Ruling

1. The applicant was sentenced to serve twelve (12) years and seven (7) months imprisonment as per the judgement of Bwononga J dated 13/10/2022, with effect from 17/11/2016. He has so far served only six (6) years. He is therefore not eligible for release.

2. File to be released to the lower court for safe custody.

3. Prisons officers are availing the wrong files for decongestion, which is contributing to backlog, instead of reducing of the same.

Orders accordingly.
