for the respondent contended that it was held under }{\insrsid3499483\charrsid14974417 leasehold}{ \insrsid11159782\charrsid14974417 . The evidence on record could not help this court to determine that matter. However, since there was no certificate of any kind adduced in evidence at the hearing before LC court, it will be assumed that the land was held under customary tenure}{ \insrsid3945431\charrsid14974417 .}{\insrsid11159782\charrsid14974417 }{\insrsid3499483\charrsid14974417 \par \par }{\insrsid11159782\charrsid14974417 Schedule }{\insrsid3499483\charrsid14974417 1 Part 2}{\insrsid11159782\charrsid14974417 }{\insrsid3499483\charrsid14974417 of}{\insrsid11159782\charrsid14974417 the Executive Committees (Judicial Powers) Act }{ \insrsid3499483\charrsid14974417 provided that LC courts could try matters relating to trespass. Schedule 2 provided that the court could hear cases in respect of land held under customary tenure. However, s. 30 of the Land (Amendment) Act removed this jurisdiction from the court when it introduced s. 76A, vesting the }{\insrsid11227729\charrsid14974417 jurisdiction}{\insrsid3499483\charrsid14974417 in land matters at first instance in the Parish or Ward Courts. }{ \insrsid11227729\charrsid14974417 The Land Amendment Act, 2004 came into force on the 18/03/2004. }{\insrsid3499483\charrsid14974417 There is therefore no doubt that }{\insrsid3945431\charrsid14974417 when it sat on 9/10/05 }{ \insrsid3499483\charrsid14974417 the LC1 Court of}{\insrsid11227729\charrsid14974417 Kamuli Road, Rubaga Parish had no jurisdiction to entertain the case. The judgement that resulted from the proceedings was therefore }{\insrsid3945431\charrsid14974417 null and void}{\insrsid11227729\charrsid14974417 for want of jurisdiction.}{\insrsid11159782\charrsid14974417 \par }{\insrsid11227729\charrsid14974417 \par I finally come to the question whether the }{\insrsid812892\charrsid14974417 Chief Magistrate fail}{\insrsid11227729\charrsid14974417 ed}{\insrsid812892\charrsid14974417 to exercise her jurisdiction in this matter }{\insrsid11227729\charrsid14974417 and whether she}{\insrsid812892\charrsid14974417 act}{\insrsid11227729\charrsid14974417 ed}{\insrsid812892\charrsid14974417 in the exercise of her jurisdiction illegally or with material irregularity or inju}{\insrsid11227729\charrsid14974417 stice. The judgment being challenged was delivered on 9/10/2005. The Chief Magistrate gave her order of eviction on }{\insrsid11601991\charrsid14974417 18}{\insrsid11227729\charrsid14974417 /}{\insrsid11601991\charrsid14974417 0}{ \insrsid17825\charrsid14974417 8}{\insrsid11227729\charrsid14974417 /2006 in an application that had been filed on }{\insrsid17825\charrsid14974417 28/07}{\insrsid11227729\charrsid14974417 /2006. By the time of filing the application and granting the order for eviction the Local Council Court}{\insrsid7613781\charrsid14974417 s}{\insrsid11227729\charrsid14974417 Act, of 2006 }{\insrsid4613004\charrsid14974417 had}{ \insrsid11227729\charrsid14974417 come into force}{\insrsid7613781\charrsid14974417 }{\insrsid11227729\charrsid14974417 on the 8/08/06. \par }\pard \qj \li0\ri0\sl360\slmult1\widctlpar\faauto\rin0\lin0\itap0\pararsid14974417 {\dbch\af36\insrsid16536977\charrsid14974417 \par }\pard \qj \li720\ri720\sl360\slmult1\widctlpar\faauto\rin720\lin720\itap0\pararsid14974417 {\dbch\af36\insrsid5186874\charrsid14974417 \loch\af0\dbch\af36\hich\f0 \'93}{\dbch\af36\insrsid16536977\charrsid14974417 \hich\af0\dbch\af36\loch\f0 Without prejudice to the generality of subsection (1), a chief magistrate may call for and examine the record of any proceedings before a magi\hich\af0\dbch\af36\loch\f0 strate\hich\f0 \rquote \loch\f0 s court inferior to the court which he or she is empowered to hold and situate within the local limits of his or her jurisdiction for the purpose of satisfying himself or herself as to the correctness, legality or propriety of any finding, sentence \hich\af0\dbch\af36\loch\f0 ,\hich\af0\dbch\af36\loch\f0 decision, judgment or order recorded or passed, and as to the regularity of any proceedings of that magistrate\hich\f0 \rquote \loch\f0 s court.}{\dbch\af36\insrsid5186874\charrsid14974417 \loch\af0\dbch\af36\hich\f0 \'94}{\dbch\af36\insrsid16536977\charrsid14974417 \par }\pard \qj \li0\ri0\sl360\slmult1\widctlpar\faauto\rin0\lin0\itap0\pararsid14974417 {\dbch\af36\insrsid16536977\charrsid14974417 \par \hich\af0\dbch\af36\loch\f0 I believe this provision }{\dbch\af36\insrsid5186874\charrsid14974417 \hich\af0\dbch\af36\loch\f0 may be properly imported to amplify }{\dbch\af36\insrsid16536977\charrsid14974417 \hich\af0\dbch\af36\loch\f0 the Chief Magistrates supervisory powers over LC courts. Where a dispute\hich\af0\dbch\af36\loch\f0 comes before }{\dbch\af36\insrsid5186874\charrsid14974417 \hich\af0\dbch\af36\loch\f0 him/}{\dbch\af36\insrsid16536977\charrsid14974417 \hich\af0\dbch\af36\loch\f0 her in which}{\dbch\af36\insrsid5186874\charrsid14974417 \hich\af0\dbch\af36\loch\f0 it}{\dbch\af36\insrsid16536977\charrsid14974417 \hich\af0\dbch\af36\loch\f0 appears that the process of the court is being abused, the }{ \dbch\af36\insrsid7613781\charrsid14974417 \hich\af0\dbch\af36\loch\f0 Chief }{\dbch\af36\insrsid16536977\charrsid14974417 \hich\af0\dbch\af36\loch\f0 Magistrate has }{\dbch\af36\insrsid7613781\charrsid14974417 \hich\af0\dbch\af36\loch\f0 a legal duty }{ \dbch\af36\insrsid16536977\charrsid14974417 \hich\af0\dbch\af36\loch\f0 to ensure that the abuse is stopped.}{\dbch\af36\insrsid5186874\charrsid14974417 \hich\af0\dbch\af36\loch\f0 Where illegal orders have been made he/she may nullify them }{ \dbch\af36\insrsid11601991\charrsid14974417 \hich\af0\dbch\af36\loch\f0 and/or}{\dbch\af36\insrsid5186874\charrsid14974417 \hich\af0\dbch\af36\loch\f0 make alternative orders.}{\dbch\af36\insrsid16536977\charrsid14974417 \hich\af0\dbch\af36\loch\f0 \hich\af0\dbch\af36\loch\f0 In this case the court had exercised a jurisdiction that was not vested in it or which had been removed from it. The}{\dbch\af36\insrsid5186874\charrsid14974417 \hich\af0\dbch\af36\loch\f0 file was now before the Chief Magistrate. She had the }{\dbch\af36\insrsid11601991\charrsid14974417 \hich\af0\dbch\af36\loch\f0 duty}{\dbch\af36\insrsid5186874\charrsid14974417 \hich\af0\dbch\af36\loch\f0 as the supervisor of }{ \dbch\af36\insrsid3945431\charrsid14974417 \hich\af0\dbch\af36\loch\f0 