The defence called no witnesses.}{\insrsid4740084\charrsid9593785 \par }{\insrsid8460170\charrsid9593785 \tab \tab The first issue: whether the plaintiff\rquote s suit is time barred, was pleaded in the written statement of defence, and was submitted upon by counsel for the plaintiff as well as the one for the defendant}{ \insrsid15752886\charrsid9593785 .}{\insrsid8460170\charrsid9593785 \par }{\insrsid15752886\charrsid9593785 \tab \tab The evidence of plaintiff is that he was interdicted from his work }{\insrsid2172407\charrsid9593785 by }{\insrsid15752886\charrsid9593785 the defendant on 2}{\super\insrsid15752886\charrsid9593785 nd}{ \insrsid15752886\charrsid9593785 August, 1983, while he was just returning from his leave of sixty (60) days. 1}{\super\insrsid15752886\charrsid9593785 st}{\insrsid15752886\charrsid9593785 June 1983 \endash 31}{\super\insrsid15752886\charrsid9593785 st}{\insrsid15752886\charrsid9593785 July 1983. \par \tab \tab While on leave, the defendant alleges, the Town Treasurer discovered that the plaintiff had misappropriated council funds by banking less amount on the defendant\rquote s UCB accounts. \par \tab \tab The Town Treasurer reported the matter to Gulu Central Police station, to investigate and prosecute the culprits. \par \tab \tab The plaintiff was interdicted pending police investigations and decision as to prosecution. Two bank cashiers were arrested and prosecuted. \par }{\insrsid1250079\charrsid9593785 \tab \tab Plaintiff was told by the defendant\rquote s officials to keep staying at home until a final decision would be taken by the police. \par \tab \tab Plaintiff reported to Gulu Central Police Station who told him th ere was nothing wrong he had done. He then reported to the Town Clerk and told Town Clerk that police had nothing against him, but the Town Clerk insisted that plaintiff remains away from work until the defendant would get the final decision from the pol ice. \par }{\insrsid8264625\charrsid9593785 \tab \tab Plaintiff continued to report to police and defendant, but was all along being told to wait. \par \tab \tab This went on up to 2001 when plaintiff took the matter of his interdiction to Inspector General of Government; who too insisted that plaintiff first clears with the police. The police issued to plaintiff a report exonerating him. Exhibit P3. In the same communication, the police called upon the defendant \par }\pard \qj \li720\ri0\sl360\slmult1\widctlpar\aspalpha\aspnum\faauto\adjustright\rin0\lin720\itap0\pararsid4530904 {\b\i\insrsid8264625\charrsid9593785 \'93 04 The purpose}{\b\i\insrsid9730160\charrsid9593785 of this letter is to enable you decide on }{ \b\i\insrsid2172407\charrsid9593785 the }{\b\i\insrsid9730160\charrsid9593785 fate of your former cashier\'94}{\b\i\insrsid8264625\charrsid9593785 \par }\pard \qj \li0\ri0\sl360\slmult1\widctlpar\aspalpha\aspnum\faauto\adjustright\rin0\lin0\itap0\pararsid4530904 {\insrsid9730160\charrsid9593785 \tab When the Inspector General of Government Business read the contents of exhibit P3 he advised the plaintiff to institute this suit. \par \tab \tab For the defendant it is submitted that the plaintiff\rquote s suit is time barred having be}{\insrsid12321071\charrsid9593785 e}{\insrsid9730160\charrsid9593785 n filed outside the limitation period of three (3) years prescribed by section 3 (2) of the Civil Procedure and Limitation Miscellaneous Provisions Act, Cap.72; the material date, when the limitation period began to run being the 02.08.83, when the plaintiff was interdicted. \par \tab \tab It is not denied by defendant that they never communicated to the plaintiff to the effect that his services had been terminated. Defendant doe}{\insrsid12321071\charrsid9593785 s not also refute the plaintiff\rquote s evidence that in calling upon he defendant to know the final position whether or not he was to resume work, plaintiff was being told that the defendant was awaiting the final decision of the police regarding the allegations against him.