Ruling

1. The Applicant was convicted on his own plea of guilty for the offence of house breaking contrary to Section 304 (1) (b) of the Penal Code and Stealing contrary to Section 279 (b) of the Penal Code. The trial court sentenced him to serve six (6) months imprisonment. The Applicant has served two (2) months of his sentence and is remaining with one (1) month, after remission, to complete the sentence. The Sentence Review Report filed on 9th April 2025 by the Probation Officer, Mr. Nelson Maroa, recommends a non-custodial sentence. I hereby direct that the Applicant shall serve a Community Service Order at Ikonge Assistant Chief’s Office, for one (1) month, under the supervision of the Probation Officer Nyamira and the Assistant Chief.Orders accordingly.