the LC\hich\af0\dbch\af36\loch\f0 Court\hich\af0\dbch\af36\loch\f0 s}{\dbch\af36\insrsid5186874\charrsid14974417 \hich\af0\dbch\af36\loch\f0 to inquire into the instances named in s.221}{\dbch\af36\insrsid4268710\charrsid14974417 \hich\af0\dbch\af36\loch\f0 }{\dbch\af36\insrsid5186874\charrsid14974417 \hich\af0\dbch\af36\loch\f0 (2}{\dbch\af36\insrsid4268710\charrsid14974417 \hich\af0\dbch\af36\loch\f0 )}{\dbch\af36\insrsid5186874\charrsid14974417 \hich\af0\dbch\af36\loch\f0 of the MCA. I therefore find that the learned Chief}{\dbch\af36\insrsid16536977\charrsid14974417 \hich\af0\dbch\af36\loch\f0 Magistrate exercised her jurisdiction illegally or with material irregularity when she entertained the application for an eviction order.}{\dbch\af36\insrsid9597491\charrsid14974417 \hich\af0\dbch\af36\loch\f0 The order of eviction was thus illegal.}{ \dbch\af36\insrsid16536977\charrsid14974417 \par }{\dbch\af36\insrsid9597491\charrsid14974417 \par \hich\af0\dbch\af36\loch\f0 The applicant prayed \hich\af0\dbch\af36\loch\f0 that this court should under its revisional powers declare the eviction order null and void and order that the applicant be put back in possession of the land in dispute. It has }{\dbch\af36\insrsid13449417\charrsid14974417 \hich\af0\dbch\af36\loch\f0 during these proceedings }{\dbch\af36\insrsid9597491\charrsid14974417 \hich\af0\dbch\af36\loch\f0 transpired that the land which is the subject of the \hich\af0\dbch\af36\loch\f0 dispute is now under the authority of the Administrator General as the Public Trustee. Mr. Wagubi, Ass}{\dbch\af36\insrsid11304881\charrsid14974417 \hich\af0\dbch\af36\loch\f0 istan}{\dbch\af36\insrsid9597491\charrsid14974417 \hich\af0\dbch\af36\loch\f0 t Admin}{\dbch\af36\insrsid11304881\charrsid14974417 \hich\af0\dbch\af36\loch\f0 istrator}{\dbch\af36\insrsid9597491\charrsid14974417 \hich\af0\dbch\af36\loch\f0 General}{\dbch\af36\insrsid13449417\charrsid14974417 \hich\af0\dbch\af36\loch\f0 ,}{ \dbch\af36\insrsid9597491\charrsid14974417 \hich\af0\dbch\af36\loch\f0 swore an affidavit in which he stated that he established in a family meeting that the respondent }{\dbch\af36\insrsid13449417\charrsid14974417 \hich\af0\dbch\af36\loch\f0 was \hich\af0\dbch\af36\loch\f0 }{\dbch\af36\insrsid9597491\charrsid14974417 \hich\af0\dbch\af36\loch\f0 indeed the widow of th\hich\af0\dbch\af36\loch\f0 e deceased. }{\dbch\af36\insrsid10906909\charrsid14974417 \hich\af0\dbch\af36\loch\f0 Following s}{ \dbch\af36\insrsid13044689\charrsid14974417 \hich\af0\dbch\af36\loch\f0 .\hich\af0\dbch\af36\loch\f0 }{\dbch\af36\insrsid10906909\charrsid14974417 \hich\af0\dbch\af36\loch\f0 26 of }{\dbch\af36\insrsid4268710\charrsid14974417 \hich\af0\dbch\af36\loch\f0 the Succession Act}{\dbch\af36\insrsid10906909\charrsid14974417 \hich\af0\dbch\af36\loch\f0 , }{\dbch\af36\insrsid9597491\charrsid14974417 \hich\af0\dbch\af36\loch\f0 Schedule 2 thereof }{\dbch\af36\insrsid4268710\charrsid14974417 \hich\af0\dbch\af36\loch\f0 sets out }{\dbch\af36\insrsid10906909\charrsid14974417 \hich\af0\dbch\af36\loch\f0 the }{\dbch\af36\insrsid4268710\charrsid14974417 \hich\af0\dbch\af36\loch\f0 rules }{\dbch\af36\insrsid9597491\charrsid14974417 \hich\af0\dbch\af36\loch\f0 relating to the occupation of residential holdings}{\dbch\af36\insrsid11304881\charrsid14974417 \hich\af0\dbch\af36\loch\f0 of deceased persons}{\dbch\af36\insrsid9597491\charrsid14974417 \hich\af0\dbch\af36\loch\f0 .