}{ \insrsid9730160\charrsid9593785 \par }{\insrsid12321071\charrsid9593785 \tab \tab Therefore on the evidence adduced, the cause of action of the plaintiff was by arrangement of the defendant, made to be dependant upon the final decision of Gulu Central Police station as regards the allegations made by defendant against the plaintiff. The final decision of the police on the matter was formally made and communicated on 13.02.2004. \par }{\insrsid5655366\charrsid9593785 \tab \tab It is therefore on the 13.02.2004 }{\insrsid2172407\charrsid9593785 that }{\insrsid5655366\charrsid9593785 the defendant should have decided to reinstate or nor to reinstate the plaintiff into his job. The defendant did not reinstate the plaintiff, inspite of the final decision of the police. The cause of action of the plaintiff as regards te rmination of his employment by defendant therefore arose on 13.02. 2004 since defendant filed the suit on 14.09.2004, the plaintiff\rquote s suit is therefore not time barred. \par \tab \tab The second issue is whether or not the plaintiff\rquote s services were lawfully terminated by the defendant}{\insrsid6050994\charrsid9593785 .}{\insrsid5655366\charrsid9593785 \par }{\insrsid6050994\charrsid9593785 \tab \tab The evidence of the plaintiff is that while working as cashier in cash office with the defendant he proceeded on leave for two months that is June- July 1983, and on return from leave on 02.08.83 he found a letter interdicting him. He was told to keep at home until a final report is got from the Gulu Central police station. He was never arrested, or charged of any offence, or charged of any criminal offence, or subjected to any disciplinary action. \par \tab \tab The defendant, apart from restraini ng the plaintiff from accessing the office premises, never communicated to plaintiff dismissing him from is employment. All that they communicated to the plaintiff was that his fate, as far as resuming his work was concerned awaited the report of the Gul u}{\insrsid12667039\charrsid9593785 Central Police station regarding the allegations against him of embezzling council funds. \par \tab \tab However}{\insrsid9455248\charrsid9593785 , when the final report of police exhibit P3 came out on 13.2.2004, totally }{\insrsid9386892\charrsid9593785 exoneratin}{\insrsid2172407\charrsid9593785 g}{\insrsid9455248\charrsid9593785 the plaintiff of any wrong doing, the defendant did not take back the plaintiff into employment. \par \tab \tab The plaintiff in his employment with the defendant was a public officer: see Article 257 of the 1995 Constitution. As such plaintiff enjoyed the protection of Article 173 of the said constitution: \par \tab }{\b\i\insrsid9455248\charrsid9593785 \'93 A public officer shall not be \par {\listtext\pard\plain\b\i\insrsid9455248\charrsid9593785 \hich\af0\dbch\af0\loch\f0 (a)\tab}}\pard \qj \fi-720\li1440\ri0\sl360\slmult1\widctlpar\jclisttab\tx1440\aspalpha\aspnum\faauto\ls2\adjustright\rin0\lin1440\itap0\pararsid4530904 { \b\i\insrsid9455248\charrsid9593785 victimized or discriminated against for having performed his or her duties faithfully in accordance with}{\b\i\insrsid348917\charrsid9593785 }{\b\i\insrsid9455248\charrsid9593785 this }{ \b\i\insrsid348917\charrsid9593785 constitution}{\b\i\insrsid9455248\charrsid9593785 ; or \par {\listtext\pard\plain\b\i\insrsid9455248\charrsid9593785 \hich\af0\dbch\af0\loch\f0 (b)\tab}dismissed or removed from }{\b\i\insrsid348917\charrsid9593785 office}{\b\i\insrsid9455248\charrsid9593785 or reduced in rank or otherwise punished without just cause\'94 \par }\pard \qj \li0\ri0\sl360\slmult1\widctlpar\aspalpha\aspnum\faauto\adjustright\rin0\lin0\itap0\pararsid4530904 {\insrsid9455248\charrsid9593785 Article 173 of the Constitution is reproduced as section 59 of the Local Governments}{ \insrsid10823914\charrsid9593785 Act, Cap. 243. I}{\insrsid9455248\charrsid9593785 n }{\b\insrsid9455248\charrsid9593785 Civil Suit Number HCT \endash 02 \endash CV \endash SC \endash 0119 \endash 2001 Angwee Kalanga vs The Attorney General}{ \insrsid9455248\charrsid9593785 : this court has observed with regard to article 173 of the constit}{\insrsid348917\charrsid9593785 ut}{\insrsid9455248\charrsid9593785 ion that:- \par }\pard \qj \li720\ri0\sl360\slmult1\widctlpar\aspalpha\aspnum\faauto\adjustright\rin0\lin720\itap0\pararsid4530904 {\b\i\insrsid8543689\charrsid9593785 \'93 This Arti cle, in case of public servants, renders the common law principle that an employer may terminate one\rquote s employment, even for no cause, no longer tenable in Uganda. }{\b\i\insrsid10823914\charrsid9593785 Therefore}{ \b\i\insrsid8543689\charrsid9593785 the holding with the case of PATEL VS MADHVANI INTERNATIONAL}{\b\i\insrsid10823914\charrsid9593785 (1992 \endash 1993) HCB 189 is no long applicable to public servants in Uganda\'94}{ \b\i\insrsid8543689\charrsid9593785 \par }\pard \qj \li0\ri0\sl360\slmult1\widctlpar\aspalpha\aspnum\faauto\adjustright\rin0\lin0\itap0\pararsid4530904 {\insrsid10823914\charrsid9593785 The above applied with equal force to the plaintiff in this case. \par \tab \tab It is now settled as the law that interdiction must only last for a reasonable time, and not all the time: see Supreme Court of Uganda Civil }{\insrsid3149453\charrsid9593785 Appeal}{\insrsid10823914\charrsid9593785 No. 27 of 1992: }{ \b\insrsid10823914\charrsid9593785 Wycliffe Kiggundu vs Attorney General.}{\insrsid10823914\charrsid9593785 \par It is also the law that a dismissal from employment is wrongful if the same is made without justifiable cause and without reasonable notice: }{\b\insrsid10823914\charrsid9593785 See A. M. }{\b\insrsid734828\charrsid9593785 JABI VS MBALE MUNICIPAL COUNCIL (1973) HCB 191.}{\insrsid10823914\charrsid9593785 \par }{\insrsid734828\charrsid9593785 \tab \tab In the case of the plaintiff, no communication of dismissal was made to the plaintiff. No notice was to him. He was just made, under the quite of interdiction, to keep away from work pending a police report about some allegations. When, after a}{ \insrsid3284079\charrsid9593785 very long period, the police report came and was given to the defendant, plaintiff was not reinstated in employment.}{\insrsid734828\charrsid9593785 \par }{\insrsid3284079\charrsid9593785 \tab \tab On the evidence availed, the defendant cannot be said to have acted in compliance with the law when he made it impossible for the plaintiff to work. \par \tab \tab The answer to the second issue is that the plaintiff\rquote s services were unlawfully terminated by the defendant. \par }{\insrsid5264922\charrsid9593785 \tab \tab The third issue is whether plaintiff has suffered any damages. \par \tab \tab The evidence adduced is that plaintiff was not being paid his salary or any part of it since 02.08.83 upto August 2003, when the police issued their report on the allegations against him. Court finds that the defendant was under obligation to pay the }{\insrsid13794077\charrsid9593785 plaintiff}{ \insrsid5264922\charrsid9593785 is salary pursuant to se}{\insrsid13794077\charrsid9593785 c}{\insrsid5264922\charrsid9593785 tion 17(2) of the employment Act: See also the }{\insrsid13794077\charrsid9593785 Judgment}{\insrsid5264922\charrsid9593785 of }{\b\insrsid5264922\charrsid9593785 Kano Kora J. A. in SSCA No. 6 of 1998: G}{\b\insrsid2977640\charrsid9593785 ULLA BALLI USHILLANI VS KAMPALA}{\b\insrsid2176336\charrsid9593785 PHARMACEUTICALS Ltd.}{\b\insrsid5264922\charrsid9593785 \par }{\insrsid9332010\charrsid9593785 \tab \tab According to the plaintiff once defendant got the police report exonerating the plaintiff, and defendant refused to reinstate the pla intiff, then that is when his termination of service should be taken as effective. \par \tab \tab Court accepts the evidence adduced by the plaintiff and the submission that the effective date of termination of service is 03.08.2004. \par \tab \tab In the plaint plaintiff pleaded that his salary per month was shs 126,605/= under the U6 scale. In his testimony to court he claimed his salary to be shs 238,518/= per month. \par }{\insrsid9202076\charrsid9593785 \tab \tab There was no prayer to amend the plaint. plaintiff is bound by his pleadings. \par \tab \tab Court therefore holds that the plaintiff suffered damage by way of non payment of salary, which on average, and in accordance with what is pleaded in the plaint is determined by court to have been shs 126,605/= per month for the period from 03.08.83m the date of interdiction, to 03.08 .2004, the date found by court to be the termination date of the services of the plaintiff by the defendant. \par \tab \tab As already found by court, the termination of the employment of the plaintiff by the defendant was unlawful by reason of being contrary to the terms and conditions of services, therefore in accordance with section 61 (2) of the Local Government }{\insrsid15224301\charrsid9593785 s Act the plaintiff is entitled, and therefore