IN THE MATTER OF THE ESTATE OF FRANCIS GICHAMBA MAINA alias F.G. MAINA, FRANCIS MAINA OR FRANCIS MAINA MUGOIYO (DECEASED)

RULING

The confirmation application is dated 28/10/2012. The deceased was survived by children and grandchildren. I am satisfied that the proposed distribution largely conforms with Sections 38, 41and 71 of the Law of Succession Act. I allow the application and confirm the grant made on 26/10/2011. The estate shall devolve as proposed in paragraph 5 of the joint affidavit of Nyawira Wangechi Maina and Wangai Muhiu Maina sworn on 25/10/2012, save that the word “JOINTLY” wherever it appears shall be replaced with “EQUALLY”.

Costs will be in the cause.
