Ruling

1. This file was opened for purposes of considering whether the convict Princess Okoye is suitable for consideration of her sentence review in the spirit of prison decongestion pursuant to the Chief Justice Memo dated 7th December 2022.

2. The applicant was convicted for the offence of Trafficking of narcotic drugs contrary to section 4 (a) of the Narcotic drugs And Psychotropic Substances Control Act No.4 of 1994. She was sentenced on 22nd December 2020 to pay a fine of Ksh.9,421,839/- in default to serve a one-year imprisonment for count I and a fine of Ksh.1,908,165/- in default to serve a one-year imprisonment for count II.

3. In addition, she was sentenced to serve ten (10) years imprisonment. All the sentences were to run consecutively starting from 11th March 2019.

4. According to the probation report dated 3rd February 2025 on record the Applicant has served five years and eleven months of her sentence. The Applicant still has six years and one month left to serve and does not have a balance of 3 years on her sentence.

5. I therefore find that the Applicant is not eligible for early release.