has suffered damage of being denied by defendant of:-}{\insrsid9202076\charrsid9593785 \par {\listtext\pard\plain\insrsid8992965\charrsid9593785 \hich\af0\dbch\af0\loch\f0 (a)\tab}}\pard \qj \fi-720\li1440\ri0\sl360\slmult1\widctlpar\jclisttab\tx1440\aspalpha\aspnum\faauto\ls3\adjustright\rin0\lin1440\itap0\pararsid4530904 { \insrsid8992965\charrsid9593785 one years gross pay in lieu of notice as from the date of termination of service i.e. 13.08.2003 \par {\listtext\pard\plain\insrsid8992965\charrsid9593785 \hich\af0\dbch\af0\loch\f0 (b)\tab}pensions in accordance with the pensions Act \par {\listtext\pard\plain\insrsid8992965\charrsid9593785 \hich\af0\dbch\af0\loch\f0 (c)\tab}basic salary in lieu of all earned and officially carried forward leave. \par {\listtext\pard\plain\insrsid8992965\charrsid9593785 \hich\af0\dbch\af0\loch\f0 (d)\tab}Severance package equivalent to six months basic pay for every completed year of service. \par {\listtext\pard\plain\insrsid11747139\charrsid9593785 \hich\af0\dbch\af0\loch\f0 (e)\tab}}{\insrsid11747139\charrsid9593785 Transport expenses at the rate equivalent to one currency point for every five kilometers from duty station to the employee\rquote s home district headquarters. \par {\listtext\pard\plain\insrsid11747139\charrsid9593785 \hich\af0\dbch\af0\loch\f0 (f)\tab}Transport expense at the rate equivalent to fifteen currency points from home district headquarters to the employees home village. \par }\pard \qj \li0\ri0\sl360\slmult1\widctlpar\aspalpha\aspnum\faauto\adjustright\rin0\lin0\itap0\pararsid4530904 {\insrsid11747139\charrsid9593785 Issues numbers four (4) and }{\insrsid4340103\charrsid9593785 five (}{\insrsid11747139\charrsid9593785 5) will be considered together as they are interconnected with each other. \par }{\insrsid4340103\charrsid9593785 The fourth (4) issue is what is the quantum of damages suffered and the fifth (5) issue is what are the remedies available to the plaintiff. \par \tab \tab As to quantum of damages suffered by plaintiff, it is possible on the evidence adduced to quantify the loss by way of salary not paid and the one year gross pay in lieu of notice. \par \tab \tab The plaintiff was not paid his monthly salary, found by court to be on average }{\insrsid9262217\charrsid9593785 shs 126,605/= from the date of interdiction i.e. 02.08. 83 to 03.08.2004 the date found by court to be the termination date of the } {\insrsid26675\charrsid9593785 plaintiff\rquote s}{\insrsid9262217\charrsid9593785 employment. This works out: shs. (126,605/= x 21 x 12) = shs 31,904,460/= sum of shs. 31.904.460/= is awarded to plaintiff as lost salary.}{ \insrsid4340103\charrsid9593785 \par }{\insrsid9262217\charrsid9593785 \tab \tab As to the one years gross pay in lieu of notice the amount due to plaintiff is: shs (126,605/= x 12) = 1,519,260/=. Thus shs 1,519,260/= is awarded to plaintiff being one years gross pay in lieu of notice.
\par \tab \tab }{\insrsid26675\charrsid9593785 As to entitlement to pension, section 10(2) and (3) of the pensions Act would have entitled the plaintiff pension, gratuity or other allowance on the attainment of the age of forty five years and on serving a continuous period of ten years or more. T he plaintiff could also have compulsory retired on reaching the age of fifty five years.}{\insrsid9262217\charrsid9593785 \par }{\insrsid11936545\charrsid9593785 The plaintiff stated his age}{\insrsid2625132\charrsid9593785 as sixty (60) years as at the da}{\insrsid11936545\charrsid9593785 te of his testimony to court on 24.04.2007. He was thus born in 1974. }{ \insrsid2625132\charrsid9593785 By}{\insrsid11936545\charrsid9593785 the time of termination of his services by defendant on 03.