}{ \dbch\af36\insrsid11304881\charrsid14974417 \hich\af0\dbch\af36\loch\f0 Rule 1 (1) thereof provides:}{\dbch\af36\insrsid9597491\charrsid14974417 \par }{\dbch\af36\insrsid11304881\charrsid14974417 \par }\pard \qj \li720\ri720\sl360\slmult1\widctlpar\aspalpha\aspnum\faauto\adjustright\rin720\lin720\itap0\pararsid14974417 {\dbch\af36\insrsid11304881\charrsid14974417 \loch\af0\dbch\af36\hich\f0 \'93}{\dbch\af36\insrsid9597491\charrsid14974417 \hich\af0\dbch\af36\loch\f0 In the case of a residential holding occupied by the intestate p\hich\af0\dbch\af36\loch\f0 rior}{\dbch\af36\insrsid11304881\charrsid14974417 \hich\af0\dbch\af36\loch\f0 }{\dbch\af36\insrsid9597491\charrsid14974417 \hich\af0\dbch\af36\loch\f0 to his or her death as his or}{\dbch\af36\insrsid11304881\charrsid14974417 \hich\af0\dbch\af36\loch\f0 }{\dbch\af36\insrsid9597491\charrsid14974417 \hich\af0\dbch\af36\loch\f0 her principal residence, any wife or husband, as}{ \dbch\af36\insrsid11304881\charrsid14974417 \hich\af0\dbch\af36\loch\f0 }{\dbch\af36\insrsid9597491\charrsid14974417 \hich\af0\dbch\af36\loch\f0 the case may be, and any children, under eighteen years of age if male, or}{ \dbch\af36\insrsid11304881\charrsid14974417 \hich\af0\dbch\af36\loch\f0 under }{\dbch\af36\insrsid9597491\charrsid14974417 \hich\af0\dbch\af36\loch\f0 twenty-one years of age and unmarried if female, who were normally}{ \dbch\af36\insrsid11304881\charrsid14974417 \hich\af0\dbch\af36\loch\f0 resident in }{\dbch\af36\insrsid9597491\charrsid14974417 \hich\af0\dbch\af36\loch\f0 \li0\ri0\sl360\slmult1\widctlpar\faauto\rin0\lin0\itap0\pararsid14974417 {\dbch\af36\insrsid11304881\charrsid14974417 \hich\af0\dbch\af36\loch\f0 Under rule 2 of }{\dbch\af36\insrsid17825\charrsid14974417 \hich\af0\dbch\af36\loch\f0 the same }{ \dbch\af36\insrsid11304881\charrsid14974417 \hich\af0\dbch\af36\loch\f0 Schedule it is provided that a}{\dbch\af36\insrsid9597491\charrsid14974417 \hich\af0\dbch\af36\loch\f0 ny wife, husband or child who normally cultivated, farmed or tilled any}{ \dbch\af36\insrsid11304881\charrsid14974417 \hich\af0\dbch\af36\loch\f0 land}{\dbch\af36\insrsid9597491\charrsid14974417 \hich\af0\dbch\af36\loch\f0 adjoining a residential holding owned by an intestate prior to his or her}{ \dbch\af36\insrsid802118\charrsid14974417 \hich\af0\dbch\af36\loch\f0 deat\hich\af0\dbch\af36\loch\f0 h }{\dbch\af36\insrsid9597491\charrsid14974417 \hich\af0\dbch\af36\loch\f0 shall have the right to cultivate, farm and till the land as long as he or}{ \dbch\af36\insrsid11304881\charrsid14974417 \hich\af0\dbch\af36\loch\f0 }{\dbch\af36\insrsid9597491\charrsid14974417 \hich\af0\dbch\af36\loch\f0 she continues to be resident.