Ruling

1. The Applicant was charged and convicted on his plea of guilty of the offence of assault causing actual bodily harm contrary to Section 251 of thePenal CodeCap 63 (Laws of Kenya). He was arrested on 17/5/2021 and arraigned in court on 18/5/2021 when he was sentenced to two (2) years imprisonment. His early release by prison is 25/9/2022. The Report by Jackline Mwei Probation/Community Service Officer that was filed on 1/8/2022 recommends that the Applicant serves the remainder of the two (2) months of the sentence under Community Service Order at Mogweko Assistant Chief’s Office. Bearing in mind the date of his arrest and date of sentencing in line with Section 333(2) of theCriminal Procedure CodeCap 75(Laws of Kenya), it is hereby directed that the Applicant serves the Community Service Order as recommended in the said Report but until 17/9/2022. Orders accordingly.