-8.2004, the plaintiff was aged fifty six (56) years. He had started his employment on 10.05.73. He was thus eligible for pension under section 10 of the pensions Act, Cap. 243, and under section 61 of the local Governments A ct. \par \tab }{\insrsid2625132\charrsid9593785 \tab In the case of Angwee Kalanga vs Attorney General (supra) this court held:- \par }\pard \qj \li1440\ri0\sl360\slmult1\widctlpar\aspalpha\aspnum\faauto\adjustright\rin0\lin1440\itap0\pararsid4530904 {\b\i\insrsid2625132\charrsid9593785 \'93 Service in the public service has with it entitlement to pension, gratuity and other benefits depending on the number of years served. Continuity of service is thus of para mount value to serving in pubic service. To purport to terminate the service of a public servant through unclear and indirect means such as deleting an employee\rquote s name from the pay roll cannot be allowed by this court as lawfully terminating the service of the }{\b\i\insrsid4530904\charrsid9593785 plaintiff}{\b\i\insrsid2625132\charrsid9593785 and thus deprive him }{\b\i\insrsid4530904\charrsid9593785 entitlement}{\b\i\insrsid2625132\charrsid9593785 to pension, gratuity and other benefits that are intended for a public servant and his/her family to fall on in retirement. To do so would amount to violating Article 173 of the Constitution to the prejudice of the plaintiff\'94 \par }\pard \qj \li0\ri0\sl360\slmult1\widctlpar\aspalpha\aspnum\faauto\adjustright\rin0\lin0\itap0\pararsid4530904 {\insrsid2625132\charrsid9593785 The above holding equally applies to the plaintiff in this case. \par \tab \tab In the case, unlike in the Angwee Kalanga, case where a declaration that the plaintiff was entitled to pension was sought, the plaintiff claims general damages for the suffering, including loss of pension caused to him by the defendant\rquote s unlawful conduct in the matter; pension entitlement and }{\insrsid14436438\charrsid9593785 c}{\insrsid2041977\charrsid9593785 al}{\insrsid14436438\charrsid9593785 c}{\insrsid2041977\charrsid9593785 u}{\insrsid14436438\charrsid9593785 la}{ \insrsid2041977\charrsid9593785 tion}{\insrsid2625132\charrsid9593785 being one of them; basic salary}{\insrsid2041977\charrsid9593785 in lieu of all erred and officially carried forward leave is another. Since defendant made it impossible for plaintiff to work, it is not possible for court to calculate the }{\insrsid4530904\charrsid9593785 severance package}{\insrsid2041977\charrsid9593785 equivalent to six months basic pay for every completed year of service as it is a matter of }{\insrsid4530904\charrsid9593785 argument as}{\insrsid2041977\charrsid9593785 to what is a }{\b\insrsid2041977\charrsid9593785 \'93completed year of service\'94 .}{\insrsid2041977\charrsid9593785 Given the nature of the termination of the plaintiff\rquote s employment and the lapse of time}{\insrsid16142917\charrsid9593785 it has taken, the exact amount due to plaintiff by way of transport expense cannot be easily ascertained also.}{\insrsid11936545\charrsid9593785 \par }{\insrsid16142917\charrsid9593785 \tab \tab In two cases, rather of recent, and with facts similar to those of this case, the High Court, has on the principles that general damages are awarded at the discretion of the court, as compensation to pla}{ \insrsid1779890\charrsid9593785 c}{\insrsid16142917\charrsid9593785 e the plaintiff in as good as pos}{\insrsid1779890\charrsid9593785 i}{\insrsid16142917\charrsid9593785 tion as he/she would have been had the wrong complained of not taken pla}{ \insrsid1779890\charrsid9593785 c}{\insrsid16142917\charrsid9593785 e, proce}{\insrsid1779890\charrsid9593785 e}{\insrsid16142917\charrsid9593785 ded to award general damages. \par \tab \tab In }{\b\insrsid16142917\charrsid9593785 Christopher Yiki A}{\b\insrsid9386892\charrsid9593785 g}{\b\insrsid16142917\charrsid9593785 atre vs Yumbe District Local Government: HCCS No. 0022/2004}{\b\insrsid995985\charrsid9593785 }{ \insrsid995985\charrsid9593785 court awarded shs 55,000,000/= by way of general damages to a Chief Administration Officer for loss of job and income and failure to pro vide for is family. The plaintiff claimed in that suit damages for unlawful dismissal and sought to be paid his salary and allowances and general damages for breach of c ontract of employment amongst other prayers. \par }{\insrsid3149453\charrsid9593785 \tab \tab In this case, the plaintiff, as a cashier, is of a lower status than the Chief Administrative Officer in the }{\b\insrsid3149453\charrsid9593785 \'93 Christopher Yiki Ag}{\b\insrsid4530904\charrsid9593785 a}{ \b\insrsid3149453\charrsid9593785 tre\'94}{\insrsid3149453\charrsid9593785 case; and a district engineer in the }{\b\insrsid3149453\charrsid9593785 \'93 MARCELO LERI KOWO}{\b\insrsid4530904\charrsid9593785 \'94}{\insrsid3149453\charrsid9593785 case, and therefore the damages to him should be lower than those awarded in the two cases.
