1. I have perused the application (Chamber summons) dated 22/12/2022. I certify it as urgent and grant leave to the applicant to be heard during the recess.

2. On the main motion, I have perused the grounds and the supporting affidavit. I am satisfied that in the interim, the applicant deserves the orders sought as he has demonstrated a prima facie case.

3. I certify the application as urgent and grant Prayer 2 of the Notice of Motion dated 22/12/2022 and order that the applicant is hereby arrested and released on cash bail of Kshs. 50,000/= to report to the DCI Siaya on 30/12/2022 at 10. 00 am as summoned by Police Constable Peter Magiri on 20. 12. 2022 and report back to court at 2 pm for further orders.