}{\dbch\af36\insrsid802118\charrsid14974417 \hich\af0\dbch\af36\loch\f0 Unless other }{\dbch\af36\insrsid17825\charrsid14974417 \hich\af0\dbch\af36\loch\f0 evidence is adduced}{\dbch\af36\insrsid802118\charrsid14974417 \hich\af0\dbch\af36\loch\f0 to rebut the fact that the respondent was the widow of the deceased and resident with him on the disputed land}{\dbch\af36\insrsid17825\charrsid14974417 \hich\af0\dbch\af36\loch\f0 befor\hich\af0\dbch\af36\loch\f0 e his death}{ \dbch\af36\insrsid802118\charrsid14974417 \hich\af0\dbch\af36\loch\f0 , she appears to have}{\dbch\af36\insrsid13449417\charrsid14974417 \hich\af0\dbch\af36\loch\f0 had}{\dbch\af36\insrsid802118\charrsid14974417 \hich\af0\dbch\af36\loch\f0 the right to remain in the residential holding by law.}{\dbch\af36\insrsid9597491\charrsid14974417 \par }\pard \ql \li0\ri0\sl360\slmult1\widctlpar\faauto\rin0\lin0\itap0\pararsid14974417 {\dbch\af36\insrsid9597491\charrsid14974417 \par }\pard \qj \li0\ri0\sl360\slmult1\widctlpar\faauto\rin0\lin0\itap0\pararsid14974417 {\dbch\af36\insrsid9597491\charrsid14974417 \hich\af0\dbch\af36\loch\f0 The applicant }{\dbch\af36\insrsid17825\charrsid14974417 \hich\af0\dbch\af36\loch\f0 also}{ \dbch\af36\insrsid3239361\charrsid14974417 \hich\af0\dbch\af36\loch\f0 purported to }{\dbch\af36\insrsid9597491\charrsid14974417 \hich\af0\dbch\af36\loch\f0 challenge the }{\dbch\af36\insrsid3239361\charrsid14974417 \hich\af0\dbch\af36\loch\f0 Administrator}{\dbch\af36\insrsid9597491\charrsid14974417 \hich\af0\dbch\af36\loch\f0 General\hich\f0 \rquote \loch\f0 s powers in this estate}{\dbch\af36\insrsid3239361\charrsid14974417 \hich\af0\dbch\af36\loch\f0 in this application}{ \dbch\af36\insrsid8600729\charrsid14974417 \hich\af0\dbch\af36\loch\f0 . In paragraph 4 of his affidavit in rejoinder he st\hich\af0\dbch\af36\loch\f0 ated that the letters of administration were obtained after the application for revision was heard. He contended that the grant was obtained to sabotage this application. I am unable to agree with this assertion. }{ \dbch\af36\insrsid9842013\charrsid14974417 \hich\af0\dbch\af36\loch\f0 It is immaterial that the grant was made a\hich\af0\dbch\af36\loch\f0 fter the application was filed. }{\dbch\af36\insrsid10965320\charrsid14974417 \hich\af0\dbch\af36\loch\f0 S. 4(1) of the Administrator General Act provides that when a person dies in Uganda, the agent}{\lang1033\langfe1033\dbch\af36\langnp1033\insrsid13449417\charrsid14974417 \hich\af0\dbch\af36\loch\f0 of }{ \lang1033\langfe1033\dbch\af36\langnp1033\insrsid6556384\charrsid14974417 \hich\af0\dbch\af36\loch\f0 the Administrator General}{\dbch\af36\insrsid10965320\charrsid14974417 \hich\af0\dbch\af36\loch\f0 of the area in which the death occurs shall, upon receiving notice of the death or upon the death co\hich\af0\dbch\af36\loch\f0 ming to his or her knowledge institute inquiries to ascertain whether the deceased left any, and if so what, property in Uganda}{\dbch\af36\insrsid10575128\charrsid14974417 \hich\af0\dbch\af36\loch\f0 . He }{\dbch\af36\insrsid10965320\charrsid14974417 \hich\af0\dbch\af36\loch\f0 shall}{\dbch\af36\insrsid10575128\charrsid14974417 \hich\af0\dbch\af36\loch\f0 then}{\dbch\af36\insrsid10965320\charrsid14974417 \hich\af0\dbch\af36\loch\f0 report the death with full particulars as to property, as far as ascertainable, to the Administrator General. S. \hich\af0\dbch\af36\loch\f0 4(3) (d) and (e) go on to provide that upon receiving such report or upon such death coming to his or her knowledge, if it appears to the Administrator General that probate or letters of administration have not been obtained within two months from the dea \hich\af0\dbch\af36\loch\f0 t\hich\af0\dbch\af36\loch\f0 h of the testator; or that the person died intestate, the Administrator General may apply to the court for letters of administration of the estate of the deceased person, whereupon the court shall, except for good cause shown, make a grant to him or her o \hich\af0\dbch\af36\loch\f0 f\hich\af0\dbch\af36\loch\f0 letters of administration. The fact that the applicant had filed this application could not pre}{\dbch\af36\insrsid17825\charrsid14974417 \hich\af0\dbch\af36\loch\f0 vent}{ \dbch\af36\insrsid10965320\charrsid14974417 \hich\af0\dbch\af36\loch\f0 the Administrator General from applying for letters of administration in }{\dbch\af36\insrsid10575128\charrsid14974417 \hich\af0\dbch\af36\loch\f0 the estate of the deceased}{ \dbch\af36\insrsid10965320\charrsid14974417 \hich\af0\dbch\af36\loch\f0 . \par \par \hich\af0\dbch\af36\loch\f0 The applicant }{\dbch\af36\insrsid9597491\charrsid14974417 \hich\af0\dbch\af36\loch\f0 proposed}{\dbch\af36\insrsid17825\charrsid14974417 \hich\af0\dbch\af36\loch\f0 that he would}{\dbch\af36\insrsid9597491\charrsid14974417 \hich\af0\dbch\af36\loch\f0 have }{\dbch\af36\insrsid10965320\charrsid14974417 \hich\af0\dbch\af36\loch\f0 the grant }{\dbch\af36\insrsid17825\charrsid14974417 \hich\af0\dbch\af36\loch\f0 m\hich\af0\dbch\af36\loch\f0 ade }{ \dbch\af36\insrsid10965320\charrsid14974417 \hich\af0\dbch\af36\loch\f0 to the Administrator General}{\dbch\af36\insrsid9597491\charrsid14974417 \hich\af0\dbch\af36\loch\f0 revoked. He is free to do so if he has better rights}{ \dbch\af36\insrsid17825\charrsid14974417 \hich\af0\dbch\af36\loch\f0 to administration or probate}{\dbch\af36\insrsid9597491\charrsid14974417 \hich\af0\dbch\af36\loch\f0 than }{\dbch\af36\insrsid10965320\charrsid14974417 \hich\af0\dbch\af36\loch\f0 the Administrator General. He}{\dbch\af36\insrsid9597491\charrsid14974417 \hich\af0\dbch\af36\loch\f0 is also }{\dbch\af36\insrsid10965320\charrsid14974417 \hich\af0\dbch\af36\loch\f0 at liberty }{\dbch\af36\insrsid9597491\charrsid14974417 \hich\af0\dbch\af36\loch\f0 to challenge the applicant}{\dbch\af36\insrsid10965320\charrsid14974417 \loch\af0\dbch\af36\hich\f0 \rquote }{\dbch\af36\insrsid9597491\charrsid14974417 \hich\af0\dbch\af36\loch\f0 s occupation of the}{ \dbch\af36\insrsid10965320\charrsid14974417 \hich\af0\dbch\af36\loch\f0 suit}{\dbch\af36\insrsid9597491\charrsid14974417 \hich\af0\dbch\af36\loch\f0 property}{\dbch\af36\insrsid17825\charrsid14974417 \hich\af0\dbch\af36\loch\f0 in a court of competent ju\hich\af0\dbch\af36\loch\f0 risdiction. What ought to be noted is that widows and widowers are the only persons entitled to apply for letters of administration without }{\dbch\af36\insrsid10578014\charrsid14974417 \hich\af0\dbch\af36\loch\f0 first consulting the Administrator General (}{\dbch\af36\insrsid13449417\charrsid14974417 \hich\af0\dbch\af36\loch\f0 s.}{\dbch\af36\insrsid10578014\charrsid14974417 \hich\af0\dbch\af36\loch\f0 5 (1) Administrator General Act).
